OFFICERS REPORTS Certification of Posting Clerk's Cash Statement for December, 1970 Budget Report for December, 1970 Library Report for December, 1970 Police Report for December, 1970 COMt"UNICATIONS A letter from the Edgewater Beauty Shop requesting that a street light be placed across the street from her place of business was read by the City Clerk. Councilman Wiggins duly made a motion for the matter be turned over to the Street Department and get recommendations from the Florida Power and Light Company to see if a light is needed on the street. Said motion was seconded by Councilman Lodico. Upon roll call vote, said motion CARRIED. A letter from Sam Andrews and the residents of Silver Ridge regarding a drainage ditch joining Silver Ridge making it a breeding place for mosquitoes. Mr. Cutshaw stated he ha~ been working with the Mosquitoe Control Service and they have decided the pipe under U.S. Highway 1 will have to be lowered before the problem can be solved. A letter has to go to the State before the pipe can be lowered. A motion was duly made by Councilman Ganta to table the letter until we hear from the State, being seconded by Councilman LOdico. Upon roll call vote, said motion CARRIED. ORDINANCES ORDINANCE NO. 679: AN ORDINANCE ADOPTING ROBERTS RULES OF ORDER AS REVISED FROM TIME TO TIME AS SUPPLEMENTARY RULES OF PROCEDURE APPLICABLE TO MEETINGS OF THE CITY COUNCIL, TO BE IN FORCE AND EFFECT WHEN SAID ROBERTS RULES OF ORDER ARE NOT IN CONFLICT WITH THE CHARTER OR ANY ORDINANCE OF THE CITY OF EDGEWATER, FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFOR. The above Ordinance was read by the City Attorney, Charles A. Hall. Councilman Lodico duly made a motion to adopt the said Ordinance being seconded by Councilman Fugate. Upon roll call vote, said motion CARRIED with Mayor Cairnie voting Nay. -2- , r u o o '1 U ORDINANCES, cont A motion was duly made by Councilman Lodico to waive the second reading of the Ordinance and seconded by Councilman Fugate. Upon roll call vote, said motion CARRIED. RESOLUTIONS RESOLUTION NO. 387: A RESOLUTION ACCEPTING THE AUDIT REPORT FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1969 AND ENDING OCTOBER 31, 1970 PREPARED BY TURNEY & DUPREE, CERTIFIED PUBLIC ACCOUNTANTS, AND AUTHORIZING PAYMENT TO THE SAID TURNEY & DUPREE FOR SERVICES PERFORMED IN PREPARING SAID AUDIT REPORT AND ALL PRELIMINARY WORK THERETO, IN THE AMOUNT OF $2,000.00 WHICH SAID SUM OF $1,000.00 IS TO BE PAID FROM THE GENERAL FUNDS AND $1,000.00 FROM THE WATER & SEWER-OPERATION AND MAINTENANCE FUND. Councilman Lodico duly made a motion to adopt the Resolution being seconded by Councilman Ganta. Upon roll call vote, said motion CARRIED. RESOLUTION NO. 388: A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK, ON BEHALF OF THE CITY OF EDGEWATER, TO EXECUTE AN EASEMENT OF FIVE (5) FEET IN WIDTH TO THE FLORIDA POWER AND LIGHT COMPANY, A FLORIDA CORPORATION, SAID EASEMENT LYING AND BEING WITHIN LAND DEEDED TO THE CITY OF EDGEWATER BY VOLUSIA COUNTY, FLORIDA IN THAT CERTAIN DEED RECORDED IN OFFICIAL RECORDS BOOK 523, PAGE 289, PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA, DECLARING THE GRANTING AND GIVING OF SAID EASEMENT TO BE A PUBLIC PURPOSE AND IN THE BEST INTEREST OF THE CITY OF EDGEWATER AND PROVIDING AN EFFECTIVE DATE THEREFOR. A motion was duly made by Councilman Fugate to table the Resolution so the Council can check into it. Said motion was seconded by Councilman Lodico. Upon roll call vote, said motion CARRIED. OLD BUSINESS Councilman Fugate duly made a motion that the light be granted to J.B. O'Connell which was tabled at last meeting. Said motion was seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. A request by residents of Coquina Drive for the street to be paved was tabled at the last meeting so the City Attorney could investigate and see if the street is dedicated to the City. The City Attorney stated the street is not dedicated to the City and in order for the city to pave the street, a quick claim would have to be signed by each resident granting the necessary easement. A motion was duly made by Councilman Ganta to study the matter further with the City Attorney. Said motion was seconded by Councilman Lodico. Upon roll call vote, said motion CARRIED. Councilman Fugate duly made a motion that the request of the Reid's for a fishing dock to be built on their property, be granted. Seconded by Councilman Lodico. Upon roll call vote, said motion CARRIED. A motion was duly made by Councilman Lodico to further study the drainage problem on Palmetto Street with Max Massey being seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. Councilman Lodico duly made a motion to move the fireplug at the corner of Ocean Avenue and Old County Road at the request of Coronado Paint. Said motion was seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. -3- , . u o (.) o . .f .. NEW BUSINESS The Certification of Bids for a new Garbage Truck were opened and read by the City Clerk. The bids were as follows: Florida Equipment Company International Harvester Company Smokey's Auto Service Stephen Ferguson Pontiac .Truck Equipment Inc. $16,370.00 $13,259.77 $15,209.00 $12,880.00 $13,818.17 Square Deal Machinery stated they were unable to submit a bid at this time. Councilman Lodico duly made a motion to table the bids for further study being seconded by Cou~ci1man Wiggins. Upon roll call vote, said motion CARRIED. A motion was duly made by Councilman Lodico to accept the report from Outlaw Engineering Firm on up-dating of the Sewer plant and authorizing of payment of service rendered. Said motion was seconded by Councilman Fugate. Upon roll call vote, said motion CARRIED. MISCELLANEOUS Mr. Bebbington complained about a Construction company who moved their equipment to South India Palm several months ago and they have not started building. Mr. Bebbington was advised that it had not been six months since the permits were issued and they can renew the permit for another six months if construction has not started. Mr. Clinton complained about bayonets planted beside their driveway, obstructing their view of the highway. Mr. Clinton stated he wanted the City to have the people cut them down since the bayonets were higher than the City Ordinance stated they could be. The City Attorney advised Mr. Clinton he would have to go see the Judge and swear out a warrant for his neighbors arrest and bring the matter before the court, otherwise the City could not do anything. There being no further business, Councilman Fugate duly made a motion to adjourn. Seconded by Councilman Wiggins. Upon roll call vote, said motion CARRIED. Time of Adjournment: 8:55 P.M.
