OF EDCEWATER, FLORIDA HELD OCTOBER 21ST, 1963 The Regular Meeting of the City Council of the City of Edgewater, Florida held October 21, 1963 was called to order by Mayor A. Hussey at 7:30 P.M. Fred Garlick Present Present Present Present Present Present Present Present Present Present Tom Groover, Representing Briley, Wild & Associates, presented recommendations on the three remaining bids necessary for the purchase of materials for water extension. They were as follows: Part III - Item 3 - 6" Gate Valves and Valve Boxes Hughes Supply $685.19 Unit price $62.29 Part IV - Fire Hydrants Agricon, Inc. $744.80 Unit price $106.40 Part V - Cast Iron Fittings Agricon, Inc. $760.00 Unit price $380.00 The materials to be purchased under Part V will consist of the following: 13 - 6" x 6" Crosses 9 - 6" Tees 16 - 6" Plugs 15 - 6" Tapped Plugs (Tapped 2") 5 - 6" Caps Motion duly made by Councilman Palmateer we accept bids as recommended by Briley, Wild & Associates for these three items, seconded by Councilman Drury and by vote CARRIED. Roll call vote being as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Drury Mayor Hussey Yea Yea Yea Yea Yea Attorney Ossinsky' said he will draw up an appropriate ordinance for accepting all the bids, on the authority of the Council. Mr. Groover said the companies will hold the prices for thirty days but said that they would probably give the City a few extra days since they do want the business. Mr. Groover suggested that letters be written to these companies saying that the Engineers recommendations had been accepted. ,: I .~ \1 ~ tJ 'V Attorney Ossinsky said that these letters could be written but at any time before the ordinance is drawn up and passed, the Council could, if they desired, change their minds. Motion duly made by Councilman Palmateer the Attorney draw up an ordinance necessary for the purchase of these materials for the water~ lines, seconded by Councilman Siller and by vote CARRIED. Roll call vote being as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Drury Mayor Hussey Yea Yea Yea Yea Yea The Minutes of the Regular Meeting'Jof October 7th, 1963, the Continued Meeting of October 11th, 1963 and the Minutes of the two Special Meetings of October 14th, 1963 were presented to each Councilman for his approval. Motion duly made by Councilman Siller these minutes stand approved as submitted, seconded by Councilman Seng and by vote CARRIED. Councilman Siller explained about the $320.00 paid to Wilbur Farnell for work in Florida Shores. He said the Council realizes the need of the Dragline in Florida Shores after that last rain. He said that if the Council had been contacted, they would have had someone from Edgewater. We would rather have someone from Edgewater. Mayor Hussey said he believed the people in Florida Shores were well aware of the conditions there. Mr. Smith, from Florida Shores, said he knows this man, Mr. Farnell, and he said he did good \'JOrk. l~or Hussey said he did not want to take anything avay from anybody. It was an emergency. Councilman Siller said some citizens of Edgewater asked him why they were not contacted. He said we should have at least contacted someone in the City. Nayor Hussey said he overlooked this fact. He said Mr. Smith said he knew this man. If I am wrong I admit it. Library Report for the month of September, 1963, was read. Report from the Board of Governors - Community Center - for November 1961 through September 1963, was read. Certification of posting dated October Sth, 1963, I~S read. Certification of posting dated October 16th, 1963, was read. CONHUNICATIONS A letter was read from the Edgewater American Legion, Post 2S5, requesting that the City of Edgewater purchase a suitable wreath, to decorate the Veterans Monument, during the Veterans Day ceremonies November lOth, 1963 as has been done in the past.. Motion duly made by Councilman Seng the City purchase the wreath for the Veterans Day ceremonies, seconded by Councilman Palmateer and by vote CARRIED. Roll call vote being as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Drury :Hayor Hussey Yea Yea Yea Yea Yea . . ~ u , I I v u v A letter was read from the Edgewater Public Library Board asking for an advance of $35 from the Library Budget for expenses for the trip to Ocala by Thelma Hennig and this money is to come out of the budget for the fiscal:year ending October 31, 1963 since it was included in the Library Budget for this year. They also requested that $2 be advanced for the membership of Mrs.. Hennig in the Florida Library Assoc. out of this years budget. Motion duly made by Councilman Seng we advance Mrs. Hennig $35 from this years budget for her trip to Ocala and advance her $2 for her enrollment fee in the Florida Library Assoc., seconded by Councilman Siller and by vote CARRIED. Roll call vote being as folloiiS:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Drury Mayor Hussey Yea Yea Yea Yea Yea A letter from the Edgewater Civic Association was read stating that at an October 17, 1963 meeting, the members of the Edgewater Civic Assoc. expressed their wi]ingness to cooperate with the City Council to the best of their ability towards protecting, preserving and beautifying our river front. A letter was read from the Edgewater Civic Assoc. concerning the painting of Fog Lines outlining the curbing on Riverside Drive and U.S. #1. They said this would be especially helpful on foggy nights. The Council agreed that the Clerk should write some letters and see what could be done about this. ORDINANCES ORDINANCE NO. 365 AMENDING ORDINANCE NO. 325, THE SAME BEING AN ORDINANCE APPROPRIATING REVENUES. TO BE COL~TED FOR THE. CITY OF EDGEVlATER, VOLUSIA COUNTY, FLORIDA, FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1962, AND ENDING OCTOBER 31, 1963 TO THE VARIOOS ITEMS OF THE CITY BUDGET. The above ordinance was read in full by City Clerk O'Connell and motion duly made by Councilman Siller this Ordinance be adopted, seconded by Councilman Palmateer and passed by vote of the City Council of the City of Edgewater, Florida at the Regular Meeting of the said Council held October 21st, 1963. The above resolution 'Was read in full by City Clerk O'Connell and motion duly made by Councilman Palmateer this resolution be adopted, seconded by Councilman Seng and passed by vote of the City Council of the City of Edgewater, Florida at the Regular Meeting of the said Council held October 21st, 1963. Roll call vote being as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Drury Mayor Hussey Yea Yea Yea Yea Yea OLD BUSINESS None NE:W BUSINESS None A letter was read from Louis Ossinsky, Jr. regarding the interest of the City of Edgewater, Florida in Ma,c's Bar, Inc. vs. Oliver Rosengarten, et al, Circuit Court, Volusia County, Florida, Chancery No. 35,331. The Building Restriction which is being sought is nNo dwellings to be erected on Lots l4A, l4B, 15A and 16A.n He stated the interest of the City is limited. If the Citycowns property in the subdivision which was to receive the benefit of the restrictions the City would have an interest and should intervene in the suit as a party Defendant to oppose the removal of the restrictions provided it is desirable to do so. If the City does not own property Which was to receive the benefit of the restrictions, the City has no interest in the suit and could not lawfully intervene or defen~ in behalf of anyone. The City's interest therefore is limited to protecting its own property if it has any. Councilman Seng said he did not believe the City owned any property abutting this property mentioned. He said therefore, he did not feel the City should be mixed up in the law suit.
