A letter was read from Louis Ossinsky, Jr. regarding the interest of
the City of Edgewater, Florida in Ma,c's Bar, Inc. vs. Oliver Rosengarten,
et al, Circuit Court, Volusia County, Florida, Chancery No. 35,331.
The Building Restriction which is being sought is nNo dwellings to
be erected on Lots l4A, l4B, 15A and 16A.n
He stated the interest of the City is limited. If the Citycowns
property in the subdivision which was to receive the benefit of the
restrictions the City would have an interest and should intervene in
the suit as a party Defendant to oppose the removal of the restrictions
provided it is desirable to do so. If the City does not own property
Which was to receive the benefit of the restrictions, the City has
no interest in the suit and could not lawfully intervene or defen~
in behalf of anyone. The City's interest therefore is limited to
protecting its own property if it has any.
Councilman Seng said he did not believe the City owned any property
abutting this property mentioned. He said therefore, he did not feel
the City should be mixed up in the law suit.
There being no further business motion duly made by Councilman Palmateer
we now adjourn, seconded by Councilman Drury and there were no objections.
Hinutes taken by Marie Robinson.
