The Continued Meeting of the City Council of the City of Edgewater, Florida

DECISIONS ON BIDS:
Councilmm1 Seng said it is imperative that the ditches must be cleaned and
done as soon as possible.
Councilw~n Drury stated the City should require a 100% Performance Bond
and request the contractor to cut dOl~ the first payment to $1,000.00.
Councilman Palmateer said -- first decide whether to buy the truck crane
and then decide on clearing the ditches.
Motion duly ro~de by Councilman Seng to accept the bid of J. B. }~rtin of
Titusville, seconded by Councilman Drury and by vote 6ARRIED.

The Council asked IVll'. VJ.a.rtin if he would provide the Performance Bond and
accept ~l,OOO.OO as first payment and he told them he would.
Before voting Councilman Palmateer said he did not think the City was re-
sponsible for cleaning the ditches--that it should be up to the property
Oi'mers.
Motion duly made by Councilman Siller to accept the bid of Design Metals of
DeLand to install the Traffic Signals with concrete poles being used in place
of steel poles, seconded by Councilman Ifrury and by vote CARRIED. Roll call

AN ORDINANCE ACCEPTING BID OF DESIGN HETAlS, INC. Al\TD REJECTING ALL
OTHER BIDS.
The above ordinance was read in full by City Clerk Kathryn B. O'Connell
and motion duly made by Councilman Siller this ordinance be adopted,
seconded by Councilman Seng and passed by vote of the City Council held

Attorney Ossins~J said he wanted to make it clear to the Council the
Ordinance is only an acceptance of the bid, to be followed by a contract.

Mayor Hussey got up and told the audience he wanted to make it clear
that he wanted the ditches cleaned as much as anyone else but he felt
the City should buy their ovm equipment.
Councilman" Seng rerrinded }~or Hussey that when the City Engineer, }w.
Groover, read off the expenses of the dragline it will cost approximately
the same as it vall for a contractor to do the work. He also said the
County }10squito Control had given them figures shovnng it costs approxi-
mately $10,000.00 a year to operate a dragline.
COQ~cilw4n Seng said he felt they should discuss further the bids of the
truck crane and the Fire House ~~ension before deciding.

Attorney Ossins~J told the Council the Ordinance was supplied by the Florida
League of Municipalities and would go into effect July 1st. He also asked
the City Clerk to send a certified copy to the Beverage Department.

Attorney Ossinsky reported to the Council there '\Inll be no bills coming to
the City for paving--the paving is being done by the County.
Counciillan Seng said he didn't think it vias fair for the ovmers that have
already paid their share of paving other streets in the City.
Attorney Ossinsky said he had received an inquiry from the Bulkhead line
and the City Clerk told him she had received the ~ap and legal descriptions
today and would give them to him.
Attorne~ Ossinsky told the Council he had received certified copies of House
Bill #1~09 & House Bill # 2155 from Tom Adams, SecretarJ of State. He said
#1809 is subject to a referendum and #2155 vnll not go into effect unless

#1809 is rejected. #1809 will have to have a Special Election prior to
August 1, 1963. Attorney Ossinsky said July 30th is the last Tuesday in
July.

Councilman Seng \vanted to knoH if it is possible to kno'w vmat changes had
been wade in the charter and Attorney Ossinsky said yes, only a few changes
\'lere made and he would be glad to wake a list of them.
In reference to the Charter Attorney Ossinsky said it takes the knowledge
of a competant lawyer to construe.
Attorney Ossinsky presented a bill for $89.44 for the two certified copies.
He also told the Council he had not had time to study the garbage ordinance.

1. Letter from State Beverage Department regarding increase in
Cigarette tax which Council passed in Ordinance #354 above.
2. Letter from HousLDg & Home Finance Agency instructing the City
to proceed with plan preparation and to establish a planning
account. (This was done in Resolution #18 above.)
3. A letter from Jess Mathas, Clerk of the Circuit Court, informing
the Council that the date of July 8 A.D. 1963 beginning at 9:00
O'clock A.M. has been set for the first meeting of the Board of
Equalization of Volusia County, Florida.
Attorney Ossinsh~ instructed the City Clerk to call ~~. ~~thas
and find out what day they will get to the Edgewater section and
then the Council can plan to attend.

NEW BUSINESS
Councilman Palmateer wanted to know--since the Resolution was passed--
i~ere the contractor is going to put the refuse.
Counci1Lman Drury stated }iI..r. Smith i'lould take care of that. Smith has
been suggested to be the inspector.
Attorney Ossinsky reminded the Council there is a lot to go in the con-
tract of cleaning the ditches.
Councilman Drury said he vlOuld be glad to take Hr. Groover, - the City
Engineer, on a survey of the ditches.
}~yor Hussey said the spoils from the ditch digging is entirely different
from the sewer spoils.
