Motion duly made by Councilman Cairnie these minutes stand approved as submitted, seconded by COtUlcilman Ridgdill and by vote CARRIED. The roll call vote was unanimous. OFFICERS REPORTS The Librarian's Report for the month of September, 1964, was read. The Police Department Report for the month of September, 1964, was read. The Budget Report for the month of September, 1964, was read. Clerk's Cash Statement for the month of September, 1964, was read. Certification of Posting dated October 6th, 1964, was read. Mayor Armstrong expressed his appreciation to the Department Heads and the City Clerk and her staff for the above reports. COMMUNICATIONS A letter was read from the Edgewater Union Church dated October 12, 1964 stating that at the regular meeting of the Board of Directors it was l.manimously voted to ask the City for a...t~affic police officer to be stationed at the crossing at S. Ridgewood and Ocean Avenue on Sl.mday. Mayor Armstrong said the COl.mcil discussed this at the last Friday Night Meeting. He said he didn't think it would be right to send someone do\'m there that does not have full authority. I will ask that the patro~ t b who is on duty go down there~and direct traffic during the servicesJ- TWe usy. person down there should either have a light of some kind or a police car so that people will obey him. Otherwise it will be an effort in vain. The Hayor said he would contact Mr. Moorley and see if we could get some directional sign of some kind similar to what they have at school crossings. He said he realized that this was an older congregation than the Methodist Church and we do want to cooperate. He said that Mr. John, who formerly worked out there on Sl.mday, had trouble getting the people to obey his command. COl.mcilman Cairnie said the Methodist Church does not have too much of a problem because the traffic light slows the traffic do\'m and the people can go to the light and cross. He would advise that ;',the Police Department plan on spending 15 or 30 minutes at the Union Church on Sl.mday if they are not busy with something else. " o \ , ", ORDINANCE NillmER 421 AMENDING A PORTION OF ORDINANCE NO. 363, THE SAME BEING AN ORDINANCE APPROPRIATING REVENUES' TO BE COLLECTED FOR THE CITY OF EDGE.WATER, VOLUSIA COUNTY, FLORIDA FOR THE FISCAL YEAR BEGINNING NOVEMBER I, 1963 AND ENDING OCTOBER 31, 1964, TO THE VARIOUS ITEMS OF THE CITY BUDGET. The above ordinance was read in full by Attorney Clark and motion duly made by Councilman Cairnie this ordinance be ad~pted, seconded by Councilman Ridgdill and passed by vote of the City Council of the City of Edgewater, Florida at the Regular Meeting of the Council held October 19th, 1964. ORDINANCE NUMBER 422 APPROPRIATING REVENUES TO BE COLLECTED FOR THE CITY OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, FOR THE FISCAL YEAR BEGINNING NOVEMBER 1ST, 1964 AND ENDING OCTOBER 31ST, 1965, TO THE VARIOUS ITEMS OF THE CITY BUDGET. The above ordinance was read in full by Attorney Clark and motion duly made by Councilman Cairnie this ordinance be adopted, seconded by Councilman Ridgdill. Discussion. Councilman Tingle: There is nothing in the budget for a City Manager. The last two meetin@ Lhave made motion to advertise for City Manager. I thought the money was set up in the budget. At one of our former meetings, according to the minutes, someone m ked how much was set up in the budget for a city manager and Mayor Armstrong said about $7,200. Now I have been told a decision has been made to take this out of the budget. I don't know when it was taken out. Mr. Tingle read an Editorial from the Miami Herald dated October 9, 1964 concerning the International City J.fanagers Meeting. Councilman Tingle: We need a City Manager. vIe do not know who will be sitting here in two years. I'layer Armstrong: The City Clerk and the whole council have;'worked very hard in the best inerest of everyone to set up this budget. I am sorry you misunderstood the budget as it was tentatively set up. The budget was posted on two bulletin boards. There was no appropriation for City Manager then. We are in pretty good shape now and only about three departments went over their appropriated money. In the future we may need a Supt. of Public Works or a City Manager to see that work is done in right manner but the time has not come yet. The Council and City Clerk has spent 24 nights going over these things for the budget. No one has been blindfolded. Councilman Tingle asked Mr. Armstrong if he would take the job as City Manager if it were a paying job. Hayor Armstrong said "No'l I am not interested in taking City 1-1anager Job. Councilman Tingle: If any company offered you job on outside would you take it? Mayor Armstrong: No. I took this job for two years and plan on keeping it. Councilman Siller asked" if the budget, good be juggled later on to allow for a City I~anager. . . u u u u '. Mayor Armstrong: Yes, as long as it is for salaries you can do this. As long as you can get the m:>ney from other departments. The Ordinance (No. 422) was passed by vote of the City Council of the City of Edgewater, Florida at the Regular Meeting of the Council held October 19th, 1964. The vote of said CO\mcil was manimous. RESOLUTIONS RESOLUTION NUMBER 61 FAVORINGTHE INTERVENTION OF THE PRESIDENT OF' THE UNITED STATES TO SETTLE THE FLORIDA EAST COAST RAILWAY STRIKE. The above resolution was read in full by Attorney Clark and motion duly made by CO\mcilman Cairnie this resolution be adopted and sent to the President and other agencies stated in the resolution, seconded by Comcilman Siller and passed by vote of the City Council of the City of Edgewater, Florida at the Regular Meeting of the said CO\mcil held on the 19th day of October, A.D. 1964. RESOLUTION NUMBER 63 APPOINTING AN ELECTION CLERK, INSPECTORS AND A SPECIAL OFFICER FOR THE SPECIAL ELECTION TO BE HELD IN THE CITY OF EDGEtrlATER, VOLUSIA COUNTY, FLORIDA ON NOVEMBER 3RD, 1964. The above resolution was read in full by Attorney Clark and lOOtion duly made by Councilman Siller this resolution be adopted, seconded by Councilman Tingle and passed by vote of the City Council of the Ci ty of Edgewater, Florida at the Regular Meeting of the said council held on the 19th day of October, A.D. 1964. The roll call vote was unanimous. OLD BUSINESs None NEW BUSINESS Motion duly made by Councilman Siller that all conununications submitted to the City be addressed to Mayor and Council and state whether they should: be read at public meeting or acted upon at closed session. All communications shall be in city hall by 4:00 P.M. the Friday before the regular meeting. Any after that will not be read. This motion was seconded by Councilman Ridgdill. Mayor Armstrong explained that sometimes letters are addressed to Mayor only. They could be considered a personal letter. It hasn't happened yet. He said he has always brought letters before the Council that had anything to do with CityBusiness. Some letters could be very embarassing and on ffiiday Night we can go over them. We can search for the truth before we come over here. If the letter can not be read publicly we will notify the party who wrote it. r1r. Ted Peck asked if these Friday Night Meetings are official. Mayor Armstrong said No. Councilman Cairnie said this motion of Councilman Siller does not stop anyone from getting up at meetings and saying anything. The roll call vote on the motion of Councilman Siller seconded by Councilman Ridgdill was unanimous. MISCEllANEOUS Tom Groover, from Briley, Wild & Associates, gave a report on the sewer project dated October 19th, 1964. This report has been made a part of the minutes. Councilman Siller asked the per cent of work done on Contract Number 1. Tom Groover said about 85%. u I. ,.;,r /" " i r It ~ u u Mrs. Ted Peck asked about the progress with the electric power contract. Mayor Armstrong said he was at the last meeting of the City of New Smyrna Beach City Council. They are waiting for Attorney General report. He said it is our move. i'lhat the rove will be we have not decided. According to Mr. Duane the steam plant will be shut down soon. It just can't go on as it has been., I hope we \-all have a favorable an-swer from the Attorney General. I believe if they could legally do it they would release US from the contract. As soon as I find out something I will let the people know. Mrs. Peck said that Mayor Hathaway of New Smyrna Beach sounded like he was going to challenge us. Mayor Armstrong: I interpret it to mean if we enter suit, it would not be contested. Attorney Clark: That was not a challenge. It is the interpretation of the attorney in New Smyrna Beach that the Mayor does not have the power to break the contract. The City of Edgewater would have to break the contract. This plant in New Snwrna Beach is new. In a year the City of New Smyrna Beach may find themselves in a position to be competitive price wise and still givelO% Rebate. The paper figures anticipate this. I am not saying this will happen but it is something to look into. They are alvs.iting reply from the Attorney General. A lengthy discussion was heard concerning the Rebate from New Smyrna Beach and Florida Power & Light Co. l-1rs. Peck asked the City Attorney if he thought we should wait one year and suffer through this inefficiency. Attorney Clark said that in a year the picture might be rosier. We have to check what kind of a franchise we could get from Florida POv~r & Light. Many factors must be considered. We have a third party in Florida Power & Light Co. It will be four to six months til we have anything finalized. The City of New Snwrna Beach realizes they will have to give us a firm commitment. Mrs. Peck said the high rates are driVing people away. Councilman Cairnie: The quicker we get out of the contract with New Smyrna Beach the better we will be. New Smyrna Beach Electric is not under the Utilities Conunission. We have no protection. They can change rates when ever they want to. The faster we get rid of New Snwrna Beach Electric the better. Mayor Armstrong advised the children to have a good time on Holloween but refrain from destruction of private and public property. l-layor Armstrong said that in a year or so we may be able to release about $25,000 to the General Fund from the "later Department. This lIlDIley would go into General Government. Thi~ would be a pig help to Edgewater as far as finances are concerned. Mrs. Robert Maxwell said she thought this money would be used for extensions. Mayor said there is a fund for just the one purpose of extensions. l'flr. DaVid L. Wiggins, Sr. said Indian River Blvd. is full of holes and would like something done about this. The Mayor said the ,'" 'v men were supposed to fix this late this afternoon but if they didn't get to it,it will be done very soon, " u ~ v Mrs. Maxwell said that Orange Tree Drive is very bad. She said some holes have been there for months. Mayor Armstrong said the city has some good shell and will take care of this as soon as it can. Mayor Armstrong said there has been a little trouble with the paving in Florida Shores. The County is l\Orking hard and when it is done it will be a good job.
