and l1inutes of the Special Meeting of the City Council held October 2nd, 1964
were presented to each Councilman for his approval. l1otion duly made by
Councilman Cairnie these minutes stand approved as submitted, seconded by

Motion duly made by Councilman Siller these bills be paid and be w4de
a 'part of the minutes vnth the exception of $428.74 to be deducted from
bill of $589.53 from City of New Smyrna Beach Utility Department
since this city has been vnthout street lights for 14 nights, seconded
by Councilman Cairnie and b~T vote CARRIED. The roll call vote was unanimous.
OFFICERS REPORTS
The Building Official's Report for the month of September, 1964, was read.
Certification of Posting dated September 22nd, 1964, was read.
Certification of Posting dated September 29th, 1964, was read.
Certification of Posting dated October 2nd, 1964, was read.
Mayor Armstrong thanked the City Clerk and Building Official for the
fine reports.
COMMUNICATIONS
A letter was read from George Spears, dated September 23, 1964,
regarding rezoning of Hart Avenue. A petition was also presented.
A letter was read from the Zoning and Planning Board, dated October 1, 1964,
stating they recommend the request for variance by Hazel R. Coyle
be denied.
A letter was read from Jennie L. Keel dated September 30, 1964, requesting
the rezoning of her home so she can operate a beauty parlor.
A letter was read from Alphonse Bosse, dated October 5, 1964, protesting
the handling of the arrest of his son by Chief of Police Hayman and the
way Mr. Bossee was treated by the Chief of Police.
A letter was read from Thelma L. Hennig, Chairman of the Library Board,
dated October 1, 1964 , requesting $10 for trip of Librarian and a member
of the City Council to the Central Florida Regional Meeting on Library
Finances in Orlando, October 14th, 1$64. Also requested $7 to pay
for a substitute librarian for that day.
11ayor Armstrong said the City Council had this peition from the people
on Hart Avenue vnth 34 names on it. He said he did not know if the
Zoning Board had seen it.
Motion duly w4de by Councilman Cairnie ,~ foliow the recommendation of
the Zoninf and Planning Board and deny the request for variance as requested
by Hazel COyle, seconded by Councilman Siller (due to the names on the
peti tion).
Mrs. Edith Peck asked what alternative the o,vner of this trailer park
hasJdue to the denial of the request for variance.
}~yor Armstrong said a number of people on Hart Avenue object to it
since this would allow building to the property line if it was granted.
11rs. Coyle said she just was asking for 75 feet to be rezoned.
Mr. Cliff Mosher said the petition presented tonight was not presented to
the Zoning Board. He said the hearing was well advertised in the newspaper.
There were 14 people at the hearing and two were in favor of the rezoning
and all the rest were against it.
The roll call on the denial of variance was unanimous. Councilman Ridgdill
wished Mrs. Coyle best ofluck in the future. Mayor Armstrong said if he
could be of any help in her t~x problem he would be glad to give his assistance.

Motion duly made by Councilman Cairnie the letter from Jennie Keel in reference
to rezoning be turned over to the Zoning and Planning Board, seconded by
Councilman Ridgdill and by vote CAR.11.IED. The roll call vote was unanimous.
Motion duly made by Councilman Siller the request of Mrs. Thelma Hennig
in the amount of ~17 be granted, seconded by Councilman Cairnie and by vote
CARRIED. The roll call vote .'las unanimous.
Mayor Armstrong said concerning the letter from Mr. Bosse he had asked Mr. Bosse
if he wanted it read. His complaint concerned the handling of a juvenile case
by Chief Jack H~n.
Attorney ~lark asked if the interested parties were here.
Councilman Cairnie said they were.
~~yor Armstrong said this is no place to debate if it is right or wrong.
~tr. Bosse said the Chief told him to take it up with the Mayor and City Council
and that was what he intended to do.
Mayor Armstrong said that we must have discipline in departments. We can not
tolerate anything unbecoming.
Councilman Siller said prior to coming here he knew nothing of this matter.
He said so far the Mayor and Council have just heard one side of this story.
He said we haven't heard from the Chief of Police. He suggested the Council
meet in the Mayor's Office to disuuss this situation.
Councilman Tingle agreed with Councilman Siller.
Mayor Armstrong said he was in his office all day and no one discussed
it vii th him.
The entire council agreed they had not seen the letter before.
}tr. Bosse said the Chief of Police is present and he said he felt the
Chief was derelict in his duty. He said he did not afford him the treatment
he should receive from Chief of Police. He said he would agree to discussing
it in the ~myor's office. He also added he posted a complaint with Police
Commissioner, City Council and ~~yor.
Motion duly made by Councilman Cairnie this matter be investigated in the
City Hall after this meeting, seconded by Councilman Siller and there were
no objections.

Councilman Tingle spoke concerning a City Manager:
I believe for the good of the City we need a City Manager. This is no reflection
on the Mayor or Council. I have believed for several years we have needed a
City Manager. Everything is left for the ~4yor to do and the Mayor does not
get paid. There is too much to do being Mayor, Judge and City Manager. The
Council changes every}1two years and said he finds it very hard to know what
is going on. A City anager can tell you what is going on. He said if $7,200
is set up for a ~~nager that averages about $2.25 per person each year. If
City Manager is good he can save his own salary. This is no reIlection on the
11ayor or Council. Should have been done before this. If we wait another year
the next council again will be undeciced. He emphasized the Council gets along
very well. He said he has lived here 15 years and feels he knows the City very
well.

Motion duly made by Councilman Tingle the City Clerk be authorized to
advertise by paper or journal for a City }~nager in the next budget.
Councilman Siller: I feel we do need a City Hanager. I wish the Mayor
could be the City }~ger.
l~yor Armstrong: I am not saying I am opposed. I don't believe it is
feasible to go to a City Manager. A City 1-1anager would have under his
jurisdiction Supt. Water Department, Street Foreman, Police Chief, Fire
Chief and City Clerk. The }~yor, who is elected to office, has a duty
to the people regarding these departments. He said he would vote for a
full time r1anager elected by the people. We have a primary so He would
have a chance to get a qualified man.
Hr. Harry Lindberg questioned as to whether we would need an attorney if we
had a City }~ager.
Mayor Armstrong said we would.
Councilman Tingle read article in the Orlando Paper,dated September 30, 1964.
He also read Section #26 of the City Charter which states the City Council
has the power to appoint a City }!anager.
Mr. Kenneth Workinger said he saw no reason for a City ~nager.
Councilman Siller: Mayor Armstrong has shovm us many times how, in material
alone", he saved the City a lot of money.
Mayor Armstrong said it is not sensible for a City }!anager to save his own
salary and then pay him a salary.
Councilman Tingle: When the Mayor ''/as on the Council in 1961, $4,800 was
appropriated for a City Supt.
fIayor Armstrong: That would be a Horking superintendent. He doesn't sit
in city hall with a ~mite collar. With more help from the Council the work
load can be lighter. The Mayor is elected and he kno:ws the needs of the City.
Councilw~n Siller: We have had mayors ~mo did not seem to be qualified
to do job the }~yor is supposed to do. He said people are sympathetic
Hhen voting for }layor and don't think of his qualifications all the time.
A City Manager should be impartial.
11r. DO~41d }~son said we should show a lot of confidence in the 11a.yor.
He is doing a good job. \ve should back him up. "\'.!hen he doesn't do a
good job then ''/e should think cf a Ci ty ~nager. Why don' t ~le pay the Hayor?
Councilman Siller said this would take a Charter Change. You can not
raise your own salary.
}~yor Armstrong said maybe we need a }!ayor-City l1anager.
Councilman Ridgdill said he didn't knO"l .mat the people thought of a City
Hanager type government. I can find many things that might; not be too good.
We, as a group, are trying to do a good job. We should make a thorough survey
of the situation.
Mr. Cliff }fusher suggested the people vote on the issue of a City Manager.

A question was asked about putting this on the November 3rd ballot.
Attorney Clark said they couldn't do that since they have to do it
30 days prior to election.
The proposed budget for the year 1964-1965 was read.
Motion duly made by Councilwan Siller the City Clerk be authorized to post
a copy of the proposed budget in a public place, seconded by Councilman Ridgdill
and by vote CARRIED. The roll call vote was unanimous.
Mr. Workinger asked about the black-top in Florida Shores.
Mayor Armstrong said there have been two hurricanes and the county men
were called to work in other places.
Mr. vlorkinger asked that one street in Florida Shores be graded so everyone
can use that street. }~yor Armstrong said he would see that this was done.
}~. G. C. Alexander presented a petition to the V~or and City Council asking
the Council to make all necessary arrangements for better power at the
earliest possible date (Florida Power. & Light). The petition further
stated that the signers are .filling to back the Council in this action
in any way they can. There were 638 signatures on the petition.
Mayor Armstrong said this is not an outright fight with New Smyrna Beach
but a fight for better service at competitive prices. He said he felt
New Smyrna Beach would do there own residents a justice by letting us out
of the contract.
Charles Golden, Commissioner in New Smyrna Beach, said he was: 100% behind
the request by the City of Edgewater and hoped the rest of the Commission
would feel the same.
Mr. Cliff l~sher complimented Mr. Golden for the article that he wrote
for the Orlando Sentinel.
}~s. Edith Peck asked if there was anyting the people of Edgewater could do
to help the Council.
Hayor Armstrong said there wasn't. He said we have to let them make up their
minds first. Their decision will determine what we will do.
}~. Golden said that next Monday the New Smyrna Beach City Commission will meet
and some decision will be made.
HISCELLANEOUS
l~. Strang, from Briley, Wild & Associates, said that some time this month
100,000 feet of pipe will be put in the ground. 80% is now in the ground.
Motion duly made by Councilman Cairnie this meeting be adjourned and the Council
meet in the Mayor's office immediately after this meeting to discuss the letter
from Mr. Bosse, seconded by Councilman Ridgdill and there were no objections.
