REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF EDGEWATER, FLORIDA
HELD JULY 20TH, 1964
The Regular Meeting of the City Council of the City of Edgewater,
Florida held July 20th, 1964 was called to order by William H. Cairnie,
Acting 14ayor, at 7:30 P.M.

The Minutes of the Regular Meeting of the City Council held July 6th, 1964
were presented to each Councilman for his approval. Motion duly made
by Councilman Siller these minutes stand approved as corrected prior to
this meeting, seconded by Councilman Tingle and by vote CARRIED. The
Roll call vote was unanimous.
The Minutes of the Special Meeting of the City Council held July lOth,
1964 were presented to eac~ Councilman for his approval. Motion duiy
made by Councilman Siller these minutes stand approved as submitted,
seconded by Councilman Tingle and by vote CARRIED. The Roll call
vote was unanimous.

Motion duly made by Councilman Siller these bills be paid and be made a part
of the minutes, seconded by Councilman Tingle and by vote CARRIED. The roll
call vote was unanimous.
OFFICERS REPORTS
Police Report for the month of June, 1964, was read.
Budget Report for the month of June, 1964, was read.
Clerk's Cash Statement for the month of June, 1964, was read.
Certification of Posting dated July 7th, 1964, was read.
Certification of Posting dated July 13th, 1964, was read.
Acting Mayor Cairnie thanked the City Clerk and her staff for the fine
reports.
COMMUNICATIONS
A letter was read from Hazel R. Coyle, dated July 15, 1964, requesting the
rezoning from residential to commercial, lots 1, 2, 3, 4, 5 and ~ of 6 -
Block 3 in the plat book #8 - Page 26 of the Volusia County Records.
Motion duly made by Councilman Siller this request on rezoning by Mrs. Coyle
be turned over to the Zoning Board to see what they think of this situation
and report back to us, seconded by Counciilman Tingle and by vote CARRIED.
The roll call vote was unanimous.
ORDINANCES
ORDINANCE NUMBER 411 DESIGNATING AND APPOINTDm A PATROLMAN FOR THE CITY
OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, AND SETTING FORTH COMPENSATION
FOR SUCH OFFICE.
The above ordinance was read in full by Attorney Clark and motion duly made
by Councilman Siller this ordinance be adopted, seconded by Councilman Tingle
and passed by vote of the City Council of the City of Edgewater, Florida at
the Regular Meeting of the said Council held July 20th, 1964. The Roll call
vote was unanimous.
Upon motion duly made by Councilman Siller, seconded by Councilman Tingle,
the requirement of reading Ordinance upon second reading was waived and the
Ordinance was ordered put into effect immediately at the Regular Meeting of
the said Council held on the 20th day of J~y, A.D. 1964 and approved as
provided by law. The vote of said Council was unanimous.
ORDINANCE NUMBER 412 TERMINATING SERVICES OF FIRE DEPARTMENT TEIEPHONE OPERATOR
FOR THE CITY OF EDGEWA TER, VOL USIA COUNTY, FLORIDA.
The above ordinance was read in full by Attorney Clark and motion duly made
by Councilman Tingle this ordinance be adopted, seconded by Councilman Siller
and passed by vote of the City Council of the City of Edgewat~ Florida at
the Regular Meeting of the said Council held July 20th, 1964. The Roll call
vote was unanimous.
Upon motion duly made by Councilman Tingle, seconded by Councilman Siller,

RESOLUTIONS

OLD BUSINESS

Councilman Tingle said that at the previous meeting he had made a motion
to table the letter from Richard Conner, Attol~ey, who represented Klaus
Gruter and Lucille M. Bair asking that City Ordinance Number 328 be
amended in reference to sale of alcoholic beverages on Sunday.
Since then Councilman Tingle said he has received many calls from people
who were against the change of hours. No one called him that was in favor
of the change.
Hotion duly made by Councilman Tingle the Liquor Hours remain the same,
seconded by Councilman Siller.
Mr. Conner stated that at the last meeting the whole council was present
with the exception of the City Attorney. Now the City Attorney is present
and not the entire council. He said that due to the number present he thought
the council would again want to table this matter. He said he had no objection
to this. He presented to the Council a petition idth about 100 signatures on
it who are all supposed to live in the City of Edgewater, but he can not guarantee
that all of them do as he had no time in which to check the names.
Councilman Tingle said this petition may have 100 names but tomorrow someone
can come up with a petition with 700 names who are against the change of hours.
He said this matter has come up before.
Councilman Siller said that by just glancing quickly over the petition he
can find two persons who do not live in this city.
Mr. Conner said he did not see the petition until just before the meeting
so he cannot definitely say that all of the people on the petition live
in Edgewater.
Mr. Gruter said that he has been trying to get this change in hours for
two years. He said he pays about $2000 in liquor licenses and feels the
hours should be changed. He said that of his customer only about 800 to
_+OQO come from Edgewater. He said the rest of his customers come from
Titusville, Oak Hill and other places. He said he didn't think it was
fair for people who don't drink for some reason, to vote against the change
which hurts the people who do drink. He said if he could have his bar open
on Sunday and closed on Monday it would be a big help. He said a lot of
the men "lork on the other days of the "leek and Sunday is the only day they
can take their wives out for a drink.
Mr. Cairnie asked if there was any other comment from the audience and there
was none.
Councilman Tingle withdrew his prevuous motion to have hours remain the same
and then pass on it at the next council meeting. Councilman Siller withdrew
his second to the motion until the full council is in session. There was
no roll call.
Mr. Conner took his petition back so he could check the names on it and said
he would then return it to the Council.

NEW BUSINESS
Mr. Walter Strang, Supervisor of Sanitary Sewerage Project, gave
a progress report. He said that as of this date the following amount
of pipe had been layed:

He said they are averaging 700 to 1000 feet of pipe per day. The
Treatment Plant is started. The Pumping Stations will not start for some
time. He again emphasized that there are many easements ~s'till out
and they are needed so as not to hold up the project.
Councilrnn Cairnie said that everyone seems to be happy with what
you are doing and you seem to be maKing fast progress.
Councilman Cairnie said that now the Fire and Police Departments are
combined and in operation 24 hours a day. He asked Jack Hayman,
Chief of Police, to explain the set-up.
Jack Hayman: We are now independent of New Smyrna Beach. We have
employees to maintain our police and city radios. We have auxiliary
~ower facilities if we need it. We can answer calls 24 hours a day.
he Police Department is still in City Hall and if anyone should need
a police officer for any reason there will be a policeman available
at all times.

There being no further business motion duly made by Councilman Tingle
we now adjourn, seconded ~y Councilman Siller and there were no objections.
