Jones Deputy City Clerk Marie Robinson Police Chief Herman Witmeyer Present Absent Present Present Present Present Present Present Present Motion duly made by Councilman Cairnie we dispense with the regular agenda and turn the meeting over to the Election Board to tabulate election returns, seconded by Councilman Ridgdill and by vote CARRIED. The roll call vote of those present was unanimous. The Election Returns were tabulated by the Election Board. RESOWTIOO NUMBER 81 DECLARING THE RESULTS OF THE SPECIAL ELECTION HELD IN THE CI'IY OF EDGEVoIATER, VOWSIA COUN'IY, FLORIDA, ON THE 7TH DAY OF SEPTEMBER, A.D. 1965. The above Resolution was read in full by Attorney Mathas and motion duly made by Councilman Cairnie this resolution be adopted, seconded by Councilman Tingle and passed by vote of' the City Council of the City of Edgewater, Florida at the Recessed Meeting of the said Council held this 8th day of September, K.D. 1965. The roll call vote of those present was unanimous. Mayor Armstrong expressed his appreciation to the Election Board with regard to the excellent way they conducted the election. The Election Board said the Election Books of the City should be gone over thoroughly. He said there are a lot of mistakes as to addresses, etc. Mayor Armstrong said he would call this to the attention of Mrs. Odham who is Supervisor of Elgction'im'Volusia County, Florida. The Minutes of the Regular Meeting of the City Council of the City of Edgewater, Florida held August 16th, 1965 were presented to each Councilman for his approval. The roll call vote of those present was unanimous. l' Mayor Armstrong said the Library is very much in the red on Book Purchases. he only part of the Library Budget that is in tact is the wages. He said it now'looks like by the end of the Fiscal Year their budget will be in the red. He further stated that the City Council has no idea What the Library purchases until they receive the bill. The City Clerk does not issue purchase orders for the Library. The City Council agreed to meet with the Library Board or the purchasing agent for the Board and try and get thisrmatter straightened out. Councilman Ridgdill said he saw no reason Why tpe Library Board had to go in the red on book purchases. He said they are abusing their purchasing privileges. It is not a great emergenqy that they buy these books. He also said he didn't think it was right that the Library Board By-La..1S should be in conflict with the City Charter. Councilman Cairnie suggested the Board be notified that their purchasing for the balance of the year should be eliminated. The Police Report for the month of August, 1965, was read. t?e Clerk's Cash Statement for the month of August, 1965, was read. he Budget Report for the month of August, 1965, was read. Certification of Posting dated August 16th, 1965, was read. Mayor Armstrong thanked the City Clerk and her staff and the Building Official for the above reports. COMMUNICATIONS A letter was read from Paul Walls, Secretary, Florida Shores Property O~mers Association, dated August 31st, 1965, requesting the City Council consider including in the 1965/66 Budget a sufficient sum (estimated at $2,500 to $3,000) to make a study of the feasibility of blaCk topping a major portion or the streets in Florida Shores, and that the result of the study be the subject of a referendum of the residents of the area. A letter was read from LaVerne Johnson, Police Officer of the City of Edgewater, dated August 29th, 1965 withdrawing his resignation as Police Officer effective September Bth, 1965. A letter was read from Mr. Horace H. Lawson, 307 Flagler Avenue, Edgewater, dated September 7th, 1965, requesting permission to put ari:alurninum cover over his car. Mayor Armstrong said in reply to the letter from the Florida Shores Property Owners Association that in order to have a Bond Issue it must be approved by the State Legislature and the Legislature doesn't meet for two years. ~e Mayor also said according to a Memo he received some time ago from the same association, this feasibility study was going to be free. }fayor said he could not truthfully favor a bond issue as this is an expenditure in just one subdivision. Councilman Cairnie agreed with the Mayor. He said he didn't think it would be right to use tax payers money in just one section of the City. Mayor Armstrong said if it was something where life would be endangered then it could come out of Emergency and Contingency. Councilman Tingle suggested the County make a study of the area, and maybe make a feasibility report. Mayor Armstrong said he talked to Harris Saxon. The streets they paved this year were thought to be the best link up of the Subdivision. Some of the streets even had to be elevated. There must be drainage to have paving. He said a good per cent of the people have paid for their paving but he said if a private contractor did the paving it would be considerably more per foot. He said in the last 2 years we have done more in that area then in the prior ten years. He said if the people are patient we will get this thing licked. Mayor Armstrong said he would write a letter to Mr. Walls, Secreatary of the Association. The Mayor also added that a feasibility study now would be of no use in 196'7. In reference to the letter from LaVerne Johnson withdrawing his resignation, Mayor Armstrong said he was really planning on going north but the doctor said it would be advisable to /stay here as he has a son who has asthma and has not been very well. .He also added the Chief of Police said Mr. Johnson's work has been satisfactory. The roll call vote of those present was unanimous. In reference to the letter from Mr. Lawson, Mayor Armstrong said there is not much the Council can do about this as giving Mr. Lawson permission to put up the aluminum cover over his car would be against the Zoning Laws. The council suggested Mr. Lawson contact the Zoning and Planning Board and see if he can get a variance. Mr. LaBonde, Building Official, said that if Mr. Lawson put up the 9luminum cover at the present time it would definitely be against the Zoning Laws of the City. Mr. Lawson said he would check into this. He thanked the council for their consideration and said he certainly did not want the City Councilmen to violate the City Laws. Mr. Lawson also told the council there are a lot of high weeds near the Sewer Plant and he is afraid there could be a fire in that area if something isn't done. ORDTIJANCES ORDTIJANCE NUMBER 448 RE-DEFINING THE FOUR VOTING DISTRICTS OF THE CITY OF EDGEWA TER, FLORIDA. Councilman Ridgdill wanted to be sure Councilman Sil:.Ler was in favor of this ordinance before it was voted upon. Mayor Armstrong and Councilman Tingle said they were sure he was in favor of this as he startEid working on this re-zoning in the last administration. The above Ordinance was read in full by Attorney Mathas and motion duly made by Councilman Cairnie this ordinance be adopted, seconded by Councilman Tingle and passed by vote of the City Council of the City of Edgewater, Florida at the Recessed Meeting of said Council held September 8th, 1965. The roll call vote of those present was unanimous. Upon motion duly made by Councilman Cairnie, seconded by Councilman Tingle the requirement of reading Ordinance upon second reading was waived and the ordinance was ordered put into effect immediately at the Recessed Meeting of said Council held on the 8th day of September, A.D. 1965, and approved as provided~by law. The roll call vote of those present was unanimous. PROCLAMATIONS Mayor Armstrong signed a Proclamation proclaiming September 13th, 1965 as World Law Day. Page 4 of 5 pages tl () . , o o Mayor Armstrong said Petitions for the November 2nd election and for the October 19th Primary,in the event more then two qualify for City Councilmen or Mayor, are now available. These petitions must be returned 40 days prior to the November 2nd election. The Mayor said he had an application for a business license from a Mr. McCallister requesting to operate a produce truck in the City, at 612 N. Ridgewood Avenue. The Building Official said according to our City Ordinances a fruit stand must be operated from a stand arid not from a truck. There has to be an approved structure built for this purpose. Councilman Ridgdill said he felt this was a matter fon the Building Official to determine. Mr. LaBonde recommended that no license be issued. Motion duly made by Councilman Cairnie we recess this meeting until 4:30 P.M. this date, seconded by Councilman Ridgdill and there were no objections. Minutes taken by Marie Robinson.
