SPECIAL MEETING OF THE CITY COONCIL
OF THE CITY OF EDGEWATER, FLORIDA
HELD JULY 28TH, 1965
The Special Meeting of the City Council of the City of Edgewater, Florida
was called to order bY Mayor Dana T. Armstrong at 7:30 P.M. on July 28th, 1965
in the Mayor's Office.

The Special Meeting was called by Councilman Tingle, Councilman Siller and
Councilman Cairnie for the purpose of making a decision on the legality of
the Special Election.
Mayor Armstrong read a portion of a letter from Mr. E. P. Fuller and Mr. Roscoe
Henderson, dated July 26th, 1965, asking that the whole matter of the special
election be given attention towards the end that, if time permits, notice:-'of
a proposed election be re-published sa as to meet the Charter requirements
of thirty days notice prior to election.
Mayor Armstrong said it has not been the intent of any member of this Council
to call an election contrary to the Charter. We based information on calling
the election on the bills themselves. He said he has now found a way to call the
election at a later date. He asked the Attorney ~o read the telegram received
this evening from Tom Adams, Secretary of State.
It read as follows:

In response to your telephone call of July 28, the following is offered: House
Bills 529, 530, 531, 532 and 533 were filed in the office of Secretary of State
May 3, 1965. Each contains the same provision relative to its effective date:
uThis act shall take effective upon its ratification by the affirmative vote of
a majority of the qualified electors of the City of Edgewater voting thereon at an
election to be called and held by the City Commissioners of said ci ty within
ninety (90) days after this act becomes a law, said election to be called and held
as near as may be in compliance with the ordinances of said City of Edgewater,
and statutes governing elections in said City.u - Section 18, Article III of
the Florida Constitution provides: UNo law shall take effect until sixty days
from the final adjournment of the session of the legislature at which it may have
been enacted, unless otherwise specially provided in such law.u - It appears
that since the effective date is not otherwise specially provided for the
ninety days wi thin which ancelection may be called to ratify the provisions
of the acts in question begins on August 4, 1965

The Mayor said we can now .comply with the Charter, State Constitution and
the Laws of the State under the direction of the Secretary of State.
Motion duly made by Co~cilman Siller we rescind Proclamation passed on
July 15th, 1965, authorizing an election to be held July 30th, 1965, seconded
by Councilman Tingle and by vote CARRIED. The roll call vote of those present
was una.niJoous.
Motion duly made by CounCilman Cairnie we now adjourn, seconded p..'T Councilman
Tingle and there were no objections.
