Jones Deputy City Clerk Marie Robinson Police Chief Herman Witmeyer Fire Chief Richard Hanson Present Present Present Present Present Present Present Present Present Present The Minutes of the Regular Meeting of the City Council held February 1st, 1965, the Minutes of the Recessed Meeting of the City Council held February 3rd, 1965 and the Minutes of the Recessed Meeting of the City Council held February 5th, 1965 were presented to each Councilman for his approval. Mayor Arnmtrong explained that at the meeting of February 1st, 1965 there wasn't a quorum present as the Council-met with members of the Legislature in reference to charter changes. Motion duly made by Councilman Siller these minutes stand approved as submitted, seconded by Councilman Cairnie and by vote CARRIED. The roll call vote was unanimous. The roll call vote was unanimous. OFFICERS REPORTS The Clerk's Cash Statement for the month of January, 1965, was read. The Budget Report for the month of January, 1965, was read. The Certification of Posting dated February 4th, 1965, was read. The Police Report for the month of January, 1965, was read. The Library Report for the month of January, 1965, was read. Mayor Armstrong thanked the City Clerk and her staff and all other Department Heads for the fine reports. COMMUNICATIONS A letter was read from Robert Hayes, Wesley Linkovich n and Thoms Day dated February 9th, 1965. The three boys have a small band known as "The Misfits". They would like to re-open the Youth Center and charge an admission of twenty-five cents per person. A letter was read from the East Volusia Mosquito Control District dated February 10th, 1965, requesting authority from the city council to make low level flights under 500 feet with its single engine airplane and helicopter over Edgewater. A letter was read from Donald T. Mason, 2ll Willow Oak Drive, Edgewater, Fla. dated February 12th, 1965 in reference to the roadway on Willow Oak Drive which he claims is in poor condition and also in reference to drainage of a lake on his property. He also complained that the city removed a culvert that crossed Willow Oak Drive and emptied into his lake and put same across the North Side of 21st Street and Willow Oak Drive. Mayor Armstrong said that the letter from the three boys who want to open the youth center should be referred to the Board of Governors since this would be open wi. th a charge of admission and also due to the fact that the boys are under age. Motion duly made by Councilman Siller this letter be referred to the Board of Governors for their consideration, seconded by Councilman Cairnie and by vote CARRIED. The roll call vote was unanimous. Motion duly made by Councilman Cairnie the request of the East Volusia Mosquito Control District to make low level flights under 500 feet over Edgewater be granted, seconded by Councilman Siller. Councilman Siller questioned as to who would be responsible if something happened to the plane and damage was done to either life or property. After considerable discussion the council agreed to let the East Volusia Mosquito Control make the flights over Edgewater. The roll call vote on the motion concerning the low level flights over Edgewater was unanimous. Page 2 of 5 page s " v . ~I v u .Concerning the letter from Mr. Mason, Mayor Armstrong said he has done ; everything he can to humor the man; a lot of people in Edgewater have rough roads. The Mayor suggested members of the council talk with Mr. Mason and see if they can get anywhere with him; the city can not let up on their routine work; the city is getting more help from the Florida Shores Developers and he said he felt we are making progress. Councilman Tingle said he talked with Mr. Mason and advised him to write to the Council. Councilman Ridgdill said he will talk with Mr. Mason. Mayor Armstrong announced that Aladar B.t.t ter, Custodian for the C()TI1JI1Jlni ty Center, had re signed due to poor health and the council DDlst find a suitable replacement. ORDINANCES ORDINANCE NUMBER 433 TERMINATING SERVICES OF CUSTODIAN FOR THE COMMUNITY CENl'ER OF '!HE CITY OF EDGEWATER, VOWSIA COUNTY, FLORIDA, AND SETTING FORm COMPENSATION IXJE FOR SUCH OFFICE TO TERMINATION DATE. The above ordinance was read in full by -City Attorney Mathas and motion duly made by Councilman Siller this ordinance be adopted, seconded by Couhcilman Tingle and passed by vote of the City Council of the City of Edgewater, Florida at the regular meeting of said council held February 15th, 1965. The roll call vote was unanimous. Upon motion duly made by Counci. 1 man Siller, seconded by Councilman Cairnie the requirement of reading Ordinance upon second reading was waived and the ordinance was ordered put into effect immediately at the Regular Meeting of the said Council held on the 15th day of February, A.D. 1965 and approved as provided by law. The roll call vote was unanimous. ORDINANCE NUMBER 434 SE'I'l'ING FORTH ~mEMENTS FOR SEWER CONNECTIONS FCR THE PROPERTY OWNERS IN THE CITY OF EDGEWATER, VOWSIA COUNTY, FLORIDA. The above ordinance was read in full by City Attorney Mathas and motion--dUly made by Councilman Siller this ordinance be adopted, seconded by Councilman Cairnie and passed by vote of the City Council of the City of Edgewater, Florida at the regular meeting of said council held February 15th, 1965. The roll call vote was unanimous. Mr. Clifford Bradley asked what will happen if there are not enough plumbers to put in the sewer connections within the three month period. Mayor Armstrong said the council is following their enabling ordinance. If they should come up against this problem he would have to check with the Federal Housing and Home Finance Agency. Upon motion duly made by Councilman Tingle, seconded by Councilman Cairnie the requirement of reading Ordinance upon second reading was waived and the ordinance was ordered put into effect immediately at the Regular Meeting of the said Council held on the 15th day of February, A.D. 1965 and approved as provided by law. The above resolution was read in full by Attorney Mathas and motion duly made by Councilman Cairnie this resolution be adopted, seconded by Councilman Tingle and passed by vote of the City Council of the City of Edgewater, Florida at the Regular loieeting of the said Council held this 15th day of February, A.D. 1965. The roll call vote was unanimous. RESOIlJTION NUMBER 72 ACCEPTING CERTAIN PROPERTY DEEDED TO THE CITY OF EDGEWATER, FLORIDA. The above resolution was read in full by Attorney Mathas and motion duly made by Councilman Ridgdill this resolution be adopted, seconded by Council1na.n Cairme and passed by vote of the City Council of the City of Edgewater, Florida at the Regular Meeting of the said council held this 15th da,y of February, A.D. 1965. 1he roll call vote was unanimous. Before voting on this resolution there was considerable discussion. Mayor Armstrong said he felt the Florida Shores Developers were acting in good faith and he believed all the buffer strips were included in this deed, but he said to be positively sure it would take some study. Councilman Ridgdill said that since the sewer easement is included in this deed he felt the city should pass on it. RESOIlJTION NUMBER 73 DESIGNATING AND APPOINTING A POLICE OFFICER FOR THE CITY OF EDGGWA TER, VOWSIA COONTY, FLORIDA. Mayor Armstrong explained that Mr. Fugate works by the hour and this resolution is just to restore his power as a police officer. Motion duly made by Councilman Siller the City Pa.Y the Cotmmm1ty Center the sum of $144.00 for the cost of putting a hood over the stove, seconded by Councilman Tingle and by vote CARRIED. The roll call vote' was unanimous. Mayor Armstrong explained that this was an additional expense to the Board of Governors that they did not anticipate so the City is paying for it. Mr. Tom Groover, Briley, Wild & Associates, read the sewer report dated February 15th, 1965. This report has been made a part of the minutes. Councilman Ridgdill asked if the sewerage project has to be put into operation only When the whole project is completed or can they start before it is completed. . . Mr. Groover said it can be put into operation before it is fully completed but that is up to the City Council. Mayor Armstrong said the city has not made a check of the entire project as of this date. He said he thouglt some corrections had been made since the last time he checked it. Motion duly made by Councilman Cairnie the City Clerk be authorized to advertise for a trailer mounted standby electric generator for the sewer project and the bids may be turned into the City Hall until 7:30 P.M. on March 12th, 1965, seconded by Councilman Ridgdill and by vote CARRIED. The roll call vote was unanimous. Mr. David L. '-liggins, Sr. asked about the surplus money to be used for water extension. Mayor Armstrong said he hasn't found out about this but will contact the fiscal agat;' Mr. Phillip Bebbington asked about the paving in Florida Shores. Mayor Armstrong said he talked to Mr. Saxon and was advised the weather was not favorable to do the paving. There being tio further business, motion duly made by Councilman Cairnie this meeting be adjourned, seconded by Councilman Siller and there were no objections. Minutes taken by Marie Robinson.
