REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA HELD OCTOBER 3RD, 1966
The Regular Meeting of the City Council of the City of
Edgewater, Florida was called to order by Mayor Earl L. Tingle
at 7:30 P.M. on October 3rd, 1966.

The Minutes of the Regular Meeting of the City Council
held September 19th, 1966 were presented to each Councilman
for his approval. Motion duly made by Councilman Walls
these minutes stand approved as submitted, seconded by
Councilman Bebbington and by vote CARRIED. The roll call
vote was unanimous.

ORDINANCES
ORDINANCE NUMBER 517 EMPLOYING JOHN N. RICH AS PATROLMAN
FOR THE CITY OF EDGEWATER, FLORIDA.
The above Ordinance was read in full by City Attorney Hall
and motion duly made by Councilman Cairnie this ordinance
be adopted, seconded by Councilman Bebbington and passed by
vote of the City Council of the City of Edgewater, Florida
at the regular meeting of the said Council held October 3rd, 1966.
The roll call vote was unanimous.
Upon motion duly made by Councilman Cairnie, seconded by Councilman
Walls the requirement of reading Ordinance upon second reading
was waived and the Ordinance was ordered put into effect
immediately at the regular meeting of the said Council held
Bctober 3rd, 1966. The roll call vote was unanimous.
ORDINANCE NUMBER 518 SETTING A BUDGET AND APPROPRIATING
REVENUES TO BE COllECTED FOR THE CITY OF EDGEWATER, VOLUSIA
COUNTY, FLORIDA FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1966
AND ENDING OCTOBER 31, 1967 TO THE VARIOUS ITEMS OF THE
CITY BUDGET.
The above Ordinance was read in full by City Attorney Hall
and motion duly made byyCounci1man Walls this ordinance
be adopted, seconded by Councilman Bebbington and passed by
vote of the City Council of the City of Edgewater, Florida
at the regular meeting of the said Council held October 3rd, 1966.
The roll call vote was unanimous.
The second reading of this ordinance will be at the next
Regular Meeting of the City Council to be held October 17th, 1966.
Mayor Tingle said the City has not set the millage until we
find out what the re-assessment will be from the County.
Mayor Tingle also said the Bud~et is up 10% over last year.
ORDINANCE NUMBER 519 APPROPRIATING REVENUE TO BE COLLECTED FOR
THE WATERWORKS AND SEWER SYSTEM OF THE CITY OF EDGEWATER, VOlUSIA
COUNTY, FLORIDA FOR THE FISCAL YEAR BEGINNING NOVEMBER 1, 1966
AND ENDING OCTOBER 31, 1967, TO THE VARIOUS ITEMS OF THE
CITY BUDGET.

The above Ordinance was read in full by City Attorney Hall
and motion duly made by Councilman Cairnie this ordinance

RESOLUTION
RESOLUTION NUMBER 150 REJECTING BID ON FIRE TRUCK EQWIPMENT
The above Resolution was read in full by City Attorney Hall
and motion duly made by Councilman Walls this resolution be
adopted, seconded by Councilman Bebbington and passed by
vote of the City Council of the City of Edgewater, Florida
at the Regular Meeting of the City Council held October 3rd, 1966.
The roll call vote was unanimous.
Councilman Walls said the City will have to change the specifications
before we re-advertise.
OLD BUSINESS
David L. Wiggins, Sr., Chairman, Zoning and Planning Board
said on April 16th, 1966 a Public Hearing was held regarding
a variance request from a Florida Shores resident. The Zoning
and Planning Board recommended this variance be denied and the
City Council denied the variance. He said he has since been
contacted many times by the party who asked for the variance.
The attorney of this party stated the Council and the Zoning
Board could have been in error. Mr. Wiggins asked the City
Attorney's legal opinion as to whether Florida Shores restrictions
on their deeds are in effect until 1986.
Attorney Hall said these restrictions are still in effect.
Any Zoning Ordinance of the City would not change what is
already in effect at the time the property was bought or what
is stated on the deed.
Richard Hanson, Fire Chief, said the Council tonight rejected
a bid on fire truck equipment. He asked why he was not
consulted about this and why he was not consulted with tegards
to the City Budget for the Fire Department.
Councilman Walls said the City has the right to reject a one
bid item. He said he is the Fire Commissioner in the City of
Edgewater and said he did tell Mr. Hanson the bid was going
to be rejected.
Mayor Tingle said Mr. Hanson can meet with the City Council tonight
if he would like and go over this matter.
Mr. Frank Zuhr, 1901 Evergreen Drive, asked where in the
City Charter does the Council have authority to appoint a
Fire Commissioner.
Mayor Tingle said a Resolution was passed appointing different
Councilmen to different departments. There is no specific title.
Mr.. Zuhr said he wanted to know the Resolution Number.

Attorney Hall said the councilmen are 1iason men between
the entire council and various department heads.
Mr. Hanson wanted to know if a Fire Commissioner could
tell him hbw to put out fires and how to run fire drills, etc.
Former Mayor Dana T. Armstrong said if you look in the Code
of General Law you can find the duties of the city fathers.
Mayor Tingle said at one time the City was run under the
supervision of one man. He said this council has done
a wonderful job by dividing up the work among the councilmen.
Councilman Cairnie said the City always was fun under this program
and when Mayor Tingle was on the Council it was run the same way.
We all had different jobs to which we were in charge.
Mayor Tingle said he refused to go along with tpis when he
was on the Council because he had no authority with the job.
Councilman Bebbington said earlier in the year the Council passed
a resolution determining the duties of the Council. I was put
in charge of the Police and Water Department. The Police Department
is doing a wonderful job this year. Last year they collected
$1,805 in fines and forfeitures and this year they have collected
$4,319.50. The Mayor has asked that he be given the supervision
of the Police Department and the City Council all agree he should
be given thss job.
Motion duly made by Councilman Bebbington the Police Department
be now placed under the supervision of the Mayor, seconded by
Councilman Walls and by vote CARRIED. The roll call vote was
unanimous.
Councilman Bebbington: In 196~ Water and Sewer Lines have been
extended. The portion to the school has been completed. School
opened today. A section in Edgewater Acres has been completed
with the exception of the final tests. Florida Sbores will be
complete with the exception of pressure sterilization and Board
of Health Tests. Tomorrow the people south of the Blvd. in
Florida Shores will be without~ter from 9:00 A.M. - 3:00 P.M.
The 1965 Water Program laid 8" line on 22nd Street and 611 line
on 27th Street in front of the culverts. During the last storm
we had drainage problems at the culverts. Tomorrow they
are going to be disconnected and moved above the culverts. We
expect tests to be completed by the 15th of this month, and
propet~y owners abutting these lines should pay the connection
fees. They will be connected up on a first come first serve
basis.
NEW BUSINESS
Mayor Tingle: The City Council is in the process of hiring
a City Manager. The City is working under a bu~get of $312,000
and we definitely are in need of someone to supervise the
departments of the City. The Council has ~greed to hire such
a man for this. Mr. Lewis Hilton, who lives m Edgewater, has
been considered for the job. .
Mrs. Ne1f Jones, Kumquat Drive, wanted to know the qualifications
of this man.
Mayor Tingle said he is a Civil Engineer.

Mrs. Jones asked if he had ever been a City Manager before.
She said we need someone trained.
Mayor ~ingle said the Council feels this man is qualified.
In a years time we can show you what he has done for the City.
This man will accept the job for $5~~00 a year.
Mr. Hilton said he would be glad to submit his qualifications
to anyone.
Mr. Robert Maxwell, Orange Tree Drive, said she would like
to~know the duties of the City Manager. We should know what
is expected of the man.
Mayor Tingle said the duties will be given to the City Manager
by the City Council. The duties will be set up in the Ordinance
when the man is hired.
Mr. John Zeilman, 3003 Woodland DRive, asked that he be called
a Business Officer and rot a City Manager.
Councilman Lodico said Mr. Hilton is worth a lot more than
$5,200 per year. He is retired and is glad to help the
City any way he can.
Councilman Cairnie said he could see the hiring of a
Supt. of Public Works for the Water, Sewer and Street Departments.
But said there was no need of an administrator in City Hall.
Mayor Tingle said the Council turned down the suggestion of
Councilman Cairnie.
Councilman Walls said the City Manager will set up communication
lines in the City. He will not just sit in City Hall, but will
coordinate the different departments. This is a tremendous job.
I said before it could be done by the Council but now I know
it can not be done by the Council alone.
Councilman Cairnie said there is a lot of confidential information
in the Police Department and sees no need for a City Manager
in that Depa~ment. He said he didn't think the City Manager
should tell the Fire Chief what to do.
Councilman Lodico said the girls in City Hall receive a lot of
calls and they need assistance with a lot of them. He said he
can't find the things he is looking for in City Hall. We whould
start now with a City Manager.
MISCELLANEOUS
Mr. John Zeilman complained about dogs running loose. There is
someone in Florida Shores raising dogs and they have a number
of German Shepherd dogs running around loose. They are dangerous.
He further stated that trash should be further defined by the City.
He had some weeds taken out of a canal by his home and it was
never picked up and just left there. Also, a test case should
be made on the weed ordinance. There is a house in Florida Shores
that Real Estate Brokers are trying to sell and it is such a
mess with weeds, etc. it is a disgrace.
Councilman Cairnie read from the Code of General Law stating
it is against our City Ordinances to raise dogs.
Mayor Tingle said the City is working on a new ordinance for cutting weeds.
Mr. Robert Maxwell, Orange Tree Drive, invited the Mayor and Council
to Veterans Day Services on November 12th, 1966.

A question was brought up about taking the flag down each day.
It was agreed that the custod~n puts the flag up in the morn~ng
and the Police Department takes it down in the evening.
There being no further business, motion duly made by Councilman
Cairnie we now adjourn, seconded by Councilman Bebbington
and there were no objections.
