SPECIAL MEETING OF THE CITY
COUNCIL OF THE CITY OF EDGEWATER,
FLORIDA HELD ON JULY 3, 1968
A Special Meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie at 10:00
A.M. on July 3, 1968.

Mayor Cairnie, "This Special Meeting was called to adopt a Res-
olution accepting the bid of P.ellows Construction Company for
paving Monroe Circle."
Councilman Ledbetter, "Mr. Mayor, I think it needless to express
my thoughts as to why this subject has come up just two days af-
ter a Regular Council Mee~ing. Nevertheless, it has. I think
11m within my rights to insist that every question, every answer,
and every statement at this meeting be made a matter of public
record."
RESOLUTIONS
RESOLUTION NO. 240 ACCEPTING THE BID OF FELLOWS CONSTRUCTION CO.
OF DAYTONA BEACH, FLORIDA FOR THE PAVING OF MONROE CIRCLE IN EDGE-
WATER, FLORIDA, AS PER SPECIFICATIONS AND FOR THE TOTAL PRICE OF
$2,639.00, REJECTING ALL OTHER BIDS; AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE A CONTRACT DOCUMENT WITH THE SAID FELLOWS
CONSTRUCTION COMPANY, AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The foregoing Resolution was read in full by City Clerk Elsie L.
Ward and upon motion duly made by Councilman Dimm this Resolution
be adopted, seconded by Councilman Dietz and passed by vote of the
City Council of the City of Edgewater, Florida at a Special Meet-
ing of said Council held July 3, 1968.
The Chair called for "question?"
Councilman Ledbetter took the floor, "Number one, I wish to see
the proof of advertising for competitive bids." City Clerk Elsie
L. Ward submitted for Councilman Ledbetterls consideration the list
of contractors who had received Invitations to Bid. Councilman
Ledbetter, "Number two, I wish to hear the City Clerk certify that
the money is in the budget to the account of paving fund, suffic-
ient to cover the bid price." City Clerk Elsie L. Ward proceeded
to read the Certification of Funds. Councilman Ledbetter, "Number
three, I wish to hear the City Clerk certify that the bids were in
her hands on or before the dead line mentioned in the advertise-
ment for bids, if there be such." Mrs. Ward, "That was read the
night the bids were opened." Councilman Dimm, "Yes, and it is a
matter of record." Councilman Ledbetter, "Ok, ok, number four, I
wish to see the Ordinance or Resolution setting up a special fund
for paving; one that is separate from the budget."

Mayor Cairnie, "There is no Ordinance or Resolution; there is
just a special fund."
Councilman Ledbetter, "Gent1emen, Charter violations are a ser-
ious matter; they are not to be looked upon 1ight1y."
Mrs. Ward, liThe auditors said we should put the money in a sep-
arate fund.; we didn't need an ordinance to set up a fund."
Councilman Dimm, liThe money is there, and it is in the record."
Mayor Cairnie, "Mrs. Ward, how did this money come in?" Mrs.
Ward, liThe Council set the price for paving at forty cents per
foot; that is to property owners on both sides of the street;
the City pays one third, the County pays one third and the prop-
erty owners pay the remaining third." Mayor Cairnie, "Where did
most of the money come from?" Mrs. Ward, "I would say Florida
Shores with Edgewater Acres next." Councilman Dimm, "This sep-
arate fund for monies has been the policy of the City for years.1I
Mayor Cairnie, "Councilman Dimm, you asked for this Resolution
to be tabled; now tell us what is the cost per foot?" Council-
man Dimm, "I don't know the cost per foot. I haven't looked in-
to that. I wanted it tabled to geive me time to read the engin-
eers' report on the bids. As for the cost, I checked with Com-
missioner Saxon and Mr. Shippee. Mr. Saxon said the price we
had quoted was a good low price per foot. I don't believe we
could pave it any cheaper. The stuff we got before for about
$9.00, I understand now is $45.00." Councilman Dietz to the
Mayor, "Why don't you want to pave Monroe Circ1e?" Mayor Cairn-
ie, lilt is too much money. II Councilman Dimm, "We agreed on the
paving program; here is the agreement, read it. Doesn't it say
Monroe Circle will be paved by private contractor?" Mayor Cair-
nie, "This doesn't mean a thing; it doesn'.t even have any sig-
natliJres on it." Councilman Dimm, "We11 as of right now, it be--
comes a part of this record." "We promised the people Monroe
Circle would be paved, and as far as I'm concerned the whole
thing is settled. You said once that if we could do it for
under $3,000.00 it would be ok. Now you think it costs too
much." Mayor Cairnie, Well, there is the engineer's fee, the
survey........" Councilman Dimm, "We11 , can you get done any
cheaper?" Mayor Cairnie, "I didn't say we could get it done
cheaper, I just said it is too much money." Councilman Dimm,
"$3,000.00, didn't you say $3,000.00? Why didn't you say back
the n we co u 1 d n 't a f for d it. II Co u n c i 1 man Norm an, II G e 0 r g e, you
are right, sometime back we all agreed to it." Mayor Cairnie,
Yes, if the price was within reason. II Councilman Dimm, IIThis
was an agreement which was agreed to on priority, not signa-
tures."
Mayor Cairnie, "Mrs. Ward, roll call p1ease."
The motion carried with Mayor Cairnie and Councilman Ledbetter
voting nay.
There being no further business, motion was duly made by Council-
man Dietz we now adjourn, seconded by Councilman Norman and there
were no objections.
