FLORIDA HELD ON MAY 6, 1968
The Regular Meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie at 7:30
P.M. on May 6, 1968.

The Minutes of the Regular Meeting of the City Council held on
April 15, 1968, and the Minutes of the Special Meeting held on
April 26, 1968 were presented to each Councilman for his approv-
al. Motion was duly made by Councilman Dietz these Minutes stand
approved as submitted, seconded by Councilman Dimm and by vote
CARRIED. The roll call vote was unanimous.

Motion was duly made by Councilman Dimm that these bills be ~c-
cepted for payment, seconded by Councilman Dietz and by roll
call vote CARRIED. The roll call vote was unanimous.
OFFICERS REPORTS
Certification of POSTING Dated April 16, 1968 was read.
Library Report for April was read.
Building Report for January, February, March & April, 1968 was
read.
COMMUNICATIONS
A letter was read from Dr. J. F. Robertson in which he thanked
the Edgewater Police Department for looking after his home while
he was away. Mayor Cairnie noted that the letter showed that
our Police Department is certainly;doing their job.
A letter from Mrs. Robert Redding was read requesting the City
Council make a donation toward the School Patrol trip to Nassau.
Motion duly made by Councilman Dietz to set aside $75.00 for the
project, seconded by Councilman Ledbetter and by roll call vote
CARRIED. Councilman Dietz, IIWe have discussed this previously,
and have arranged for the donation.1I Mrs. Redding publicly gave
her thanks on behalf of the School Patrol to the Council.
A letter of Petition from the residents of Palm Breeze Drive re-
questing the City extend water to their area was read. Mayor
Cairnie~ IIWe are waiting for specifications from our engineers
to see what the total cost of supplying water to the area will
amount toll. Motion duly made this request be tabled until the
information is obtained from our engineers by Councilman Ledbet-
ter, seconded by Councilman Dimm and there were no objections.
A letter was re~d from Mr. Herbert W. Knowlton requesting he be
permitted to purchase a narrow strip of land from the City.
Motion duly made by Councilman Ledbetter we deny this request,
seconded by Councilman Dimm and by roll call vote CARRIED. At
this time, Councilman Dimm asked for the floor, liThe City is in
the process of building a fishing pier right in this area, and
frankly, we just do not have the available ground to give Up.1I
Mr. D. Wiggins, IIWhere is this property Mr. Knowlton is interes-

A letter was read from The American Legion, Edgewater Post No.
285, requesting the City Council purchase a wreath to be used
in their Memorial Day exercises. Motion duly made by Council-
man Ledbetter we purchase the wreath, seconded by Councilman
Dimm and by rollcall vote CARRIED. The roll call vote was un-
animous. Mr. Robert Maxwell, liOn behalf of the Legion, I want
to thank the Council.1I
RESOLUTIONS
RESOLUTION NO. 235 HIRING CLYDE HEATH AS CHIEF OF POLICE FOR THE
CITY OF EDGEWATER, FLORIDA, SETTING HIS TENURE AND HIS COMPENSA-
TION, SETTING FORTH THE CONDITION OF HIS CONTINUED EMPLOYMENT,
AND PROVIDING AN EFFECTIVE DATE.
The above Resolution was read in full by City Attorney Hall and
upon motion duly made by Councilman Dietz this Resolution be
adopted, and seconded by Councilman Dimm, and passed by vote of
the City Council of the City of Edgewater, Florida at the reg-
ular meeting of said Council held May 6, 1968.
Mr. J. Lodico from the floor, IIMr. Hall, what is the difference
between a Resolution and an Ordinance?1I Mr. Hall, IINot a great
deal; however, a Resolution eliminates the necessity for a sec-
ond reading.1I
Mayor Cairnie introduced our new Police Chief, Clyde W. Heath.
At the request of the Mayor, Chief Heath gave a short resume of
his background and experience. He received an ovation of welcome
from the people in the audience.
RESOLUTION NO. 236 ACCEPTING THE BID OF SIEG AND AMBACHTSHEER,
INC. OF DELAND, FLORIDA FOR THE ANNUAL MAINTENANCE OF THE TWO
ELEVATED WATER TANKS OF THE CITY OF EDGEWATER FOR A TOTAL OF
$ 1 , 5 0 0 PER YEA R, $ 6 2 5 0 F W H I CHI S FOR M A I NT E NAN CEO F THE 1 00 {J 000
GALLON TANK AND $875 OF WHICH IS FOR MAINTENANCE OF THE 150,000
TANK, REJECTING ALL OTHER BIDS AND CANCELING AND SUPERSEDING ANY
PRIOR CONTRACTS WITH THE SAID SIEG AND AMBACHTSHEER, INC. AS OF
THE EFFECTIVE DATE OF THIS RESOLUTION, WITHOUT IMPAIRING THE
VALIDITY OF THE SAID CONTRACT TO THE EFFECTIVE DATE OF THIS
RESOLUTION, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A
THREE YEAR CONTRACT WITH SIEG AND AMBACHTSHEER, INC., AND PRO-
VIDING AN EFFECTIVE DATE.
The above Resolution was read in full by City Attorney Hall and
upon motion duly made by Councilman Dietz this Resolution be
adopted, and seconded by Councilman Dimm, and passed by vote of
the City Council of the City of Edgewater, Florida at the regu-
lar meeting of said Council held May 6, 1968.
Councilman Ledbetter, IIWhy are we having a new contract on the
first tank; don't we have two or three years to go on the present
contract?1I Mayor Cairnie, liThe company wants to be relieved of
the old contract.1I Councilman Dietz, "It is still cheaper with
this new contract than under the old contract.1I Mr. D. Armstrong,
IIWasn't the old contract for $500.00 a year?1I Councilman Dietz,
IINo, the old contract was for $600.00.11
OLD BUSINESS
Councilman Dimm, IIWe still have not received any bids on the pav-
ing of Monroe Circle. Mrs. Ward, do you think we will have them
by the next Council meeting?1I Mrs. Ward, III would believe SO.II

NEW BUSINESS
Attorney Hall took the floor and explained the new Ordinance
changing section 13 of Ordinance #219. Mayor Cairnie then made
a call for order and the hearing on the ordinance to begin.
Councilman Dimm, "ls this to be the public hearing?" Mayor
Cairnie, "Yes, this is it. Right now." Councilman Dimm, "Well,
I don't like this at all, it seems a poor way to have a public
hearing. Why, there isn't hardly anyone here." The Mayor then
asked if there were any questions or discussions from the floor.
Mr. J. Lodico, "I think it is a good idea. I even think one
year is too short a time. It should be maybe two years.1I
Councilman Dimm, IIWell, right now we have a party asking for a
variance who submitted the same petition just thirty days ago.
This Ordi~ance will eliminate that; of course, this Ordinance,
if adopted, will not affect their current petition."
ORDINANCE NO. 599 AMENDING SECTION 13 6F ORDINANCE NO. 219,
HERETOFORE ENACTED ON JANUARY 19, 1959, AS AMENDED BY SECTION
1. OF ORDINANCE NO. 346, HERETOFORE ENACTED ON MARCH 18, 1963,
RELATING TO PETITIONS FOR CHANGE IN ZONING CLASSIFICATION BY
PROVIDING A FEE OR CHARGE FOR THE COST OF PROCESSING THEREFOR
AND BY PROVIDING THAT PETITIONS FOR CHANGE IN ZONING CLASSIFI-
CATION SHALL NOT BE RE-SUBMITTED TO THE CITY COUNCIL OR ZONING
BOARD OF THE CITY OF EDGEWATER, FLORIDA UNLESS AND UNTIL ONE
YEAR HAS ELAPSED FROM THE DATE OF FILING THE ORIGINAL OR PRIOR
PETITION FOR CHANGE IN ZONING CLASSIFICATIIDN UNLESS THE RE-
PETITION IS BASED UPON A CLEAR CHANGE IN CIRCUMSTANCES, AND
PROVIDING THAT THE ZONING BOARD SHALL BE THE JUDGE AS TO WHETHER
A CLEAR CHANGE OF CIRCUMSTANCES EXISTS UPON A RE-PETITION WITHIN
ONE YEAR; AND PROVIDING THAT THE RECOMMENDATION OF THE ZONING
BOARD THAT A CLEAR CHANGE IN CIRCUMSTANCES DOES NOT EXIST CAN BE
OVERRIDDEN ONLY BY THE VOTE OFTHREE COUNCILMAN; AND PROVIDING AN
EFFECTIVE DATE THEREFOR.
The foregoing Ordinance was read in full by City Attorney Hall
and upon motion duly made by Councilman Dietz this Ordinance be
adopted, seconded by Councilman Ledbetter, and by roll call vote
CARRIED.

Councilman Ledbetter, "Whi1e everyone else is getting a raise, how
about the boys in the garbage and street department?" Councilman
Dietz,"Where do you think we wiJ1 get the money?" Councilman Led-
better, "You can always pull it out of your hat 1 i ke you did before. II
"I want to make a motion to give the boys in the garbage department
a twenty-five cent an hour raise." As there was no second, the
motion was denied. Councilman Dimm, "I would like a Special Meet-
ing to discuss all of our problems with the garbage and street de-
partments. I would like Mr. Shippe to be present at this Special
Meeting.1I Mayor Cairnie, "Why a Special Meeting; why can't this
be discussed at our regular Thursday morning workshop?" Council-

liThe purpose of the workshop meeting is to formulate plans and
work up an agenda to be used at the Regular Meeting.1I Council-
man Ledbetter, 1100 you think the men in the garbage department
should get a raise?1I Mayor Cairnie, 111 cannot say yes and I
cannot say no; it would have to be analysed.1I Councilman Dietz,
liThe situation in these departments is certainly inequitable, and
it should be analysed. Some of the men should get a raise, but
then some of them are getting more than they are worth. The de-
partment needs re-organization.1I
Councilman Dimm, IIlf I had my way, workshop meetings would be
open to the public and the press. So many things are misinter-
preted, I have felt the council should purchase a tape recorder.
With a tape recorder, there would be no mistakes about what was
decided or who made the decision.1I
Councilman Ledbetter, IIWhat would be the pUlpose of this Special
Meeting?1I Councilman Dimm,IITo discuss the situation of the gar-
bage and street department with Mr. Shippe.1I Councilman Ledbet-
ter, 111 will second your motion provided a raise for the garbage
department is on the agenda for th,is meeting. 11 Councilman Dimm,
111 can1t go along with that.1I
Mayor Cairnie, liOn behalf of the Council and the citizens of
our City, I would like to publicly thank the Edgewater Fire De-
partment for their splendid work during the time of the fire
ban and the emergency.1I
Councilman Dietz, 111 would like to make a.motion that we name a
committee, to serve at the will of the Council, to promote and
supervise the development of a City planned recreational area on
school property in Edgewater. I would like to have appointed to
the committee, school principal J. D. Hogan, Donald E. Gillespie,
James Blackwell and Eugene Gawriluk.1I Mayor Cairnie, Ills this a
motion to ask the school authorities for the use of the school
grounds?1I Councilman Dietz, IINo, my motion is to name the com-
mittee for promotion and supervision for the development of the
area. It is already cleared with the school authorities. Of
course, the committee would have to get together with the Coun-
cil.1I The motion was seconded by Counci lman Ledbetter and by
roll call vote CARRIED.

The Mayor called on Mr. J. Lodico for a few words on the status
of the fishing pier. Mr. Lodico, liThe Chamber of Commerce voted
$600.00 to build the shuffleboard courts at the last meeting.
Councilman Dimm, Councilman Ledbetter and Mayor Cairnie were at
the last meeting. The Chamber is ready to discuss the park and
pier with the Council.1I Mayor Cairnie, IIWell, when are we going
to get together and have a meeting?1I Mr. Lodico, IIWe are willing
to bave a meeting anytime it is feasible with you boys.1I The
Mayor named Wednesday, May 8, 1968 at 7:30 P.M. and Mr. Lodico
agreed for the Chamber members.

house has less room, it is a smaller house than the one being
constructed by Ha~~t~. So why is Ratmer paying more for his
