The regular meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie at 7:30
P.M., July 7, 1969.

A Motion was duly made by Councilman Dimm, second by Councilman
Dietz to accept the minutes from the Regular Meeting of June
16, 1969. The motion upon roll call vote CARRIED.

COMMUNICATIONS
A LETTER FROM Officer Curtis G. Smith dated June 23, 1969.
This ~etter was his resignation from the Police Force effective
June 30, 1969 at 8:00 a.m..
Attorney Hall: We have a resolution on this.
A LETTER From the residents on West Joyce Street requesting
that a street light be installed at the end of West Joyce Street
because they have been having trouble with Peeping toms and
cars parking in the dead end using it as a lovers lane.
Councilman Ledbetter: I make a motion due to the fact that we
have been putting lights allover town, that we grant this
petition to the People.
Councilman Dietz: Did anyone go out and look at that situation?
David did you look at it? It's in your zone.
Councilman Ledbetter: I haven't checked on the others that
have been asked for, so I don1t see any use going on these.
Councilman Dietz: The way we have been doing it in the past,
each zone man in his zone would go look at it and check on it
and are you acquainted with the situation Mayor?

Mayor Cairnie: I know the situation over there, we have
a pumping station over there and I know that we have had a number
of complaints in the past that they seem to be using it as
lover's lane down ther for some reason or another.
Councilman Dietz: There's no lights there at all?
Mayor Cairnie: No. No lights at all.
Councilman Dietz: Chief what do you say?
Chief Heath: We have a lot of calls down there. We have had
Prowlers.
Councilman Dietz: Well lets put the light in then. It looks
like it's a necessity. I'll second the motion.
A Motion was duly made by Councilman Ledbetter, second by
Councilman Dietz to install a light at the end of West Joyce
Street and the motion upon roll call vote CARRIED.
A LETTER from Strobel J. Boll and J.A. Sapp requesting a
zoning variance so that they may build a trailor park between
Old County Road and U.S.I.
Councilman Dietz: There is only on thing we can do, and thats
turn it over to the Zoning Board for their opinion.
A Motion was duly made by Councilman Diezt, second by Councilman
Ledbetter to turn this request over to the Zoning Board and
the Motion upon roll call vote CARRIED.
ORDINANCES
AN ORDINANCE AUTHORIZING AND ALLOWING THE CITY OF EDGEWATER,
FLORIDA TO ASSESS AND COLLECT ONE DOLLAR AS A COURT COST AGAINST
EVERY PERSON CONVICTED FOR VIOLATION OF STATE PENAL OR CRLMINAL
STATUTE, OR CONVICTED FOR VIOLATION OF A MUNICIPAL OR COUNTY
ORDINANCE OR FROM THE ESTREATURE OR FORFEITURE OF ANY BAIL BOND
RELATED TO SUCH PENAL STATUTES OR PENAL ORDINANCES FOR THE PURPOSE
OF PROVIDING A FUND FOR LAW ENFORCEMENT EDUCATION EXPENDITURES
FOR LAW ENFORCEMENT OFFICERS OF THE CITY OF EDGEWATER, FLORIDA,
AND PROVIDING AN EFFECTIVE DATE THEREFOR.
Councilman Dimm: I have been hearing about the dollar for the
State. What is this for the city or the state?
Attorney Hall: This is to be used for the City. There is a
State Statute taking effect as of July 1st. that requires you
to send a dollar into the state.
Councilman Dimm: We don't have anything to say about that?
Attorney Hall: No. Thats mandatory, but the State Statute
gives the City the authority to levy an additional dollar for
their own training purposes of their own officers.

Councilman Dimm: Is this a new law the legislature has passed?
Attorney Hall: Yes it is.
Councilman Ledbetter: Does that mean if a man runs a stop
sign out here he still pays the dollar or is that just on
speeding violations?
Attorney Hall: Thats on everything except a parking violation.
Anyway you want it, the State wants a dollar out of it.
Mayor Cairnie: We have to take the dollar out anyway.

Councilman Dimm: It doesn't seem very fair that they should
be hit twice. I mean I don't think we're under such bad
circumstances taht we have to hit them twice. That's my opinion
of it.
Mayor Cairnie: Any other opinions on it?
Attorney Hall: Well, this doesn't require you to raise it a
dollar. You just take the dollar out of the fine.
Councilman Dimm: You have to stipulate which way we want it
so we can put it on the books.
Councilman Ledbetter: Well the State~ going to get theirs
regardless.
Councilman Dimm: Right. So you fine a man $15.00, one dollar
goes to the State and you have fourteen left.
Councilman Dietz: Now wait a minute, does that make the fine
$15.00 or $17.00.
Councilman Ledbetter: $17.00 the way it states now.
Attorney Hall: It's whatever you want to set it, but a dollar
out of it goes to the State and if you pass this, a dollar goes
into a special fund for training your own Police Officers.
Mayor Ca~rnie: If the fine is $15.00 we have to send one dollar
of that to the State. We have no choice.
Councilman Dimm: What if the fine is $100.00.
Mayor Cairnie: It1s still one dollar.
Councilman Dimm: That for the paperwork evidently.
Mayor Cairnie: it's still one dollar.

Councilman Dimm: Now I personally don't feel that we should take
another dollar from them.
Councilman Ledbetter: Is this dollar going to be used for our
policemens schooling or do they still go to school on their own
for the required 200 hours?

Mayor Cairnie: I think that the Chief can exp1a~n just what
you would do if we had this thing created. What would you
do with that dollar.
Chief Heath: I don't know what this dollar for the State is
for.
Mayor Ca1rnie: Thatls for the Polcie Academy.
Chief Heath: Well, we don1t get any benefit out of that.
Councilman Ledbetter: 11m going to make a motion to table
this Ordinance because I don't think its in the best interest
of the People of Edgewater.
Councilman Dimm: Well, all you1re doing is taking money to
train men to get more speeders.
A Motion was duly made by Councilman Ledbetter, second by
Councilman Dimm to table this Ordinance for further study.
The Motion upon roll call vote CARRIED.
RESOLUTIONS
RESOLUTION NO. 295. A RESOLUTION ACCEPTING THE RESIGNATION
OF PATROLMAN CURTIS GLENN SMITH AND PROVIDING AN EFFECTIVE
DATE THEREFOR.
The above resolution was read by City Attorney Charles A. Hall.
A Motion was duly made by Councilman Ledbetter, second by
Councilman Dimm to accept Curtis Smiths resignation. The motion
upon roll call vote CARRIED.
Councilman Dimm: How long was he employed here?
Chief Heath: 32 days.
RESOLUTION NO. 296. A RESOLUTION HIRING LARRY CARLYLE
STEVENSON AS PATROLMAN FOR THE CITY OF EDGEWATER, FLORIDA
SETTING FORTH HIS TENURE, PROVIDING FOR HIS COMPENSATION, AND
PROVIDING AN EFFECTIVE DATE FOR SAID EMPLOYMENT.
The above resolution was read by ~ity Attorney Charles A. Hall.
A Motion was duly made by Councilman Dimm, second by Councilman
Dietz to adopt the above resolution and the Motion upon roll call
vote CARRIED.
RESOLUTION NO. 297. A RESOLUTION ACCEPTING THE BID OF BISCAYNE
FIRE EQUIPMENT COMPANY, INC. FOR FURNISHING TWO (2) SELF CONTAINED
BREATHING APPARATUS COMPLETE WITH TWO (2) EXTRA CYLINDERS AND
CARRYING CASE AND ONE Ql) FOAM EDUCTOR WITH NOZZLE AND TANK
FOR THE TOTAL PRICE OF $1,287.50 AND REJECTING ALL OTHER BIDS.

Mrs. Elsie L. Ward, City Clerk of the City of Edgewater,
Florida certified on the 7th day of July, A.D., 1969 that
there are sufficient funds in the Emergency and Contingency
Account to cover the cost of the Fire equipment covering
two (2) Breathing apparatus and one (1) Foam Eductor.
A Motion was duly made by Councilman Dimm, second by Councilman
Dietz to adopt the above resolution and the motion upon roll

Mr. Paul Walls: We have received the Breathing apparatus and
have given a demonstration of it on the 4th of July. It's
going to be a real asset to the Fire Department.

Certification of the bids received for the fishing~Pier to be
erected at Indian River BJvd~ Park. was read by the City Clerk,
Elsie L. Ward.

A Motion was duly made by Councilman Dimm, second by Councilman
Dietz to accept the lowest Bid of Springer for $4,850.00. THe
Motion upon roll call vote CARRIED. Councilman Ledbetter
abstained.
Certification of the bids received for furnishing all plant,
labor, materials and equipment and constructing drainage culverts
and adjusting sanitary sewers for the City of Edgewater was read
by the City Clerk, Elsie L. Ward.

A Motion was duly made by Councilman Ledbetter, second by
Councilman Dimm to table this bid for further study. THe Motion
upon roll call vote CARRIED.
MISCELLANEOUS
Mayor Cairnie: I think it would be very nice of the Council
to make a Motion to write a letter to the Fire Department to
commend them on the Fireworks display on the 4th. It was delightful
to have people tooting their horns and clapping when they~re over.
A Motion was duly made by Councilman Dimm, second by Councilman
Dietz tto write the letter to the Fire Department. The motion
upon roll call vote CARRIED.
There being no further business a Motion was duly made by
Counei1man Ledbetter, second by Councilman Dietz that the
meeting be adjourned. The Motion upon roll call vote CARRIED.
