The regular meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie at 7:30
P.M., March 17, 1969.

A Motion was duly made by Councilman Dimm, second by Councilman
Ledbetter to accept the minutes from the Regular Meeting of
March 3, 1969. The motion by roll call vote CARRIED.

COMMUNICATIONS
A letter from the Edgewater Volunteer Fire Department dated
March 12, 1969 asking the City Council for their consideration
in purchasing 2 radios for use in the Fire Trucks. (one 6 volt
and the other 12 volts).
Councilman Dimm: These are new radios that their talking about
and are there any prices?
Mayor Cairnie: No. I imagine one radio set will cost a little
under $500.00.
Councilman Norman: I thought we were already given the prices on
that.
Councilman Dimm: Could you put them out for bids? We haven't
had much of a discussion on this yet.
Mayor Cairnie: Yes, they'll go out for bids first.
Councilman Ledbetter: I make a motion that we table this until
we can go into a more complete study on them.
Mr. Paul Walls: You are indangering the lives of the firemen if
we don't have them. Right now we have one radio and we get real
excellent cooperation from the chief in keeping track of fires.
If we're at one fire and another one happens and the chief is
not there we're lost. We can't depend on sending the other truck,
we have no intercommunications between the trucks and between
the firemen. We have a base station over here which can be tied
into and we can keep a man here in communications with the hospital.
There are many reasons we should have this. You've got a good
Volunteer Fire Department and they are trying to do the best they
can and you sure can't operate without the proper equipment.

Councilman Dimm: Now I understand the Chief is having a
little trouble with his radio too. I think we should put this
out for bids and also include the police car.
A Motion was duly made by Councilman Dimm, second by Councilman
Norman to advertise for bids for 2 radios for the Fire Department
and 1 radio for the police chiefs car. The Motion by roll call
vote CARRIED.
A letter from Esther Wallace dated March 9, 1969 asking
permission to put a trailer on the back of her shop on 1901
South Ridgewood, Edgewater, Florida.
A Motion was duly made by Councilman Dimm, second by Councilman
Ledbetter to refer Mrs. Wallaces' request to the zoning board.
The Motion by roll call vote CARRIED.
A letter from the Shuffleboard Club of Edgewater dated March 13,
1969 asking the City of Edgewater to construct two new courts
at the Park and Pier.
Councilman Ledbetter: Mrs. WArd, do we have enough money in the
Recreation Department to build these 2 new shuffleboard courts?
Mrs. Ward: It would have to come out of Emergency and Contingency.
Before you spend too much more I think you should sit down and
figure out what the rest of the departments need for the year.
Councilman Dimm: Carl Shell, why do you need two (2) more courts?
Mr. Shell: Well because the 12 we have now are filled and there are ~
a lot more people.
Councilman Dimm: The last time you needed 2 courts was to comply
with the regulations you needed to hold tournaments. Now you
need two more becasue you have more people.
Mr. Shell: The membership is much larger this year. Its larger
than its ever been by about 30 people. We have lots of days when
we could use 8 more courts.
Councilman Dimm: Do you have the room out there?
Mr. Shell: Yes. We have lots of room.
Councilman Ledbetter~ Well, I recommend that we give it to them
because the Chamber of Commerce gave them the last 2, last year and
its been two years since we've put anything over there.
Councilman Norman: Don't you think we better wait until we find
out how much money its going to cost us.
A Motion was duly made by Councilman Ledbetter, second by
Councilman Dimm to table this until a further study can be made.
The motion by roll call vote CARRIED.
A Letter from Mrs. R. Millner dated March 11, 1969 thanking the
City for the Wednesday Coffee Hour, and Mr. & Mrs. Pasch for
doing such a fine job with it.
A Letter from the Edgewater Recreation Association thanking the
City for its aid in their first All American Day ceremony dated
March 10, 1969 was read by the Mayor.

ORDINANCES
ORDINANCE NO. 625. AN ORDINANCE AMENDING ORDINANCE NO. 609,
THE TENATIVE BUDGET ORDINANCE FOR THE FISCAL YEAR BEGINNING
NOVEMBER 1, 1968 AND ENDING OCTOBER 31, 1969, SO AS TO
APPROPRIATE THE SUM OF $13,000.00 FROM ACCRUED SURPLUS TO
SURPLUS FUNDS OF ESTIMATED INCOME FOR SAID FISCAL YEAR AND
FURTHER APPROPRIATING THE SAID SUM OF $13,000.00 TO EMERGENCY
AND CONTINGENCY FUND OF ESTIMATED EXPENDITURES FOR THE SAID
FISCAL YEAR.
The above Ordinance was read by City Attorney Charles A. Hall.
A Motion was Duly made by Councilman Norman, second by Councilman
Ledbetter to adopt the above Ordinance. The Motion by roll call
vote CARRIED.
A Motion was Duly made by Councilman Ledbetter, second by
Councilman Norman to waive the second reading and the motion by
roll call vote CARRIED.
ORDINANCE NO. 626. AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE
NO. 538 RELATING TO THE EXTENSION OF SEWER SERVICE BY ADDING
THERETO SUB-SECTION C WHICH SHALL PROVIDE FOR THE EXTENSION OF
SEWER SERVICE OUTSIDE OF THE CORPORATE LIMITS OF THE CITY OF
EDGEWATER, FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The above Ordinance was read by City Attorney Charles A. Hall.
A Motion was Duly made by Councilman Dimm, second by Councilman
Norman to adopt the above Ordinance and the motion by roll call
vote CARRIED. Councilman Ledbetter voted NAY.
Councilman Ledbetter: I'd like to know more about it. This
comes under 180 of the Florida Statutes and also in Ordinance
400. I still can't find anything in the Ordinances that says
we can put this out there. The only thing I can find is in the
Feasibility Report. I think we've got too many people in
Florida Shores and allover the rest of the town who are paying
for the Utility tax on water and sewer and we come up with this
stuff.
Mr. Armstrong: I am quite familiar with the Ordinance 400. There
would be 10% less for the people outside of the Corporation, 10%
cheaper for these people if we had to go by the Ordinance 400.
City Attorney Hall: Ordinance No. 400 doesn't say one thing about
extending the water and sewer outside of the Corporate limits.
Mr. Armstrong: Thats not what we were talking about. We're talking
about the cost of it. Ordinance No. 400 says that there will be no
differential in cost.
City Attorney Hall: Thafs talking about service within the City
Limits.
A Motion was Duly made by Councilman Norman, second by Councilman
Dimm that we waive the second reading. The Motion by roll call
vote CARRIED. Councilman Ledbetter voted NAY.

ORDINANCE NO. 627. AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE
NO. 539 RELATING TO THE EXTENSION OF WATER SERVICE BY ADDING

Norman to adopt the above Ordinance. The motion by roll call
vote CARRIED. Councilman Ledbetter voted NAY.
Councilman Ledbetter: This is an Ordinance and it pertains to
the people of Edgewater. An Ordinance written outside of the
City isn't worth the paper its written on. Isn't that right Mr.
Hall?
Attorney Hall: No. Chapter 180 allows us to do this.
Councilman Ledbetter: How can it be out in the County and be
under the municipality?
Attorney Hall: Because the State Law allows us to do it.
Mr. Walls: What are the size of the pipes?
Mayor Cairnie: They'll meet with our engineers specifications.
A Motion was duly made by Councilman Dimm, second by Councilman
Norman to waive the second reading and the motion by roll call
vote CARRIED. Councilman Ledbetter voted NAY.
ORDINANCE NO. 628. AN ORDINANCE CREATING A ZONE OR AREA OUTSIDE
THE CORPORATE LIMITS OF THE CITY OF EDGEWATER, FLORIDA FOR THE
PURPOSE OF PROVIDING WATER AND SEWER SERVICE TO SAID ZONE OR AREA;
DEFINING SAID AREA OR ZONE; REQUIRING ALL PERSONS WITHIN SAID AREA
OR ZONE TO CONNECT TO CITY WATER AND SEWER SYSTEM WHEN AVAILABLE;
AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The above Ordinance was read by aityrAtto~ney Charles A. Hall.
A Motion was duly made by Councilman Dimm, second by Councilman
Norman to adopt the above Ordinance and the Motion upon roll
call vote CARRIED. Councilman Ledbetter voted NAY.
Mr. Pummer: I am president of the Silver Ridge Home Owners
Association and we strongly object to this Ordinance as well
as the other ones concerning the water and sewer going outside
of the city. We don't think its feasib1eeor right.

Norman to waive the second reading and the Motion by roll call
vote CARRIED. Councilman Ledbe~ter voted NAY.
RESOLUTIONS
RESOLUTION NO. 280. A RESOLUTION OF INTENT TO EXTEND CITY WATER
AND SEWER SERVICE TO A DESIGNATED ZONE OR AREA OUTSIDE OF THE CITY
LIMITS; PROVIDING RULES AND REGULATIONS PERTAINING TO SAID EXTENSION;
PROVIDING THAT THERE WILL BE NO MORTGAGE REVENUE CERTIFICATES OR
DEBENTURES ISSUED TO FINANCE THE PROJECT; PROVIDING FOR THE FILING
WITH THE CITY OF WRITTEN OBJECTIONS AND PROVIDING FOR A HEARING
THEREUPON; AND PROVIDING AN EFFECTIVE DATE THEREFOR.

A Motion was duly made by Councilman Dimm, second by Councilman
Norman to adopt the above Resolution and the Motion by roll call
vote CARRIED. Councilman Ledbetter voted NAY.
Councilman Ledbetter: Why under the particular subjects do the
Citizens have to put in written objections when we haven't done
this before? I think the water and sewer department belongs to 1
the people of Edgewater and I don't want any part of setting up
here to try and represent the people of zone 2 when they have to
turn in a written objection to get the floor to speak.
City Attorney Hall: This is in Section 180 of the State Law and
has been there for years.
Mayor Cairnie: Couldn't they also send in their written objections
and then also come to the meeting and object.
City Attorney Hall: Yes, if they want to.
RESOLUTION NO. 281. A RESOLUTION HIRING WILLIAM KENNETH BUCHER
AS PATROLMAN FOR THE CITY OF EDGEWATER, FLORIDA, SETTING FORTH
HIS TENURE, PROVIDING FOR HIS COMPENSATION, AND PROVIDING AN
EFFECTIVE DATE FOR SAID EMPLOYMENT.
A Motion was duly made by Councilman Norman, second by Councilman
Dimm to accept the a~ove Resolution and upon roll call vote
CARRIED. The above Resolution was read by City Attorney Charles
A. Hall.
RESOLUTION NO. 282. A RESOLUTION APPOINTING CALVIN R. DIETZ TO
THE TRADE CODES STUDY GROUP AUTHORIZED UNDER THE VOLUSIA COUNTY
COMMISSION AS A REPRESENTATIVE FROM THE CITY OF EDGEWATER, FLORIDA
TO STUDY A UNIFIED PLUMBING CODE FOR POSSIBLE USE WITHIN THE COUNTY,
PROVIDING THAT THE SAID CALVIN R. DIETZ SHALL HAVE NO AUTHORITY OR
POWER TO MAKE ANY BINDING DECISION FOR THE CITY OF EDGEWATER,
FLORIDA, AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The above~Resolution was read by City Attorney Charles A. Hall.
A Motion was duly made by Councilman Ledbetter, second by Councilman
Dimm to adopt the above Resolution. A Motion by roll call vote
CARRIED.
Mayor Cairnie: I might explain to the people that the purpose for
this is the County is trying to get a standard plumbing code for
the whole Volusia County rather than having every city with their
own code. This is a big step in the right direetion.
RESOLUTION NO. 283. A RESOLUTION ACCEPTING THE BID OF GRAYBAR
ELECTRIC CO., INC. OF ORLANDO, FLORIDA FOR TWENTY-FOUR (24) METALARC
LAMPS IN THE AMOUNT OF THREE THOUSAND EIGHT HUNDRED SIXTY ($3,860.00)
DOLLARS.
Mrs. Ward read the certification of funds available for the above
Resolution.
The above Resolution was r.ead by City Attorney Charles A. Hall.
A Motion was duly made by Councilman Dimm, second by Councilman
Norman to adopt the above Resolution and the Motion by roll call

RESOLUTION NO. 284. A RESOLUTION AUTHORIZING THE EXECUTION
OF A UTILITIES AGREEMENT FOR THE ADJUSTMENT, CHANGE OR RELOCATION
OF CERTAIN UTILITIES WITHIN THE RIGHT-OF-WAY LIMITS HEREINAFTER
DESCRIBED, AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The Above resolution was read by City Attorney Charles A. Hall.
A Motion was Duly made by Councilman Ledbetter, second by
Councilman Dimm to adopt the above Resolution and the motion upon
roll call vote CARRIED.
Mayor Cairnie: This refers to the Utilities on the relocation
on Indian River Boulevard of the proposed exit for 1-95. I would
like to ask out Attorney if we have assurance fr.om the Telephone
Company and the Electric Company that they will move whatever
utilities they have too.
City Attorney Hall: Yes, because they have to enter into the same
agreement with the State Road Department.
Mayor Cairnie: The only other thing we have to consider is
lenghtening of the manholes for our sewers on that particular Street.
Ci ty Attorney Hall: Yes.
Mr. Armstrong: I've waited 7 years to hear you read that. .
