REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF EDGEWATER, FLORIDA
HELD DECEMBER 16, 1968
The regular meeting of the City Council of the City of Edgewater,
Florida was called to order by Mayor William H. Cairnie at 7:30 P.M.
December 16, 1968.

Motion was duly made by Councilman Dimm, second by Councilman Norman
to accept the minutes from the Regular Meeting of December 2, 1968
and a motion by roll call vote CARRIED. Councilman Dietz abstained.

COMMUNICATIONS
A letter dated November 21,1968 from Lilliam I. Jackson was her
notice of resignation from the Board of Directors, Edgewater Public
Library effective immediately. Motion was duly made by Councilman
Norman, second by Councilman Dimm to accept the above resignation and
by roll call vote CARRIED.
A letter dated December 4, 1968 from the Edgewater Zoning Board in
regards to the request of Loveland Groves, Inc. to errect a sign on
Mr. Harold McClane1s property on U.S. #1. They recommended that the
request be granted.
Motion was duly made by Councilman Dimm, second by Councilman Dietz
to grant permission and to discuss further the revision of Ordinance
No. 96 of December 12, 1955. Being no objections motion by roll call
vote CARRIED.II
A letter dated December 4, 1968 from Roger Dalhous has requested
permission to put a 60 x 24 mobile home with approximate;cost of $8000
on his lot Number 5 on Old County Road.
Motion was duly made by Councilman Dimm, second by Councilman Norman
to referr this letter to the Zoning Board as Mr. Dimm suggested.
Being no objections motion by roll call vote CARRIED.
A letter dated December 11,1968 from the United Fund of East Volusia
County, Inc. requesting permission to conduct its annual campaign
during the month of March, 1969.
Motion was duly made by Councilman Dietz, second by Councilman Norman
to grant permission. Being no objections motion by roll call vote
CARRIED.

ORDINANCES
ORDINANCE NO. 619. AN ORDINANCE PROVIDING THAT A POLICE OFFICER MAY
STOP ANY PERSON IN A PUBLIC PLACE WHEN THE SAID OFFICER REASONABLY
SUSPECTS THAT THE PERSON IS COMMITTING OR IS ABOUT TO COMMIT OR HAS
COMMITTED A FELONY OR MISDEMEANOR AND MAY DEMAND THE NAME AND ADDRESS
OF THE PERSON AND AN EXPLANATION OF HIS ACTIONS; PROVIDING FURTHER
THAT WHEN A POLICE OFFICER HAS STOPPED A PERSON FOR TEMPORARY QUESTIONING
PURSUANT TO THIS ORDINANCE AND WHEN THE OFFICER REASONABLY SUSPECTS
HE IS IN DANGER OF LIFE OR LIMB, HE MAY SEARCH SUCH PERSON FOR DANGEROUS
WEAPONS; PROVIDED FURTHER THAT WHEN THE OFFICER DISCOVERS A WEAPON,
HE MAY TAKE IT UNTIL THE COMPLETION OF THE QUESTIONING, AT WHICH TIME
HE MAY EITHER RETURN THE WEAPON OR ARREST THE PERSON SO QUESTIONED;
PROVIDING A SEVERABILITY PROVISION; PROVIDING A PENALTY FOR THE
VIOLATION OF THIS ORDINANCE AND PROVIDING AN EFFECTIVE DATE.
The above Ordinance was read by City Attorney Charles A. Hall.
Motion was duly made by Councilman Norman, second by Councilman Dietz
that this Ordinance be adopted and by roll call vote CARRIED. Mayor
Cairnie then stated that this was a similar Ordinance to which other
cities have adopted.

waive the second reading of the above Ordinance and by roll call vote
CARRIED.

ORDINANCE NO. 620. AN ORDINANCE AUTHORIZING AND ALLOWING BARS IN THE
CITY OF EDGEWATER, FLORIDA TO REMAIN OPEN FROM 12:01 P.M. ON DECEMBER
24, 1968 UNTIL 2 A.M. ON DECEMBER 25, 1968 AND FROM 12:01 P.M. ON
DECEMBER 31, 1968 UNTIL 4 A.M. ON JANUARY 1, 1969, AND FURTHER ALLOWING
THE SALE OF ALCOHOLIC BEVERAGES DURING THESE PERIODS.
The above Ordinance was read by City Attorney Charl_es A. Hall. Motion
was duly made by Councilman Dtetz, second by Councilman Dimm that this
Ordinance be adopted and by roll call vote CARRIED.
There was a call for questions by Mayor Cairnie.

Attorney Hall stated that it was and went on to explain that an Ordinance
must be submitted each year by the People of the City to the City Council
because each new Council may have different views on the above Ordinance.

Motion was made by Councilman Dietz, second by Councilman Dimm to waive
the second reading of the above Ordinance and by roll call vote CARRIED.
ORDINANCE NO. 621. AN ORDINANCE APPROVING THE RECOMMENDATION OF THE
EDGEWATER ZONING BOARD PERTAINING TO THE APPLICATION OF LOVELAND GROVES,
INC. FOR PERMISSION TO ERECT A BILL BOARD, AND GIVING AND GRANTING UNTO
SAID LOVELAND GROVES. INC. A VARIANCE FROM THE PROVISION OF SECTION 2.
OF ORDINANCE NO. 96, AND ANY ORDINANCE IN CONFLICT WITH SAID VARIANCE.
The ~bove Ordinance was read by City Attorney Charles A. Hall. Motion
was duly made by Councilman Dimm, second by Councilman Dietz to adopt
the above mentioned Ordinance and by roll call vote CARRIED.
There was a call for questions by Mayor Cairnie.

RESOLUTIONS NO. 270. A RESOLUTION ACCEPTING THE RESIGNATION OF GAIL
V. ALDERMAN AS DEPUTY CLERK FOR THE CITY OF EDGEWATER, FLORIDA.
The above Resolution was read by City Attorney Charles A. Hall and
upon Motion duly made by Councilman Dimm, second by Councilman Norman
this Resolution was adopted and by roll call vote CARRIED. .
RESOLUTION NO. 271. A RESOLUTION APPOINTING AND DESIGNATING BETTY
E. MARTZ AS DEPUTY CLERK FOR THE CITY OF EDGEWATER, VOLUSIA COUNTY,
FLORIDA AND SETTING :FORTH HER DUTIES AND COMPENSATION.
The above Resolution was read by City Attorney Charles A. Hall and
upon Motion duly made by Councilman Dimm, second by Councilman Dietz
this Resolution was adopted and by roll call vote CARRIED.

MISCELLANEOUS
POLICE CHIEF Clyde W. Heath reminded us that Court was no longer being
held on Wednesday. After Court on December 18,1968 r'1uAicipal Court will
be held on Mondays starting on December 23, 1968.
MAYOR William H. Cairnie reminded us of the Christmas Party for the
children of Edgewater was this coming Saturday December 21, 1968 in
the Community Center.
There being no further business motion was duly made by Councilman
Dietz, second by councilman Dimm that the meeting be adjourned and
there were no objections.
