09-15-1969 - Proclamation/Special Election 1 ~0 o I/O U o PROCLAMA TION A PROCLAMATION CALLING A SPECIAL ELECTION TO BE HELD IN CONJUNCTION WITH THE REGULAR ELECTION ON NOVEMBER 4, 1969 FOR THE PURPOSE OF DECIDING THE QUESTION OF ANNEXING INTO THE CITY OF EDGEWATER, FLORIDA A PARCEL OF LAND OWNED BY ROSS O. SULLIVAN AND LYING ADJACENT AND CONTIGUOUS TO LAND PRESENTLY IN THE CORPORATE LIMITS OF THE CITY OF EDGEWATER, FLORIDA, SAID PARCEL OF LAND BEING MORE PARTICULARLY HEREINAFTER DESCRIBED; PROVIDING THAT THIS PROCLAMATION SHALL BE POSTED IN TWO PUBLIC PLACES IN THE CITY OF EDGEWATER, FLORIDA FOR FOUR CONSECUTIVE WEEKS IMMEDIATELY PRECEDING THE DATE OF SAID ELECTION, ONE OF WHICH SAID PUBLIC PLACES SHALL BE THE BULLETIN BOARD IN THE CITY HALL OF THE CITY OF EDGEWA TER, FLORIDA, AUTHORIZING THE CITY CLERK TO TRANSMIT A COPY OF THIS PROCLAMATION TO THE SUPERVISOR OF ELECTIONS FOR VOLUSIA COUNTY, FLORIDA AND PROVIDING AN EFFECTIVE DATE THEREFOR. WHEREAS, Ross O. Sullivan is the owner of a parcel of land in Volusia County, Florida, more particularly described hereinafter, and has petitioned the City for annexation of said land into the City of Edgewater, Florida, and it appearing that he is the sole owner of the parcel in question and that the City Council is desirous of placing the question of annexation on the ballot for the election previously set for November 4, 1969. NOW THEREFORE, BE IT PROCLAIMED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. That a Special Election be and the same is hereby called for November 4, 1969, to be held in conjunction with the Regular Election previously called for that date, for the purpose of deciding the question of annexing the following described real estate in Volusia County, Florida owned by Ross O. Sullivan and lying contiguous and adjacent to property already within the corporate limits of the City of Edgewater, Florida, into the corporate limits of the City of Edgewater, Flo~ida, said land being more particularly described as: l ~u o u o All that portion North of the now existing Drainage ditch of that parcel described as follows: The South 500 feet of Lot 6 and the South 500 feet of West half of the Northeast quarter (East of U.S. Highway #1,) Section 2, Township 18 South, Range 34 East. Otherwise described as follows: The South 500 feet of Lot 6 and the South 500 feet of the West half of the Northeast Quarter (East of U.S. Highway #1,) Section 2, Township 18 South, Range 34 East, EXCEPT the South part being 112 feet on the West line of U.S. Lot 6, and 378 feet North from the Southeast corner of Lot 6, and riparian rights, accretions, littoral rights, and rights of upland ownership thereto belonging and appertaining. EXCEPT that part conveyed to the State of Florida for use and benefit of State Road Department of Florida, being described as, to-wit: That part of: "The South 500 feet of W-1/2 of the Northeast Quarter (NE-1/4) and Lot 6 East of the highway and North of the ditch (also described as the South 500 feet of the W-1/2 of the NE-1/4 and Lot 6 East of the highway EXCEPT South 112 feet on the East line and 378 feet North from the Southeast corner), Section 2, Township 18 South, Range 34 East which lies East of and adjacent to existing Right-of-Way of State Road 5 (U.S.#1) lying East of and within 125 feet of the existing centerline of State Road 5 (U.S.#1) 'being the West 92 feet of the land herein described and containing 0.93 acres, more or less. AND also the following described parcel: A parcel of sovereignty land now filled lying Easterly of and abutting Government Lot 6, Section 2, .Township 18 South, Range 34 East, Volusia County, Florida, more particularly described as follows: Commence at the Southeast Corner of said Government Lot 6; thence North 250 18' 40" West along the East line of said Government Lot 6, a distance of 396.55 feet to the Point of Beginning; thence continue North 25- 18' 40" West, a distance of 156.8 feet; thence North 64- 41' 20" East, a distance of 209 feet; thence South 25- 18' 40" East, a distance of 156.8 feet; thence South 640 41' 20" West, a distance of 209 feet; more or less, to the Point of Beginning. Containing 0.7 of an acre, more or less, with riparian rights pertaining thereto. SECTION 2. That this Proclamation shall be posted in two public places in the City of Edgewater, Florida once each week for four (4) consecutive weeks, the first publication or posting to be not less than thirty (30) days prior to November 4, 1969, and further providing that one of said public places for publication or posting shall be the Bulletin Board at the City Hall in the City of Edgewater, Florida. -2- I '1 , u u o o SECTION 3. That the City Clerk be and she is hereby authorized to tramsmit a copy of this Proclamation to the Supervisor of Elections for Volusia County, Florida. SECTION 4. That this Proclamation shall become effective immediately upon its adoption by the City Council and approval by the Mayor. The above and foregoing Proclamation was presented by Councilman who moved its adoption, said Norm an motion being seconded by Councilman , and, Dimm upon roll call vote, the said Proclamation was duly declared adopted at a regular meeting of the City Council of the City of Edgewater, Florida held on the 15th day of September A.D., 1969, the vote of said Council upon roll call being as follows: lP.
