The Regular Meeting of the City Council for the City of Edgewater,
Florida, \'Jas ca-led to order at 7:30 P.M., Monday, July 6, 1970,
by Mayor William H. Cairnie, in the office of the Mayor, City Hall.

A motion for approval of the minutes of the Regular Meeting of
June 15, 1970, was duly made by Councilman Ledbetter and seconded
by Councilman Lodico. Upon roll call vote, said motion CARRIED.

A motion for the approval of the above stated Bills and Accounts
for payment was duly made by Councilman Ledbetter and seconded by
Councilman Dietz. Upon roll call vote, said motion CARRIED.

The Officers Reports stated above were read by City Clerk, Elsie
L. ~Jard.
cor~MUNICATIONS
A letter from Mr. John C. Gross, 404 North Riverside Drive,
Edgewater, was read by City Clerk Elsie L. Ward. Mr. Gross stated
his wish to purchase the City property east of Riverside Drive
in front of his property.
A letter from Mr. Charles Crigger, 402 North Riverside Drive,
Edgewater, was also read, in which Mr. Crigger wished to purchase
City property east of Riverside Drive in front of his home.
Councilman Fugate explained that in talking to a past Mayor of
the City, he had learned that this strip of property between
Riverside Drive and the river had been deeded to the City for
its use as a park and recreation area; however, some owners of
property along Riverside Drive had obtained quick-claim deeds
to property across from their homes from past Councils.
Councilman Ledbetter duly moved to have Messrs. Gross and Crigger
notified by the City Clerk that lithe City has no desire to sel1
their park and recreation lands". Said motion was seconded by
Councilman Lodico and upon roll call vote, said motion DID NOT
CARRY, the vote of each Counci1man being as follows: Lodico-YEA,
Ledbetter-YEA, Fugate-NAY, Dietz-NAY and Mayor Carrnie-NAY.
Councilman Dietz then moved to table the request of Mr. Crigger
and Mr. Gross until the report came in from the City Attorney on
the survey and abstracts of this property, after which time the
Council could discuss and decide on the matter of City property
sale. Said motion was seconded by Councilman Fugate and upon roll
call vote, said motion CARRIED, the vote of each Councilman being
as follows: Lodico-NAY, Ledbetter-ABSTAIN, Fugate-YEA, Dietz-YEA
and Mayor Cairnie-YEA.
Another letter from Mr. John C. Gross was read by the City Clerk
in which r~r. Gross questioned whether a garage built on property
adjacent to his property was 1egal by any City Ordinance or Zoning
Law since the garage fronted a street.

COMMUNICATIONS, CONT.
City Attorney Charles A. Hall stated that there was no Ordinance
on Zoning or any Building Code which prohibited erecting a
garage on street frontage.
Mr. Gross, who was present at the meeting, then addressed the
Council and stated that since there was no Ordinance or Building
Code prohibiting such a structure, there was no need to further
discuss the other questions in his letter.
A letter from the Board of Public Instruction addressed to the
Chief of Police was read by City Clerk, Elsie L. Ward.
The purpose of the letter was to commend Officer Fred Cotnoir,
school crossing guard, on his job performance during the past
school term, in that no accidents or personal injuries were incurred.
Mayor Cairnie stated that he felt Mr. Cotnoir should be given a
copy of the letter and an additional copy should be placed in
his records at City Hall.
A letter from the City Planning Board was read by City Clerk,
Elsie L. Ward.
The Planning Board stated a need for two additional boat ramps
at the Park and Pier to better accommodate the increas~ number
of boats being launched from the pier.
Councilman Ledbetter moved to table the matter for further study,
said motion being seconded by Councilman Dietz. Upon roll call
vote, said motion CARRIED.
ORDINANCES
NONE
RESOLUTIONS
RESOLUTION NO. 343: A RESOLUTION APPOINTING AND
DESIGNATING CORNELIA ANN KINSEY AS DEPUTY CLERK FOR THE CITY OF
EDGEWATER, VOLUSIA COUNTY, FLORIDA, AND SETTING FORTH HER DUTIES
AND COMPENSATION.
The Resolution stated above was read by City Attorney Charles A. Hall.
A motion for adoption of said Resolution was duly made by Councilman
Lodico and seconded by Councilman Ledbetter. Upon roll call
vote, said motion CARRIED.
Mayor Cairnie asked to rearrange the agenda momentarily and skip
to MISCELLANEOUS, in order that Mr. Roberts from the TM Communi-
cations Company could make his presentation and return to Deland
for another appointment.
Mr. Roberts then presented Mayor Cairnie with a pre-contract and
a pre-payment check for $1,000.00 for the TM Company's new cable
television contract with the City.
After Mayor Cairnie wished Mr. Roberts and the TM Communications
Company "much luck" in setting up their operations in the City,
Mr. Roberts stated that he believed they had found a suitable
tower site and hopefully work would begin in about six months.
OLD BUSINESS
A Certification of Bids received on the air conditioning and
insulating of the Community Center was read by City Clerk, Elsie
L. Ward. The sealed bids were then opened and read aloud by the

Councilman Dietz duly moved to table the two bids on heating and
air conditioning and the one bid on insulation for further study.
Said motion was seconded by Councilman Fugate and upon roll call
vote, said motion CARRIED.
NEW BUSINESS
A motion was duly made by Councilman Ledbetter and seconded by
Councilman Dietz for the intent to put out bids for paving the
area around the front of the shuffleboard courts and the side
adjacent to the restrooms. Bids are to be returned by July 20,
1970, with the individual contractors providing their own
recommendations for paving. Upon roll call vote, said motion
CARRIED.
A motion to put out bids for a culvert under Knapp Avenue was
duly made by Councilman Fugate and seconded by Councilman Dietz.
Upon roll call vote, said motion CARRIED.

Mr. Paul Walls, spokesman for the Recreation Association, addressed
the Council and expressed the need for a mowing machine at the
ball park and surrounding area. Mr. Walls stated that he had gotten
some prices on a "Snapper" mower and further added IIwe \'.Jould like
to have the City purchase one for the Recreation Area, or allow
the Association to use the City's Gravely tractor and we would
provide our own manpower and maintenancell.
Councilman Ledbetter duly moved to assign the Gravely tractor to
the Recreation Association, said motion being seconded by Councilman
Fugate. Upon roll call vote, said motion CARRIED.
An agreement was reached between the Council and members of the
Association present that the tractor would be kept at the City Barn
and the Association member checking out the tractor would see the
Police patrolman on duty, who in turn would get the key and open
the Barn gates, should the tractor be needed over the weekends or
after City Hall hours.
Councilman Dietz expressed his thanks to Chief C. W. Heath for
the Chief's job well done in clearing the heavy traffic after the
fireworks display on Saturday, July 4, 1970.
Mr. Paul Walls stated that Mrs. Leona Carden, Librarian, and Mrs.
Muriel Ihnken, Assistant Librarian, had requested an additional
week's vacation WITHOUT pay. He further stated that the Library
Board had considered and approved their r-equest, provided the
Board received theCity Council's approval.
The City Council gave their approval provided each of the ladies
would be on vacation at different times and without pay.
Councilman Ledbetter thanked the Fire Chief and the Volunteer
Fire Department for their prompt action taken at the recent mobile
home fire in his park.

MISCELLANEOUS, CONT.
Councilman Lodico stated that the work on the sea wall at the
Park and Pier had been completed and that he and the Council was
very pleased with the results.
There being no further business, a motion was made, seconded and
CARRIED for adjournment of the meeting.
