THE CITY COUNCIL OF THE CITY OF EDGEWATER
REGULAR MEETING
HELD JUNE 15, 1970
The Regular Meeting of the City Council of the City of Edgewater,
Florida, was called to order by Mayor William H. Cairnie at 7:30
P.M., Monday, June 15, 1970.

APPROVAL OF MINUTES
A motion for approval of the minutes of the Regular Meeting of
June 1, 1970, was duly made by Councilman Lodico and seconded by
Councilman Ledbetter. Upon roll call vote, said motion CARRIED.
Mayor Cairnie r~quested a diversion in the Dsua1 order of business,
due to the fact that Mr. Roberts, TM Communications r.epresentative
had a later appointment after his business with the Council was
completed. Mayor Cairnie requested the City Attorney read the
Ordinance covering the TV cable franchise listed on the agenda.
ORDINANCES
ORDINANCE NO. 663: AN ORDINANCE GRANTING THE TM
COMMUNICATIONS COMPANY OF FLORIDA A NON-EXCLUSIVE FRANCHISE TO
ERECT, MAINTAIN AND OPERATE IN, UNDER, OVER, ALONG, ACROSS AND UPON
THE STREETS, LANES, AVENUES, SIDEWALKS, ALLEYS, BRIDGES, AND
HIGHWAYS AND OTHER PUBLIC PLACES IN THE CITY OF EDGEWATER, FLORIDA,
AND SUBSEQUENT ADDITIONS THERETO, FOR THE PURPOSE OF TRANSMISSION
AND DISTRIBUTION BY WIRE OR CABLE OF TELEVISION TO THE INHABITANTS
OF SAID CITY; PROVIDING AN INITIAL TERM OF FIFTEEN YEARS FOR SAID
FRANCHISE; AND PROVIDING AND OPTION TO RENEW SAID FRANCHISE FOR
A LIKE PERIOD OF TIME; AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The Ordinance stated above was read by City Attorney Charles A. Hall.
A motion for approval of said Ordinance was duly made by Councilman
Dietz and seconded by Councilman Lodico. Upon roll call vote,
said motion CARRIED.
A motion for the waivure of the second reading of said Ordinance
was duly made by Councilman Dietz and seconded by Councilman
Ledbetter. Upon roll call vote, said motion CARRIED.

duly made by Councilman Lodico and seconded by Councilman Dietz.
Upon roll call vote, said motion CARRIED.

The Officers Reports stated above were read by City Clerk, Elsie
L. Ward.
COMMUNICATIONS
A letter from Mr. Cyril Marchinton directed to the City Council
was read by City Clerk, Elsie L. Ward.
Mr. Marchinton, owner of the property on which the Floreco Crab
Company is sited, requested an additional 60-day extension time
for clearing the property and razing all buildings on said property.
He further stated that efforts had been made to clear the property,
but that the original 60-day clearing time had expired and he
wished to have additional time in order to completely clear the
property of all debris, buildings and other hazardous conditions.

COMMUNICATIONS, CONT.
Councilman Ledbetter duly moved to grant Mr. Marchinton a 60-day
extension, said motion being seconded by Councilman Dietz. Upon
roll call vote, said motion CARRIED.
The City Attorney was instructed to advise Mr. Marchinton, by letter,
of the approval of his request and remind him that ALL buildings
were to be removed by the expiration of this time period.
RESOLUTIONS
RESOLUTION NO. 341: A RESOLUTION ACCEPTING THE RESIGNATION
OF ELIZABETH CROUSER AS DEPUTY CLERK FOR THE CITY OF EDGEWATER,
VOLUSIA COUNTY, FLORIDA, AND TERMINATING HER EMPLOYMENT EFFECTIVE
JUNE 15, 1970.
The Resolution stated above was read by City Attorney Charles Hall.
A motion was duly made by Councilman Dietz and seconded by Council-
man Lodico for approval of said Resolution. Upon roll call vote,
said motion CARRIED.
RESOLUTION NO. 342: A RESOLUTION APPOINTING MEMBERS
TO THE ZONING BOARD OF THE CITY OF EDGEWATER, FLORIDA; PROVIDING
FOR THEIR TENURE; PROVIDING THAT NO COMPENSATION BE PAID; AND
FURTHER PROVIDING AN EFFECTIVE DATE THEREFOR.
City Attorney Charles A. Hall read the above stated Resolution.
Councilman Dietz duly moved to approve said Resolution, said motion
being seconded by Councilman Ledbetter. Upon roll call vote,s
said motion CARRIED.
OLD BUSINESS
Councilman Lodico reported that he had contacted Florida Power
and Light in regards to the street light request of Mrs. Leslie
Haughwout, North Riverside Drive, and that Florida Power and Light
had agreed to send a representative to inspect the situation.
However, Councilman Lodico further stated that fue representative
had not been able to get here, but that Councilman Lodico had
inspected the light and found it to be across from the Haughwout
home and directly on the proper line.
NEW BUSINESS
The following Proclamation was read by City Attorney Charles A. Ha~l:
liThe City Council and each member thereof has studied the proposed
Vo1usia County Charter to be voted upon by the people and have come
to the conclusion that the adoption of said Charter would not be
in the best interest of the City of Edgewater or its citizens and
therefore oppose said Vo1usia County Charter as individuals comprising
the City Council of the City of Edgewater, Florida. This Proclamation
does not purport to express the views of the citizens of the City
of Edgewater but only members of the City Council thereof. II
Mayor Cairnie cited two reasons for opposition to the Charter as
follows: 1. liThe Road and Bridge Tax will be eliminated after
October, 1970, if the Charter is approved. We will not receive
any revenue from this tax for paving in our city, but will have
to do our own paving, which might cause an increase in our mi11age."
2. lilt takes our County Commission seat away from here and we
will have to go to Daytona Beach for any help or services we
might need.1I

NEW BUSINESS, CONT.
A motion for approval of said Proclamation was duly made by
Councilman Dietz and seconded by Councilman Ledbetter. Upon roll
ca~l vote, said motion CARRIED.
A motion was duly made by Councilman Ledbetter to advertise for
bids on the air conditioning and heating of the Community Center
building, bids to be returned by July 6, 1970, at 4 P.M. Said
motion was seconded by Councilman Lodico and upon roll call vote,
said motion CARRIED.
Councilman Ledbetter duly moved to advertise for bids on the
insulating of the Community Center building, bids to be returned
by July 6, 1970, at 4 P.M. Said motion was seconded by Councilman
Dietz and upon roll call vote, said motion CARRIED.
MISCELLANEOUS
After the suggestion by Mayor Cairnie, Councilman Ledbetter duly
moved to hold all Council Meetings during the summer months in the
Mayor's office at City Hall. Said motion was seconded by Councilman
Dietz and upon roll call vote, said motion CARRIED.
Mayor Cairnie explained in his suggestion that attendance was
relatively small during the summer months and that the air condi-
tioning system at City Hall was more adequate.
There being no further business, Councilman Dietz duly moved for
the adjournment of the meeting, said motion being seconded by
Councilman Ledbetter and CARRIED.
