REGULAR MEETING
APRIL 20, 1970
Mayor William H. Cairnie called to order the Regular Meeting of
the City Council of the City of Edgewater at 7:29 P.M., Monday,
April 20, 1970.

APPROVAL OF MINUTES
A motion to approve the minutes of the Regular Meeting of April 6,
1970, was duly made by Councilman Ledbetter and seconded by
Councilman Fugate. Upon roll call vote, said motion CARRIED.

A motion was duly made by Councilman Lodico and seconded by Coun-
cilman Ledbetter to approve said bills and accounts for payment.
Upon roll call vote,said motion CARRIED.
OFFICERS REPORTS
Certification of Posting
COMMUNICATIONS
A letter from Harold and Vera McLane requesting permission to
place~a trailer on one of their lots in Highland Shores west of
the railroad was read by City Clerk Elsie L. Ward.
Councilman Ledbetter duly moved to turn the request over to the
Zoning Board, said motion being seconded by Councilman Fugate.
Upon roll call vote, said motion CARRIED.
City Clerk Elsie L. Ward read a letter from Mr. W. J. Check, who
asked whether something could be done to eliminate some of the noise
made by the trains in our area during the early hours of each
morning.
Councilman Ledbetter, due to the fact that municipalities have no
control over the railways, duly moved to turn the matter over to
the City Attorney in order for the City Attorney to advise the
Florida East Coast Railway, by letter, that a complaint had been
made. Said motion was seconded by Councilman Lodico and upon
roll call vote, said motion CARRIED.
A letter from Rose S. Matthews, Secretary of the Edgewater Public
Library Board, was read by City Clerk Elsie L. Ward.
The letter stated that the Library Board had approved sending the
Librarian, Mrs. Carden, to the Florida Library Association meeting
in Ft. Lauderdale, Florida, on May 13 through 16, 1970. Estimated
expense of $60 to cover the three-day meeting would be allocated
from the Library Budget; however, the Board respectfully requested
the Council authorize this allocation of funds.
Councilman Fugate duly moved to grant the request of the Library
Board, said motion being seconded by Councilman Lodico. Upon roll
call vote, said motion CARRIED.
ORDINANCES
ORDINANCE NO. 662: AN ORDINANCE ACCEPTING THE BID
OF ESCOE MARINE CONSTRUCTION OF HOLLY HILL, FLORIDA, TO CONSTRUCT
A SEAWALL AS PER SPECIFICATIONS ALONG THE EDGEWATER PARK ACROSS
FROM CITY HALL FOR THE SUM OF FOUR THOUSAND FIVE HUNDRED DOLLARS,
MAKING SAID ACCEPTANCE OF BID CONDITIONAL UPON SAID ESCOE MARINE
CONSTRUCTION ENTERING INTO AN ACCEPTABLE CONTRACT WITH THE CITY
FOR THE CONSTRUCTION OF SAID SEAWALL, REJECTING ALL OTHER BIDS
AND SETTING FORTH AN EFFECTIVE DATE THEREFOR.
The Ordinance stated above was read by City Attorney Charles Hall.
A motion was duly made by Councilman Ledbetter to adopt said
Ordinance, said motion being seconded by Councilman Fugate. Upon
roll call vote, said motion CARRIED.
Councilman Ledbetter duly moved to waive the second reading of
said Ordinance, said motion being seconded by Councilman Fugate.
Upon roll call vote, said motion CARRIED.

ORDINANCES, CONT.
Mayor William H. Cairnie explained that although the bid of Escoe
Marine was not the lowest bid received, the Council had decided
to accept the Escoe bid of $4,500 on the basis of the 6" wall which
they \'Iould construct rather than a 5" wall. Mayor Cairnie further
stated that several of the Councilmen had personally inspected
some of the work performed by Escoe Marine arid felt that for the
additional sum of approximately $250.00, the City would benefit
from the quality of their work.
Councilman Ledbetter added that the 6" wall with a 12" x 14" cap,
as quoted by Escoe Marine, would better meet the City of Edgewater1s
needs rather than a 5" wall with a 12" x 12" cap.
RESOLUTIONS
RESOLUTION NO. 340: A RESOLUTION HIRING GEORGE R.
KATEZ AS PATROLMAN FOR THE CITY OF EDGEWATER, FLORIDA, SETTING
FORTH HIS TENURE, PROVIDING FOR HIS COMPENSATION, AND PROVIDING
AN EFFECTIVE DATE FOR SAID EMPLOYMENT.
The Resolution stated above was read by City Attorney Charles Hall.
A motion for adoption of said Resolution was duly made by Councilman
Ledbetter and seconded by Councilman Lodico. Upon roll call vote,
said motion CARRIED.
Councilman Ledbetter stated that Mr. Katez is a local resident
and expressed his wish to have one of the newspapers get a story
from Mr. Katez on his background and experience in law enforcement.
Councilman Ledbetter added he felt this story would be a great
service to the City of Edgewater in that Mr. Katez was a local
resident.
RESOLUTION NO. 341: A RESOLUTION EXPRESSING THE
OPPOSITION OF THE CITY COUNCIL OF EDGEWATER, FLORIDA, TO SENATE
BILL 278 WHICH WOULD PROHIBIT MUNICIPALLY OWNED WATER AND SEWER
UTILITIES FROM CHARGING CONSUMERS OUTSIDE OF THE CITY LIMITS A
RATE OF MORE THAN FIFTY PERCENT IN EXCESS OF THE RATE CHARGED
WITHIN THE CITY, AUTHORIZING AND DIRECTING THE CITY CLERK TO
SEND A COpy OF THIS RESOLUTION TO EACH MEMBER OF THE VOLUSIA
COUNTY LEGISLATIVE DELEGATION AND SETTING FORTH AN EFFECTIVE
DATE THEREFOR.
The Resolution stated above was read by City Attorney Charles Hall.
Prior to action on said Resolution, Councilman Ledbetter asked of
City Attorney Hall which document would take precedence should
the proposed Senate Bill 278 be enacted; the Senate Bill and its
limitations on municipalities' rate charges (50% of the rate charged
within the city) or the City of Edgewater1s Ordinance No. 400,
which allows the City to charge 100% of the rate charged within
the City?
City Attorney Hall replied that he was of the opinion that City
Ordinance No. 400 would take precedence.
A motion to adopt said Resolution was duly made by Councilman
Fugate and seconded by Councilman Lodico. Upon roll call vote,
said motion CARRIED.
OLD BUSINESS
The American Truss Company1s request for a trailer, tabled at the
Councilr;meeting of March 2, 1970, was brought forth for discussion.

OLD BUSINESS, CONT.
Councilman Fugate duly moved to deny the request, said motion being
seconded by Councilman Lodico. Reasons for denial being that the
Truss Company had adequate facilities within their confines to
house a night watchman and that the City's Ordinance covering
trailers prohibited such an arrangement. The Council felt that
exceptions to this Ordinance would not be wise. Upon roll call
vote, said motion CARRIED.
Councilman Lodico suggested that American Truss Company be contacted
by letter and be apprised fully for the denial of their request.
NEW BUSINESS - NONE
MISCELLANEOUS
Mr. Paul Walls reported to the Council the names of the newly
elected officers of the Recreation Association as follows: Don
Gillespie, President; Bob Wolfe, Vice-President; Sue Blackwell,
Treasurer; Carole Moses, Recording Secretary; Nora Gillespie,
Corresponding Secretary and Paul Walls, Advisor.
Mr. Walls also reported that the Volunteer Fire Department would
be sponsoring their annual Fire College beginning Monday, April
27 through May 1, from 7 p.m. to lQ p.m. He stated that a
representative from the Florida State Fire College would be in
charge of the lectures and training sessions.
Councilman Fugate reported that the three new radios for the
Police cars had been installed; radios used previously in these
vehicles had been installed in the fire trucks and street and
water department trucks. Councilman Fugate stated the Edgewater
Police Department is now connected with the County and New Smyrna
Beach frequency, making communiaations between these departments
considerably more efficient and beneficial to the City.
Mr. James Budd, 1709 S. Ridgewood, reported to the Council that
the unsightly makeshift shed erected adjacent to his property
had not been removed nor had any of the junk around the building
been removed.
Councilman Ledbetter moved to give the property owners a written
notice of 72 hours time to clean the property; and if they failed
to comply, authorize the Chief of Police to issue said property
owners a citation to appear in court to answer to the charge of
public nuisance. Said motion was seconded by Councilman Fugate
and upon roll call vote, said motion CARRIED.
There being no further business, Councilman Fugate duly moved to
adjourn, said motion being seconded by Councilman Ledbetter and
CARRIED.
