The Regular Meeting of the City Council of the City of Edgewater,
Florida, was called to order by Mayor William H. Ciarnie at 7:30
P.M., Monday, March 2, 1970.

APPROVAL OF MINUTES
A motion to approve the minutes of the Regular Meeting held
February 2, 1970, was duly made by Councilman Lodico and seconded
by Councilman Dietz. Upon roll call vote, said motion CARRIED.

A motion for approval of stated bills for payment was duly made by
Councilman Lodico and seconded by Councilman Dietz.
Prior to roll call vote, Councilman Ledbetter raised the question
as to whether any bills had been paid prior to the meeting now
in session. Mayor Cairnie and City Clerk Elsie L. Ward stated
that some of the utility bills, payable monthly, had been paid
due to the fact that no second council meeting was held in February
because several council members were ill.
There being no further questions, upon roll call vote, said motion
for approval of bills for payment CARRIED; Councilman Ledbetter
ABSTAINED.

The Officers Reports stated above were read by City Clerk, Elsie L. Ward.
COMMUNICATIONS
City Clerk Elsie L. Ward read a letter from Mr. M. F. Charles, in
which Mr. Charles requested a street light to be placed at the end
of Sutton Place, since this street had no lighting.

Councilman Ledbetter duly moved to grant the erection of this light,
stating that this area was very dark and numerous requests had been
made for al1ight. Said motion was seconded by Councilman Fugate
and upon roll call vote, said motion CARRIED.

COMMUNICATIONS, CONT.
A letter from Paul F. Walls, President of the Edgewater Recreation
Association, was read by City Clerk Elsie L. Ward.
The letter stated in part the intentions of Boy Scout Troop #406
to hold a camporee for the Halifax District, which would involve
from 150 to 200 boys camping at the Recreation Center over the
weekend. The letter further stated there would be plenty of adult
supervision and each boy had his own insurance, but that the
Recreation Association felt the City Council should be consulted
before final permission was given.
Councilman Ledbetter duly moved to grant permission to the Boy
Scouts for the camporee, said motion being seconded by Councilman
Lodico. Upon roll call vote, said motion CARRIED.
Three letters directed to the Edgewater Police Department were read
by City Clerk Elsie L. Ward.
Letters from Mr. & Mrs. James A. Buchanan, Sea Horse Trailer Park
and Mr. E. R. Hilson, Plant Superintendent of Maule Industries,
expressed appreciation to the Police Deparment and particularly
to Officer E. A. Martin for the courteous and efficient manner in
which Officer Martin recovered stolen property of those involved.
Miss Joyce Parkinson of Las Vegas, Nevada, commended Officer W. K.
Bucher for his display of courteousy and efficiency during the
investigation on January 10, 1970, of a traffic accident in
Edgewater which involved Miss Parkinson and her parents.
As spokesman for the Council, Mayor Cairnie commended the Police
Department and its officers and requested a copy of these letters
be given to Officers Martin and Bucher for their personal files.
A letter from Mr. Louis Se1engut, President of the American Truss
Company, was read by City Clerk Elsie L. Ward.
Mr. Se1engut requested permission to locate and maintain a trailer
within the confines of the company property, to be utilized during
the night hours for the express purpose of protection of the property.
The trailer would be properly connected and would adhere to the
usual City Ordinances and inspections.
Mr. Se1engut further stated that despite the efforts of the Police
Department to protect and surveil the area, the American Truss
Company had been victimized by vandalism and had suffered considerable
losses for the past three years; continuous losses due to vandalism
and theft might well affect the ability to continue their business
at their present location.
A motion to table the request of the American Truss Company for
further investigation was duly made by Councilman Fugate and seconded
by Councilman Dietz. Upon roll call vote, said motion CARRIED.
ORDINANCES
ORDINANCE NO. 650: AN ORDINANCE REPEALING SECTION 3
(C) (6) OF ORDINANCE NO. 538 OF THE CITY OF EDGEWATER, FLORIDA,
AND ABOLISHING SAID SECTION ALLOWING DISCONTINUANCE OF SERVICE
CHARGE FOR SEWAGE WHEN PROPERTY IS VACATED, AND SETTING FORTH AN
EFFECTIVE DATE THEREFOR.
The Ordinance stated above was read in full/by City Attorney
Charles A. Hall.
A motion to adopt said Ordinance was duly made by Councilman Dietz
and seconded by Councilman Ledbetter. Upon roll call vote, said
motion CARRIED.

ORDINANCE NO. 651: AN ORDINANCE PROMULGATING AND SETTING
FORTH A VACATION SCHEDULE AND POLICY FOR THE POLICE DEPARTMENT OF
THE CITY OF EDGEWATER, FLORIDA; SETTING FORTH OFFICIAL HOLIDAYS FOR
SAID POLICE DEPARTMENT; AND PROVIDING AN EFFECTIVE DATE THEREFOR.
City Attorney Charles A. Hall read the Ordinance stated above in
its entirety.
Councilman Fugate duly moved for adoption of said Ordinance, second
of said motion being made by Councilman Dietz. Upon roll call vote,
said motion CARRIED.
A motion for waivure of the second reading of said Ordinance was
duly made by Councilman Ledbetter and seconded by Councilman Lodico
and uponrro11 call vote, said motion CARRIED.
ORDINANCE NO. 652: AN ORDINANCE SETTING FORTH A
VACATION POLICY AND SCHEDULE FOR FULL TIME EMPLOYEES OF THE CITY
OF EDGEWATER, VOLUSIA COUNTY, FLORIDA; EXEMPTING MEMBERS OF THE
EDGEWATER POLICE DEPARTMENT FROM THE PROVISIONS THEREOF; AND
SETTING AN EFFECTIVE DATE THEREFOR.
The Ordinance stated above was read in full by City Attorney
Charles A. Hall.
A motion for adoption of said Ordinance was duly made by Councilman
Lodico and seconded by Councilman Ledbetter. Upon roll call vote,
said motion CARRIED.
A motion for the waivure of the second reading of said Ordinance was
duly made by Councilman Dietz and seconded by Councilman Ledbetter.
Upon roll call vote, said motion CARRIED.
ORDINANCE NO. 653: AN ORDINANCE RELATING TO TRAILER
OR MOBILE HOME PARKS; ADOPTING MINIMAL REQUIREMENTS FOR TRAILER
PARKS OR MOBILE HOME PARKS WITHIN THE CITY OF EDGEWATER, FLORIDA;
PROVIDING FOR APPLICATIONS FOR LICENSES TO OPERATE TRAILER PARKS
OR MOBILE HOME PARKS; SETTING FORTH A LICENSE FEE SCHEDULE; PROVIDING
PENALTIES FOR VIOLATIONS OF THIS ORDINANCE; AND PROVIDING AN
EFFECTIVE DATE THEREFOR:
City Attorney Charles A. Hall read in full the Ordinance stated above.
A motion for adoption of said Ordinance was duly made by Councilman
Fugate and seconded by Councilman Ledbetter. Upon roll call vote,
said motion CARRIED.
A motion for waivure of the second reading of said Ordinance was

ORDINANCE NO. 654: AN ORDINANCE TERMINATING MAYOR WILLIAM
H. CAIRNIE AS MUNICIPAL JUDGE AND RELIEVING HIM OF HIS DUTIES AS
SAID MUNICIPAL JUDGE; AND PROVIDING AN EFFECTIVE DATE THEREFOR.
City Attorney Charles Hall read in full the above stated Ordinance.
A motion to adopt said Ordinance was duly made by Councilman Fugate
and seconded by Councilman Dietz. Upon roll call vote, said motion
CARRIED, with Mayor Cairnie ABSTAINING.

ORDINANCE NO. 655: AN ORDINANCE HIRING AND APPOINTING
DAVID L. SHANNON, ATTORNEY AT LAW, AS MUNICIPAL JUDGE OF THE CITY
OF EDGEWATER, FLORIDA; SETTING FORTH HIS TENURE AND HIS COMPENSATION;
AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The above stated Ordinance was read in full by City Attorney Charles
A. Hall.
A motion for adoption of said Ordinance was duly made by Councilman
Dietz and seconded by Councilman Ledbetter. Upon roll call vote,

RESOLUTIONS
RESOLUTION NO. 335: A RESOLUTION REQUESTING AND URGING
THE DEPARTMENT OF TRANSPORTATION OF THE STATE OF FLORIDA, FORMERLY
STATE ROAD DEPARTMENT, TO TAKE ACTION TO ALLEVIATE THE EXISTING
TRAFFIC CONGESTION AND TRAFFIC HAZARDS ON STATE ROAD 5 (U.S. 1)
IN FRONT OF THE EDGEWATER SHOPPING CENTER IN THE CITY OF EDGEWATER,
FLORIDA; AUTHORIZING THE CITY CLERK TO SEND A COpy OF THIS RESOLUTION
TO THE DEPARTMENT Of TRANSPORTATION AND TO THE VOLUSIA COUNTY
REPRESENTATIVES OF THE DEPARTMENT OF TRANSPORTATION AND TO THE
VOLUSIA COUNTY COMMISSION, AND SETTING FORTH AN EFFECTIVE DATE.
The Resolution stated above was read by City Attorney Charles Hall.
A motion for adoption of said Resolution was duly made by Councilman
Lodico and seconded by Councilman Dietz. Upon roll call vote,
said motion CARRIED.
OLD BUSINESS
A Certification of bids received on a new back hoe was read by
City Clerk, Elsie L. Ward, said Certification stating receipt of
two (2) bids only.
The sealed bids were then opened by the City Clerk and read aloud
as follows:

Lakeland, Florida, had advised they were unable to bid per
specifications at this time.
Councilman Dietz moved to table the bid from C & C Tractor, Inc.
for further investigation. Said motion was seconded by Councilman
Ledbetter and upon roll call vote, said motion CARRIED.
