THE CITY COUNCIL OF THE CITY OF EDGEWATER
REGULAR MEETING HELD
JANUARY 19, 1970

The Regular Meeting of the City Council of the City of Edgewater,
Florida, was called to order at 7:55 P.M. by Mayor William H.
Cairnie; the meeting being delayed some 25 minutes due to the
Public Hearing held prior to the Council meeting.

Prior to approval of the minutes of the Regular Meeting of January
5, 1970, Councilman Fugate brought to the attention of the
Councilmen the paragraph on hiring of the dispatchers; in which
the statement was made that the dispatchers would be interviewed
by the Chief and would be approved by the WHOLE Council.
Due to some confusion surrounding the word Iwho1e", Mayor Cairnie
point~d out that any person employed by the City could be approved
by a 3-2 vote. There would be no exception to the hiring of
dispatchers and that the applicants would not have to be approved
by the Council as a whole per se.
Upon clearing of this matter, Councilman Lodico duly moved to
approve the minutes of the January 5th meeting, said motion was
seconded by Councilman Dietz. Upon roll call vote, motion CARRIED.

A motion to accept the above stated bills for payment, with the
exception of the bill from the City Attorney, Charles A. Hall,
which would be held for payment until review and acceptance by
the Council, was duly made by Councilman Lodico. Said motion was
seconded by Councilman Fugate and upon roll call vote, motion CARRIED.

Certification of Posting
Police Report for December
The aforementioned reports were read by City Clerk Elsie L. Ward.
COMMUNICATIONS
A letter from Angelo J. and Antoinette M. Caruso was read by
City Clerk, Elsie L. Ward.
The Carusos were requesting a street light for the corner of 22nd
street and Pine Tree Drive in Florida Shores; stating that the
area was extremely dark and isolated and that their home had been
vandalized on Christmas Eve, 1969.
Councilman Ledbetter moved to turn the matter over to Councilman
Dietz for his review and recommendation since that area was in
Zone 4.
Said motion was seconded by Councilman Fugate and upon roll call
vote, said motion CARRIED.
A letter from TM Communications Company requesting permission to
conduct a pre-market survey in the City of Edgewater was read
by the City Clerk.
The letter stressed the point that this survey would be strictly
to gather data on the marketability of cable television in this
area and would not be for soliciting customers for cable television.
Councilman Dietz moved to grant the TM Company permission to conduct
the survey, said motion being seconded by Councilman Fugate.
Upon roll call vote, said motion CARRIED.

COMMUNICATIONS, CONT.
A formal letter from Turney and Dupree, Certified Public Accountants,
was read by City Clerk, Elsie L. Ward.
The content of the letter was a statement by the Accountants that
their recent examination of the City records had been made in
accordance with generally accepted auditing standards and procedures
and that, in their opinion, the balance sheets and related statements
submitted by them to the City presented fairly the financial position
of the City of Edgewater, Florida, as of October 31, 1969.
ORDINANCES
ORDINANCE NO. 647: AN ORDINANCE ACCEPTING AND
CONFIRMING A STREET WITHIN THE CITY OF EDGEWATER, FLORIDA, DEDICATED
TO PUBLIC USE BY THE OWNERS OF SAID LAND, STANLEY TIZZARD AND MARION
E. TIZZARD, HIS WIFE, AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The above stated Ordinance was read in full by City Attorney,
Charles A. Hall.
A motion to adopt this Ordinance was duly made by Councilman Lodico
and seconded by Councilman Fugate. Upon roll call vote, said
motion CARRIED.
A motion for waivure of the second reading of said Ordinance was
duly made by Councilman Dietz and seconded by Councilman Fugate.
Upon roll call vote, said motion CARRIED.
ORDINANCE NO. 648: AN ORDINANCE RELATIVE TO THE CONTROL
OF DOGS IN THE CITY OF EDGEWATER, FLORIDA; PROHIBITING OWNERS OR
KEEPERS OF DOGS FROM ALLOWING THEM TO DISRUPT THE PUBLIC PEACE
OR BECOME A NUISANCE; SETTING FORTH DEFINITIONS AS TO WHAT DISRUPTS
OR DISTURBS THE PUBLIC PEACE OR IS A NUISANCE; PROVIDING FOR A
METHOD OF NOTICE TO OWNERS OR KEEPERS OF DOGS ALLEGED TO DISRUPT
THE PUBLIC PEACE OR BE A NUISANCE; DECLARING IT UNLAWFUL FOR OWNERS
OR KEEPERS OF DOGS TO FAIL OR REFUSE TO ABATE THE NUISANCE AFTER
NOTIFICATION TO DO SO; PROVIDING A PENALTY FOR OWNERS OR KEEPERS
OF DOGS FOUND TO BE A NUISANCE IN FACT WHO FAIL OR NEGLECT OR
REFUSE TO ABATE SAID NUISANCE; AND SETTING AN EFFECTIVE DATE THEREFOR.
The Ordinance stated above was read in full by City Attorney Charles
A. Hall.
A motion to adopt said Ordinance was duly made by Councilman Dietz
and seconded by Councilman Ledbetter. Upon roll call vote, said
motion CARRIED.
Councilman Dietz duly moved to waive the second reading of said
Ordinance, said motion being seconded by Councilman Ledbetter,
and upon roll call vote, said motion CARRIED.
ORDINANCE NO. 649: AN ORDINANCE DESIGNATING AND
APPOINTING A DEPUTY CITY CLERK FOR THE CITY OF EDGEWATER, VOLUSIA
COUNTY, FLORIDA, AND SETTING FORTH COMPENSATION FOR SUCH OFFICE.
The above stated Ordinance was read in full by City Attorney
Charles A. Hall.
A motion for adoption of this Ordinance was duly made by Councilman
Dietz and seconded by Councilman Fugate. Upon roll call vote, said
motion CARRIED.
Councilman Dietz duly moved for waivure of the second reading of
said Ordinance, said motion being seconded by Councilman Fugate
and upon roll call vote, said motion CARRIED.

RESOLUTIONS
RESOLUTION NO. 326: A RESOLUTION NAMING AND APPOINTING
COUNCILMAN DAVID LEDBETTER AS COORDINATOR OF THE PARK AND PIER
AND RECREATION DEPARTMENTS OF THE CITY OF EDGEWATER AND SETTING
AN EFFECTIVE DATE THEREFOR.
The Resolution stated above was read by City Attorney Charles A. Hall.
A motion to adopt this Resolution was duly made by Councilman Lodico
and seconded by Councilman Dietz. Upon roll call vote, said motion
CARRIED, with Councilman Ledbetter ABSTAINING.
RESOLUTION NO. 327: A RESOLUTION ACCEPTING THE
RESIGNATION OF DAVID L. WIGGINS AS A MEMBER OF THE EDGEWATER ZONING
BOARD AND PROVIDING AN EFFECTIVE DATE THEREFOR.
The Resolution stated above was read by City Attorney Charles A. Hall.
Councilman Lodico duly moved to adopt this Resolution, said motion
being seconded by Councilman Ledbetter and upon roll call vote,
said motion CARRIED. Mayor Cairnie and Councilman Dietz voted NAY.
RESOLUTION NO. 328: A RESOLUTION ACCEPTING THE
RESIGNATION OF SUE BLACKWELL AS DEPUTY CITY CLERK FOR THE CITY OF
EDGEWATER, VOLUSIA COUNTY, FLORIDA AND TERMINATING HER EMPLOYMENT
EFFECTIVE JANUARY 7, 1970.
The Resolution stated above was read by City Attorney Charles A. Hall.
A motion for adoption of said Resolution was duly made by Councilman
Ledbetter and seconded by Councilman Lodico. Upon roll call vote,
said motion CARRIED.
RESOLUTION NO. 329: A RESOLUTION APPOINTING MEMBERS TO
THE CITY PLANNING BOARD, PROVIDING FOR THEIR TENURE AND PROVIDING
AN EFFECTIVE DATE THEREFOR.
The Resolution stated above was read by City Attorney Charles A. Hall.
A motion to adopt said Resolution was duly made by Councilman Lodico
and seconded by Councilman Ledbetter. Upon roll call vote, said
motion CARRIED.
OLD BUSINESS
A question on the paving of Willow Road was raised to which Mayor
William H. Cairnie stated that the road could not be paved the
last few months due to the inclimate weather; however, come the
spring months, Willow Road was first on the agenda for paving.
NEW BUSINESS
Certifications of bids received for a new Police car and for new
radios for the Police cars was read by City Clerk, Elsie L. Ward.
At this point, the sealed bids were opened and read aloud by the
City Clerk as follows:
New Smyrna Motors - 1970 Plymouth 4-door sedan - $2,299.00
Watkins Ford, Inc.- 1970 Ford 4-door sedan - $2,375.00
Councilman Dietz duly moved to table these bids until they could
be studied by the Council. Said motion was seconded by Councilman
Ledbetter and upon roll call vote, said motion CARRIED.

NEW BUSINESS, CONT.
Sealed bids received for new radios for the Police cars were
opened and read by the City Clerk as follows:

Councilman Ledbetter duly moved to table these bids also for further
study by the City Council. Said motion was seconded by Councilman
Dietz and upon roll call vote, said motion CARRIED.
MISCELLANEOUS
Councilman Ledbetter duly moved to amend the vacation and sick
leave Ordinances, said motion being seconded by Councilman Lodico.
Upon roll call vote, said motion CARRIED.
Councilman Dietz duly moved that there be no further permits issued
for trailer parks in the City of Edgewater until the Council has
an opportunity to draw up a new Ordinance, eliminating some confusion
in the present Ordinance; and further, that the Council meet at
9:30 A.M. Wednesday, January 21, 1970, for this purpose.
Said motion was seconded by Councilman Lodico and upon roll call
vote, said motion CARRIED.
Due to the tabling of the bids received on Police radios and subse-
quent delays in re-enacting the local dispatching system, Councilman
Lodico duly moved to change the present set of crystals in the
Police radios in order to start the dispatching system immediately.
Said motion was seconded by Councilman Ledbetter and upon roll call
vote, said motion CARRIED, with Mayor Cairnie and Councilman Dietz
voting NAY.
Councilman Ledbetter duly moved to appropriate $8500 of the surplus
monies to the Police -Department to hire the dispatchers. Said
motion was seconded by Councilman Fugate and upon roll call vote,
said motion CARRIED, with Councilman Dietz again voting NAY.
There being no further business, Councilman Ledbetter duly moved
for adjournment; said motion being seconded by Councilman Dietz
and CARRIED.
