Vernon Priest, requesting approval to remove a 41-inch historic Live Oak Tree from property located in the Elegant Manor Estates Subdivision. Darren Lear, Development Services Director, provided a staff report and recommendation. Councilman Powers asked if the applicant was present; Mr. Lear said he doesn't believe so. Councilman Powers explained while he doesn't like it, the applicant is ultimately following the law and is willing to mitigate by compensation that will go into the tree fund. Councilwoman Bennington agreed with what Councilman Powers said; stating she doesn't see how they could deny it. Mayor Depew stated that it seemed to unfortunately be poor planning. Heidi Embry (Jacobs), 120 Orange Avenue, asked about the types of trees to be replanted and the reasoning behind the removal of the tree. Jen Wessler, 2950 Ragis Road, expressed her displeasure over the approval of the removal. Jennifer Fox, 115 E. Turgot Avenue, asked if the Developer could make it a common area to preserve the tree. Councilman Powers asked if this was straight zoning; Mr. Irby informed him that this was a PUD. City of Edgewater Page 4 Printed on 411212023 City Council Meeting Minutes December 5, 2022 Councilwoman Bennington asked if they were being asked to approve something that they hadn't seen and that had been pre planned before they approved the preliminary plat; Mr. Irby explained that a plan was presented with so many lots on it. Councilman Powers asked if Council had no legal ground to reopen the PUD as it was already approved; he asked City Attorney Wolfe if denying the removal would open the City up for legal action. Mr. Wolfe said that he does think it would; the applicant does have the right to the permit if they are willing to make the payment of $6597. Councilman Powers said this was something they should look at altering in the Land Development Code; he would like to strengthen the concerning portion and look at the legal grounds to increase the cost of that mitigation. Jim Fox, 115 E. Turgot Avenue, expressed displeasure over the mitigation cost. Chuck Martin, 205 Cherrywood Lane, stated his opinion on the tree situation in Edgewater. Councilwoman Gillis asked if it was a City Ordinance or a State law regarding the requirements for removing trees; she felt as though anyone with enough money could just pay to have any tree removed. City Attorney Wolfe answered that this was a City Ordinance and City Manager Irby informed her that the applicant could mitigate by planting trees however on this particular lot, there isn't enough room for the number of trees required. Councilwoman Bennington said that if you look at it the way residents are, $6500 is a cheap bill to pay for another buildable lot; Councilman Powers interjected that they had to look at strengthening the process and the Code. Councilwoman Bennington agreed and stated that in this case, they almost have to approve it or they are opening themselves up for a lawsuit. Debbie Kerr Henry, 231 Hubbell Street, inquired over the reasoning behind the denial leading to a lawsuit. Councilman Power asked Darren Lear, Development Services Director, if there was a deadline for a decision; City Attorney Wolfe answered that there wasn't. Councilman Powers said that he's willing to take a gamble on denying the request. A motion was made by Councilman Powers, second by Councilwoman Bennington, to deny the issuance of a Tree Removal Permit for a 41-inch Live Oak tree located on Lot #27 of the Elegant Manor Subdivision based on the required payment per section 21-311. The MOTION was APPROVED by the following vote: Yes: 5 - Mayor DePew, Councilwoman Gillis, Councilwoman Bennington, Councilwoman Dolbow and Councilman Powers C. Dennis Pinkman, requesting approval to remove a 41-inch historic Live Oak Tree from property located at 2232 Juniper Drive. Darren Lear, Development Services Director, provided a staff report and recommendation. City of Edgewater Page 5 Printed on 411212023 City Council Meeting Minutes December 5, 2022 Heidi Jacobs, 120 Orange Avenue, asked about the types of trees required for the mitigation and f they would be required to be taken care of; she was assured that there is a two year guarantee. Councilwoman Dolbow asked if they were building a house on the lot; Mr. Irby confirmed. Councilwoman Gillis stated that according to the diagram, it doesn't seem like the historic tree has to be removed. Councilman Powers said that they could build a single family residence without removing the tree; the tree was where they wanted to park an RV. Mayor Depew closed the public comments. This item failed due to lack of Motion. 11. OFFICER REPORTS a. The consultant (MJC) was ultimately selected per their unique expertise and advanced specialized knowledge regarding law enforcement staffing analysis as well as a successful track record of executing similar work for other law enforcement agencies. No other consultant can administer the model as it is not published. Refer to the sole source justification provided. City of Edgewater Page 1 of 1 Printed on 4/18/2023 powered by LegistarTM Sole Source Justification Criteria for Edgewater Police Department Law Enforcement Staffing Analysis The Edgewater Police Department seeks to contract with Miller Justice Consulting, LLC (MJC) to execute a law enforcement staffing analysis. MJC is staffed by select experienced applied criminologists (housed in the University of North Florida & the University of Mississippi) who have designed a new law enforcement staffing analysis model. The model has been endorsed by and the keynote address topic for the Florida Sheriff's Association, the National Sheriff's Association, and the Federal Bureau of Investigation National Academy. Moreover, its development has been supported by two US COPS Office federal grant awards. While the original steps of the new law enforcement staffing analysis model was published in the scientific journal Policing: An International Journal (Vose et al, 2020), the model has evolved into a third version per lessons learned employing it for the Gallatin (TN) Police Department and the Marion County Sheriff's Office (FL) with specific improvements in terms of measurement refinements, additional variables included and measured, and improvement of the semi - structured questionnaire used to capture officer input and shiftwork time allocations. Though in development for near future publication, the now most current version of the model (used in the aforementioned Gallatin and Marion analyzes) that will inform Edgewater Police Department immediate and near future staffing needs has not yet been published and is thus not yet publicly available for other scientific consultants to administer. Therefore, a bidding process is impossible as no other consultants/vendor is capable of executing the new evidence -based law enforcement staffing model. The consultant (MJC) was ultimately selected per their unique expertise and advanced specialized knowledge regarding law enforcement staffing analysis as well as a successful track record of executing similar work for other law enforcement agencies. Review of google scholar, ResearchGate, and similar online scientific research engines confirm that no other entity has any experience utilizing the enhanced staffing model. Riverside Drive City of Edgewater Edgewater, FL 32132 EDGEWATER I" Legislation Text File #: AR-2023-190, Version: 1 COUNCIL AGENDA ITEM SUBJECT: Public Works Facility Design Additional Fees to Change Create Phased Construction Approach DEPARTMENT: Environmental Services SUMMARY: The City Council approved the Public Works Facility Design Services Project with Architects Schenkel & Shultz, Inc. (via solicitation RFQ 20-ES-010) at the January 28, 2021 meeting and authorized $350,000 for Planning and Schematic Design services. The result was a proposal from Schenkel & Schultz. Inc. for $1,590,000 to produce construction plans and specifications which implement the findings of the pre -design services. City Council authorized this amount via two separate agenda items: at the September 13, 2021 meeting using $1,000,000 in funds budgeted in Fiscal Year FY2021, and at the October 4, 2021 meeting using $590,000 in funds budgeted for FY2022 to complete the full design. During the time while the facility has been under design, construction pricing has seen dramatic inflation in costs. As such, it was determined infeasible to fund the entire construction of the Public Works Facility all at one time. Staff requested Schenkel & Shultz, Inc. to provide a set of construction -ready plans for a portion of the site to encompass the Fleet and Fuel area and a portion of the Administration building which includes shops, offices, and the necessary site "headworks" infrastructure. This change of scope request came at a time when the full site plans were nearly completed, thus significant additional work is needed to revise the construction documents to produce a portion of the facility which will function independent of the remaining items, which are anticipated to be funded at a later date. BUDGETED ITEM: ® Yes ❑ No ❑ Not Applicable BUDGET AMENDMENT REQUIRED: ® Yes ❑ No ❑ Not Applicable RECOMMENDED ACTION: Motion to approve the change order from Schenkel & Shultz, Inc. in the amount $129,675.00 for the Public Works Facility Design and related budget amendment. P.O. Box 100 409 Mango Tree Drive Edgewater, FL 32132 RE: City of Edgewater Public Works Facility SUBJECT: Professional Engineering & Architectural Design -Phase II ADDITIONAL SERVICE Fees Dear Ms. Dewees: SCHENKELSHULTZ is pleased to submit the fee proposal below concerning additional efforts required for Construction Phasing of the project as part of the design for your new Public Works Facility. Our proposal is based upon the revised scope of work identified throughout various meetings in our November 17, 2022 & January 18, 2023 meetings as well as various emails and phone conversations for Construction Phasing of the project as further discussed below. The A/E team has spent the past several months working on Phase II design for the project (which consists of design development submittal and construction documentation submittal through bidding and permitting). Currently the design team is approximately 90% complete with the construction documents stage. As part of this process, it was requested to conduct an estimate based on 90% construction documents. The estimate noted that due to the status of the unbalanced current construction bid market, the project's construction cost had risen from approximately a $30 million budget (initially established at the schematic design stage), to approximately a $42 million budget (at end of the 90% construction documents). Based on early on meetings, it is worth noting that the current design meets all Owner needs as discovered through the schematic design process (therefore, decreasing the programmed building square footage or site's footprint would compromise the Owner's needs). In the January 18, 2023 project phasing and scope of work meeting, it was mentioned that the design team is to revise the current 90% construction documents by incorporating project reductions as part of a Construction Phase 1 reflecting a revised Owner construction budget of approximately $18 million (inclusive of the Construction Management CM@R overhead fees), instead of the previous $30 million at schematic design or the current $42 million estimate per the 90% construction documents. To accomplish the decreased budget, the design team has been tasked with significantly reducing and revising the footprint of both the Site and Administration Building, as well as deferring construction for a portion of the current project as part of a final Construction Phase 2 in the future (the deferred construction includes several buildings & structures, and portions of the site affecting the entire design team). Please take into account that since currently the design team is approximately 90% complete with the construction documents, at this stage all building systems have been designed and have been in place for a while. In addition, the design team was in the process of adding some details and conducting minor tweaks as part of final project coordination amongst the various design disciplines. Therefore, it will be a major effort for the design team to revise / reduce the current project scope, and coordinate all required changes at this stage of the project. However, our team is at the City's service and is more than willing to assist in this effort. We understand that part of the Owner's request is for the design team to provide construction documents for the Construction Phase 1 reduced scope, as well as that the site permitting is to include both 200 E. Please refer to attached Exhibit 'A' Construction Phasing Site Plan and Exhibit'B' Construction Phasing Admin Bldg. Plan which are illustrations based on the January 18, 2023 meeting discussions per the requested project's Construction Phasing which are summarized below: • Construction Phase 1 (initial construction for the reduced scope project footprint which includes minor and considerable areas to be redesigned due to the $18 million Owner construction budget reduction) • Construction Phase 2 is limited to site / Civil permitting ONLY (remainder of Phase 2 documentation is excluded from the design team and would be part of a future project) • LEED Sustainability Certification will no longer be pursued as part of Construction Phase 1 because the Construction Phase 1 decreased scope is not large enough (reduced site & Administration Building). However, LEED Sustainability Certification will be part of the future Construction Phase 2 For the additional efforts required by the project's "construction phase 1" and revised scope of work associated with such, we propose a fixed fee of $129,675.00 (One Hundred -Twenty Nine Thousand and Six Hundred Seventy Five Dollars). This fee includes architectural, interior design, civil, landscape, irrigation, structural, specialty equipment & vehicle services, mechanical, electrical, plumbing, fire protection, security & communications. While this additional service request encompasses a revision to the previous design phase II in our contract with the City (for the design development and construction documentation submittals through bidding and permitting stages of the project), note that by adding construction phasing, the contract's phase III Construction Administration services fees per previously approved P.O. 010555 are only relative to the original project construction duration of approximately a 14 month schedule (which is adequate and applicable to the construction phase 1 but excludes Construction Administration services for the future Construction Phase 2). Clarifiratinnt- ■ Construction Administration fees for the final Construction Phase 2 in the future are not included. ■ Permitting and application fees are not included. ■ Project will be completed using Revit (BIM). ■ All reimbursable expenses are included in the lump sum fee. ■ Fees for any required testing above and beyond the scope listed in the above items, are not included. ■ Any significant changes or out of sequence changes in scope, client changes or unforeseen conditions may require additional services.
