The Regular Meeting of the City Council of the City of Edgewater, Florida, held March 16th, 1959 was called to order by Mayor George O. Sedgwick at 7:30 P.M. ROLL CALL Ma,yor George O. COMMUNICATIONS A communication was read from property owners adjoining First Street in Totem Park Subdivision asking that this street be officially vacated. "' OFFICERS REPORT The Clerk read the Clerk's Cash Statement and the Budget Report for the month of February, 1959. Also the Police Report and the Librarian's Report. RESOLUTIONS None ORDINANCES ORDINANCE No. 222 VACATING THAT PART OF FRANCES DRIVE ADJACENT TO AND WEST OF LOTS 5, 11, 18, 19 and 20, INDIAN RIVER ESTATES, PER Mll! IN MAP OOOK 8, PAGE 248, PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA, AND,-PROVIDING FOR THE REVERSION OF THE ABANDONED PORTION OF SAID FRANCES DRIVE AS AFORESAID TO THE ABUTTING PROPERTY OrlNERS. ~ v u \J The above Ordinance was read in full and motion duly made by Councilman Broga this Ordinance be adopted, seconded by Councilman Shaeffer and passed by vote of the City Council of the City of Edgewater, Florida at a regular meeting held on March 16th, 1959. Roll call vote being as follows:- Councilman Broga Yea Councilman Shaeffer Yea Councilman Henry Yea Councilman Farrell Yea Mayor Sedgwick Yea Upon motion duly made by Councilman Shaeffer, seconded by Councilman Farrell and carried, the requirement of reading said ordinance upon second reading was waived and the ordinance was ordered put upon final passage. Passed by vote of the City Council of the City of Edgewater, Florida, at a regular meeting of said Council held onsthe 16th day of March, A. D. 1959, and approved as provided by law, the vote of said council on roll call being as follO'\''1s:- Councilman Broga Yea Councilman Shaeffer Yea Councilman Henry Yea Councilman Farrell Yea Mayor Sedgwick Yea OLD BUSINESS Mr. Fernald appeared before the Council regarding his complaint on Chickens. Mayor Sedgwick ask the reason for the petition. J.Jr. Fernald stated they disturbed him ear~y in the morning. Also the grounds were filthy \-lith chicken manure and when the wind blows from the Southwest he could not keep his bedroom windows open. At day break the chickens are cackling. They also devaluate my property. Ask for opinions of the Council, Councilman Shaeffer stated he looked over this situation and in him opinion Mr. Fernald is justifiable in his complaint and there is an odor there and I reconnnend something should be done. Councilman Broga stated if proved a nuisance something should be done. Councilman Farrell stated if Mr. Conrad wanted to be a farmer he should be on a farm and not in the center of town. Councilman Henry stated if it had lowered the value of his property, certainly something should be done. Motion was then duly made by Councilman Shaeffer that action be taken to have chickens removed from the premises of Mr. Conrad. Seconded by Councilman Farrell and by vote CARRIED. Womack Paving Co. Construction approximately 1,400 lineal feet of standard concrete curb and gutter for the unit price of ---------------$2.00 per lineal ft. Construct approximately 150 lineal feet of 4ft retaining wall of concrete for the unit cost of ---------------$65.00 per cu. yd. or 8O~ per sq. ft. Catch basin frame and grate and drop inlet price of ---------------$300.00 each Construct approximately 3.3 sq. yds 6ft concrete pavement apron --------$10.00 per sq. yard. Construct approximately 390 fineal feet of dropped curb and gutter for the unit price of ---------------$2.00 per lineal ft. Furnish all labor, material and equipment necessary to perform this work in accordance with City of Edgewater specifications. Approximate Cost $6,153.00 II ~ v i'-. u v Owens Brothers, Concrete Co. vle are pleased to submit a bid on installing curbing & gutters, grading, and lowering three manhole covers on Park Ave. between U. S. #1 and Riverside Drive as follows:- 1. Class "B" State Road Department Concrete to be used throughout curbing, gutter, sidewalk and driveways. All fill dirt under concrete to be compacted by us with mechanical compactors. Curb and gutter to be standard Florida State Road Department design for which we already have proper forms. 2. Remove trees in right-of-way as indicated on plans and all grading to within a plus or minus one inch of proper grade under concrete and hauling away of excess dirt shall bedone for a flat price of $490.00. Excess dirt to be property of Contractor. 3. Prices on concrete work are as follows: Curb and gutter (regular or lowered) -- $2,00 per lineal foot Sidewalk or other flat work, 4" deep -- 37~ per sq. ft. or 1 foot of curb & gutter and 4 ft. sidewalk $3.48 per running foot. Driveway areas 6" deep ------- 47i per sq. ft. (or, 1 ft. of curb & gutter ajnd 4 ft. of 6" driveway $3.88 per running ft. 4. 4 inch expansion joint between sidewalk and curb - 8i per lineal foot. 5 . Raised or dropped retaining "lalls will be installed where directed by you in accordance with plans at a price of $2.00 per sq. ft. of vertical surface, 6" thick. 6. ~~oles will be lowered as directed by engineer and moved approximately 2 ft. toward center of street. Grating will be installed at gutter level at one manhole to provide catch basin as per instructions of your engineer. This work is to be limited to the top of the manhole as engineer advises that vertical "lalls need not be relocated. Cost for manhole work, in- cluding 1 grating - $489.00. 7. City of Edgewater shall arrange with City of New Sll\VI'na Beach to re- locate power poles as soon as curb and gutter is laid. Approximate Cost $5,851.00 George E. Lear. Construct approximately 5,600 sq. ft. of 4' x 4" concrete sidewalk for the unit price ,of 40~ per sq. ft. Construct approximately 1400 lineal feet of standard concrete curg and gutter for the unit price of $2.00 per lineal ft. Construct approximately 390 linear feet of dropped curb and gutter for the unit price of $2.00 per linear ft. ~ Construct approximately 150 linear feet of 4" retaining wall of concrete for tt1e unit cost of $65.00 per cubic yd. or 80i per sq. ft. Catch basin frame and grate drip unit price of $300.00 Including manhole tops to be lowered, construct approximately 3.3 sq. yds. 6" concrete pavement in front of Fire Station for the unit price of $10.00 per sq. yd. Approximate Cost $6,153.00 After discussion and tabulation of approximate Cost of bids submitted, motion was duly made by Councilman Broga the contract be let to }fr. George E. Lear. Seconded by Councilman Shaeffer and by vote CARRIED. Roll call vote being as follows :- Councilman Broga Councilman Shaeffer Councilman Henry Councilman Farrell Mayor Sedgwick Yea Yea Yea Yea Yea It was then suggested from the floor that Mr. Lear post a performance bond and a limit be placed on the time consumed on the job. Mayor Sedgwick stated he was sure Mr. Lear would comply with posting a bond and it was up to the Council to put a time limit on the job. VACATING of First Street. Attorney Chisholm stated the same procedure would have to be followed as vacating Frances Street, by advertising a hearing date for objections. Motion was then duly made by Councilman Farrell, we vacate First Street and put it on record, seconded by Councilman Shaeffer and by vote CARRIED. Mayor Sedgwick stated we would have an Ordinance written up covering the breakage of fire-plugs and covers. Mr. Piser ask when the cut-overs on the streets were going-to be repaired, as some of the streets were in very bad shape and anyone could break a spring. }1ayor Sedgwick said this would could not be done this kind of weather, but as soon as it cleared up and got warmer this would be taken care of. Mr. Smith of Edgewater Acres then ask when a light would be put up on his street as it had been some time since he had ask for this light and nothing had been done. Mayor Sedgwick stated a surg~y had been made for this light and it would be placed on light pole N. of Mr. Smith when the Light Company got around to it. Mayor Sedgwick then announced there would be a Special Meeting Wednesday March 18th at 2:00 P.M. to go over contracts on Heating and Air-Conditioning in the new City Hall. There being no further business Councilman Farrell moved we do now adjourn, seconded by Councilman Shaeffer and by vote CARRIED. Time 8:45 P.M.
