Chairman Kennedy opened the public hearing. Marilyn Jones Bennett, 194 Jones Fish Camp Road asked if this project is the same owner as the prior meeting in 2020. Mr. Lear stated Lennar purchased this project from the prior owner. Ms. Bennett asked if the name of the road will still be Jones Fish Camp Road. Chairman Kennedy advised yes. Ms. Bennett asked if the plans had changed. Cody Bogart of Newkirk Engineering stated now the plans are not encroaching on the river. There will be no boat slips. Mr. Lear stated there was a pier and dock that is no longer in the plans. Ms. Bennett stated she had traffic concerns. Mr. Lear stated a traffic study was done and the study did not indicate traffic issues. Mr. Lear also stated they will be putting in sidewalks. Cody Bogart stated that Lennar is working on utility and repaving will happen if any damage is done during the work. Mr. Bogart stated the study did not indicate the need to repave Jones Fish Camp Road. Ms. Bennett expressed concern regarding emergency vehicles. Mr. Lear stated this has been addressed in the PUD agreement. Ms. Bennett stated she is concerned about animals being forced out of their environments and also about infrastructure. Mr. Lear recommended Cody Bogart from Newkirk Engineering to meet with Ms. Bennett to discuss her concerns and discuss the plans. Chairman Kennedy closed the public meeting and asked for a motion. A motion was made by Mr. Wright, second by Mr. Maroney, to send a favorable recommendation to City Council for Item SD-2201. Mr. Lear stated in order to be considered adequate shrubbery, the shrubbery buffer would not allow the pool to be visible from Riverside Drive. Mr. Lear stated there will be an inspection to insure this condition is met. Chairman Kennedy asked if a screen could be put up. Mr. Lear stated yes, but the applicant would have to submit another variance request. The applicant, Yariv Natanel, 1209 South Riverside Drive stated he might want a screen in the future. Chairman Kennedy advised him he would need to submit another variance at that time. Chairman Kennedy closed the public hearing. A motion was made by Mr. Wright, second by Mr. Andrejkovics, to approve Item VA-2204 with the condition of adequate shrubbery. Mr. Lear stated the building department can charge double the permit fee, and staff is currently looking to charge more in the future for after the fact variances. Chairman Kennedy asked if the applicant pulled a permit. Mr. Lear stated no, and it was an error by the contractor, not the property owner. Chairman Kennedy closed the public participation.
