Chairman Kennedy asked for approval or changes to minutes. Mr. Thomas Duane stated he was in
attendance at the May meeting and requested the minutes be corrected to reflect he was present.
Mrs. Williams stated she would make that correction.
A motion was made by Mr. Wright, second by Mr. Andrejkovics, to approve the Minutes of
the May 11, 2022 meeting with correction.. The MOTION was APPROVED by the following

a.SD-2202 - Cody Bogart, requesting Preliminary Plat approval for Edgewater
Preserve Phase 1
Mr. Lear provided a staff report and recommendation.
Chairman Kennedy opened the public hearing.
Robert Clinton, Volco Road and Clinton Road stated he had three concerns. The first was the
entrance is on a curve and the speed limit is 40 mph, which most people do not adhere to at this time.
Mr. Clinton's concern was the safety of that curve entrance. Mr. Clinton's second concern was
residents will be crossing US 1, and there have been some bad wrecks at that location. Mr. Clinton's
third concern was that this item is for Edgewater Preserve, but the sign on the property states Park
of Edgewater. Chairman Kennedy stated that is the legal designation.
Mr. Andrejkovics asked how many units are in Phase 1. Darren Lear stated 94 units is the correct
number of units. Mr. Andrejkovics asked about a traffic signal. Mr. Lear stated the developers have
been meeting with Volusia County and there are many steps of transportation improvements to be
made over period of time.
Mr. Clinton stated he spoke with DOT and they said it would be 10 years for a traffic signal.
Cody Bogart, applicant from Newkirk Engineering stated they have had extensive negotiations with
the County and the City of Edgewater. Mr. Bogart stated they will have to permit for each tie in with
Volco Road for each phase. The City will have the ability to state they cannot build any more until
road improvements have been made. Mr. Bogart stated the reason DOT stated 10 years is because
that is their schedule and budget, however; the development will speed up that process as the
developer will be paying for the improvements to Volco Road, which is currently a substandard road.
Mr. Bogart stated they will be adding a left turn lane and also will make a crossing for a safe
transition. Mr. Bogart stated soon Volco Road will be widened to 12 feet, improved, and elevated for
safety. Mr. Bogart stated he believes they will be putting in a traffic light within 3 to 5 years. The
road improvements will begin this year.
Mr. Clinton stated his family built Volco Road.
Chairman Kennedy closed the public hearing.

Mr. Lear provided a staff report and recommendation.
Chairman Kennedy opened the public hearing.
Mr. Amalfitano asked if the shed would be on a cement pad. Mr. Lear stated he was not sure.
Chairman Kennedy closed the public hearing.
A motion was made by Mr. Amalfitano, second by Mr. Rainbird to approve Item VA-2213.

c.VA-2214 - Joel Ayala, requesting a variance for property located at 208 S. Park
Place
Mr. Lear provided a staff report and recommendation.
Chairman Kennedy opened the public hearing.
Chairman Kennedy stated he received a letter from the next door neighbors at 204 S Park and they
are strongly urging the Planning and Zoning Board to grant this variance because this site has been
severely neglected in the past and this would be a much need improvement.
Chairman Kennedy closed the public hearing.
A motion was made by Mr. Wright, second by Mr. Rainbird to approve Item VA-2214. The
MOTION was APPROVED by the following vote:

Comprehensive Plan Consistency:The current Volusia County Future Land Use designation of Low Impact Urban (LIU)consists of
lands which are determined to be suitable for urban type development,and are adjacent to existing urban development.Lands
designated LIU serve as a transition between highly protected natural resource areas and existing urban development.The LIU is
primarily a residential designation but may allow limited commercial development.The gross residential density shall not exceed one
(1) dwelling unit per acre.
The current Volusia County Future Land Use designation of Environmental System Corridor (ESC)consists of important ecological
corridors comprised of environmentally sensitive and ecologically significant lands.Land use activities occurring within these
corridors shall not degrade these natural functions and connections.The intention is to provide protected,natural pathways which
connect to other protected areas such as parks,conservation lands and water bodies.This inter-connection helps maintain the
ecological integrity and ecodiversity of the County's vast natural resources.ESC's shall include significant interconnected natural
systems of environmentally sensitive lands,connecting to and including conservation areas where possible.The ESC's are not
intended to include pre-existing improved,cultivated,or developed lands unless such lands contain unique or exceptional ecological
value.Conservation and silviculture,utilizing Best Management Practices (BMP's),will be the preferred use,however,other
compatible passive agricultural activities may also be permitted such as unimproved pasture.The primary consideration of compatible
agriculture should be potential adverse impacts to the short and long term ecological stability of the system,as well as adjacent lands
and waterways.The Environmental System Corridor configuration displayed on the Future Land Use Map is intended to show a
generalized location for the corridor.The actual boundaries will be established based upon site specific information and features.(1)
The maximum residential density shall not exceed one (1)dwelling unit per twenty-five (25)acres.(2)The maximum Floor Area
Ratio shall not exceed ten percent (0.10 FAR).
The City Agriculture Future Land Use allows one (1) dwelling unit per 2.5 acre.
RECOMMENDED ACTION
Motion to send a favorable recommendation to City Council for CPA-2203.
