I I E a C L U T I O N
WHEREAS, on September 20, 1938, the Town Council of the
Town of Edgewater, Florida established a fund than and there
specified as "Special Delinquent Tax Fund".
y.;D '.i1E1iES, it is and has been at all times the intent
of the Town Council to make such use of said fund as would from
time to time , in the discretion of the Council, appear to the
best interests of the Town.
AND ,iiEEREAS, there is some doubt as to whether the above
stated designation of said fund might create confusion in re-
gard to the use thereof.

I.
That said resolution of September 20, 1938 be and the same
is hereby rescinded.
II.
That all of the monies now in said "especial belinquent Tax
Fund" be placed in a fund to be designated as "especial Foreclosed
Property Fund".
III.
That all monies hereafter collected from sales of Town owned
lots acquired through foreclosure proceeC ink. s, trading of proper-
ties or properties purchased from monies in said fund or income
received from said properties shall be placed and kept in said
"especial Foreclosed Property Fund".

That the following expenditures shall from time to time
as required be paid out of said fund: state and County taxes due
and owing on properties owned by the Town, legal and necessary
expenses incurred in connection. with the sale of any property
so owned, expenses of cleaning; and of upkeep of all of said
properties, payment of which said sums shall be mace as and
when ordered and directed. by said Town Council.
V.
That, in addition to the expenditures authorized in Para-
graph IV of this Resolution, said fund may likewise be used at
any time when in the discretion of the Council it is necessary
to meet any municipal emergency or deemed advisable to provide
for the erection or construction of any public work of general
benefit to said Town, provided hoever, that any such expenditure
so met shall be by a proper resolution at the time legally made
by said Town Council.
That, inasmuch as any expenditures authorized to be made
under tection V of this 2esolution are cf such nature that they
cannot be estimated and provided for beforehand in future .-innual
Budgets of said Town, since they are to be expended for emergen-
cies or for the furtherance of public works, the need for which
or benefit of which cannot ordinarily or reasonably be foreseen
at the ti_!e of the adoption of said Budget in each year, and in-
asmuch as it is imposible to specify or set aside any definite
amount of said fund at said time for the pur;. c: es set forth in
Paragraph V hereof, therefore any such expenditures from said
fund so made in accordance with the hesolution authorized to be

made in Section V hereof shall be deemed and taken as s,:: t aside
annually for the purposes stated in Paragraph V hereof, and this
Resolution shall be deeded and taken as incorporated in and made
a part of any annual budget herafter adopted by the Town Council
od said Town, and the money so expended shall be solely from said
fund; provided however that Sections V and VI of this ;.esolution
shall only be effective when and if the expenditures provided
by Section V hereof are authorized by the a_-nual .6►pl ropriation
Ordinance of said Town in any year ' in which such expenditures
are made.
DONE AND RESOLVED at a regular meeting of the Town Council of
the Town of Edgewater, Florida, held this let day of April
