Motion by Councilman Henry these minutes stand approved as submitted, seconded by Councilman Farrell and by vote CARRIED. OFF! CERS REPORT Fire Chief Garlick reported there were two brush fires and fifteen men completed 15 hours course of Fire School during the month. COMMUNICATIONS A petition was read from Mr. W. J. Fernald regarding Mr. Conrad's chickens, which are regarded as a nuisance to him in regard to odor, noise and getting out of pen. The Mayor presented the permission granted Mr. Conrad signed by all his neighbors within 200 feet and stated the Building Inspector and also the Health Department had inspected the place and found nothing wrong with having chickens. The Mayor also brought out there was only one signature on the petition asking to get rid of the chickens that lived within the 200 feet required. After a discussion, Councilman Shaeffer moved this petition be tabled. . /\;. .. v :... c..) v RESOLUTION A RESOLUTION DECLARING THE INTENTION OF THE CITY OF EOOEWATER, FLORIDA, TO VACATE THAT PART OF FRANCES DRIVE ADJACENT TO AND WEST OF LOTS 5, 11, 18, 19 and 20, INDIAN RIVER ESTATES, AS PER MAP IN MAP BOOK 8, PAGE 248, PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA, AND PROVIDING FOR THE SERVING OF NOTICE UPON THE ABUTTING PROPERTY OWNERS AND THE TIME AND PLACE AT WHICH OBJECTIONS CAN BE HEARD BEFORE THE CITY COUNCIL. The above Resolution was read in full by Attorney Chisholm and motion duly made by Councilman Broga this resolution vacating this street and the time of March 16th be set for the time of hearing be adopted, seconded by Council- man Shaeffer and by vote CARRIED. Roll call vote being as follows:- Councilman Broga Yea Councilman Shaeffer Yea Councilman Henry Yea Councilman Farrell Yea Mayor Sedgwick Yea OLD BUSINESS Mr. vi. Smith appeared before the Council and stated he had been operating on trial a bus route for a thirty day period and a route and schedule had been worked out and ask that he be granted a franchise to operate in Edge- water. He also complained that the Taxi Cabs from New Snwrna Beach had been going just ahead of the bus and had been picking up passengers and ask whether they were licensed and if they would please see that they be stopped as it was hurting his business. Mayork Sedgwick stated the taxi cabs were not licensed in Edgevmter, and did not have a franchise to operate, but if anyone in the City calls a cab they can answer the call, but should not solicit passengers on the return trip. l-1ayor Sedgwick ask Hr. Smith to have a written request before the Council stating route traveled and hours bus is in service. Also fare to be charged. l-1r. Smith to be allowed to operate until next Council meeting and suggestion made that his Attorney together with Attorney Chisholm draw up B franchise with terms to allow Mr. Smith to pick up and deliver off his route in special cases. NEW BUSINESS Councilman Shaeffer moved the rest of the Council meetings be held in the Community Center, seconded by Councilman Farrell and by vote CARRIED. Councilman Shaeffer regarding the meeting with property holders this afternoon, it seems to me Mr. Driskel has a justifiable complaint in the amount of ground being taken for sidewalk and curbing, and suggest that for the ground taken from Mr. Driskel we move Park Place east 5 or 6 feet back two houses and in addition that a corner of City Hall property be used for display of his plants, and give him this advantage and not run him out of town. This started a dis- cussion and after this Mayor Sedgwick ask for dispositions of the other Council- men. Councilman Broga stated it we can legally do it" he was in favor of it. Councilman Henry stated providing other parties back of him are satisfied. Councilman Farrell, stated he felt we should help George out and keep him in business as he is a good citizen. Councilman Shaeffer, I am very much in favor of keeping Mr. Driskel in business, he is a good citizen and I am in favor of leasing him this ground for $1.00 per year. Motion duly made by Councilman Shaeffer that the strip of land lYing between the City Hall and easterly boundary of Park Place shall be leased to George Driskel for $1.00 per said strip, also fronting on Park Avenue and extending to property leased by Edmond Gates. Seconded by Councilman Farrell and by vote CARRIED. Roll call vote being as follows:- . " <..J ~ v \ . v l~. .', .....
