80311/21/2002 14:41 !*vtrument # W02-267342 dOk: 4967 Paee: 3230 ORDINANCE NO.vn� AN ORDINANCE VACATING PROTIONS OF THE FOLLOWING AVENUES: RAILROAD AVENUE BEGINNING AT THE SOUTH LINE OF LOT 35 L NORTH TO THE NORTH LINE OF LOT 35Z, AND FLAGLER AVENUE BEGINNING AT THE NORTH SIDE OF THE FLORIDA EAST COAST RAILROAD RIGHT OF WAY NORTH TO THE NORTH LINE OF LOT 35Z, BOTH LYING IN ASSESSOR'S SUBDIVISION OF G. ALVAREZ GRANT IN SECTION 52, TOWNSHIP 17 SOUTH, RANGE 34 EAST AS RECORDED IN MAP BOOK 3, PAGE 137, PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA. WHEREAS, pursuant to a public hearing on October 2, 1972, for the purpose of hearing objections to the proposed vacating hose portions of Railroad and Flagler Avenues set forth herein and thereafter the City Council finding that it is proper and for the best interest and welfare of the City to vacate and abandon avenues as hereinafter described and provided. N NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF 4P EDGEWATER, FLORIDA: SECTION 1. That the following Avenues be and the same hereby are vacated and abandoned, to -wit: Railroad Avenue beginning at the South Line of Lot 35L North to the North Line of Lot 35Z, and Flagler Avenue beginning at the North side of the Florida East Coast railroad right of way North to the North Line of Lot 35Z, Both lying in Assessor's Subdivision of G. Alvarez Grant in Section 52, township 17 South, Range 34 East as recorded in Map Book 3, Page 137, Public Records of Volusia County, Florida. SECTION 2. That the above described streets herein vacated shall revert to the abutting property owners as provided by law, and title is vested in said respective owners insofar as the City of Edgewater, Florida, has the legal right to vest such title. SECTION 3. That the Mayor and the City Clerk of the City of Edgewater, Florida, hereby are authorized and directed to execute and deliver in the name of the said City, quit -claim deeds to such abutting Book: 4967 •` ,. Matousek � iusia County, Clerk of Court property owners, conveying title to the hereinabove described part of the vacated and abandoned streets or thoroughfares adjoining their respective parcels of land. SECTION 4. That a duly certified copy of this Ordinance may be recorded in the office of the Clerk of the Circuit Court of Volusia County, Florida, in the discretion of and at the expense of the abutting property owners. SECTION 5. That all Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed. SECTION 6. That this Ordinance shall take effect immediately upon its adoption by the City Council and approval by the Mayor. The above Ordinance was read in full and passed by vote of the City Council of the City of Edgewater, Florida at a regular meeting of said Council held on the ;(fft day of December, A.D. 1972. Upon motion duly made, seconded and carried, the requirement of reading said Ordinance upon second reading was waived and the Ordinance was ordered put upon final passage.
