REGULAR MEETING OF THE CITY COUNCIL
OF THE CITY OF EDGEWATER, VOLUSIA
COUNTY, FLORIDA, HELD APRIL L7th, 1961.
The Regular Meeting of the City Council of the City of Edgewater, Florida
held April 17th, 1961 was called to order by Mayor Crawford C. Shaeffer at
7:30 P.M.

The Minutes ofs the Regular Meeting held April 3rd, 1961 were presented to
each Councilman for his approval. Motion duly made by Councilman Seng these
minutes stand approved as submitted, seconded by Councilman Armstrong and
by vote CARRIED.

the minutes, seconded by Councilman Beck and by vote CARRIED. Roll call vote

COMMUNICATIONS
A letter was read from the Edgewater Volunteer Fire Department asking their
name be withdrawn from Petition presented at the April 3rd Council meeting.
OFFI CERS REPORT
The Clerk read the Clerk's Cash Statement and the Budget Report for the month
of March, 1961. Also the Police Report for the month of March, 1961.

PROCLAMATION
A Proclamation was read by Attorney Chisholm declaring April 23-29 as
National Association of Real Estate Board Week.

Councilman Smith stated he had a question for Attorney Chisholm. Is it
right for the City to install City property in a private automobile? Attorney
Chisholm stated this was discussed with the Council and he was instructed to
draw up an agreement to be signed by Mr. LaBonde that he would agree that the
legal title remain in the City and he would use diligence in protecting this
system from damage and deterioration. The Council was in accord and the
agreement drawn and signed.
Councilman Smith: I want to know if this does not have to be discussed at
a regular meeting and not a special meeting and have approval1 Attorney
Chisholm stated he considered this one of the internal functions of the City,
the same as you would instruct a certain man to drive a truck or tractor.
Councilman Smith: At the December 3rd meeting right here it was stated the
police car was to be left at the City Hall for the Mayor and Inspector to use.
Why was this motion ignored, and why is the car not used by both? I say it is
a violation of the Charter.
Councilman Beck: I cannot go into this matter with detail and actual facts,
but I do know everyone working for the City has violated the Charter at some
time or other. I do not keep a file of the minutes, I try to keep them in my
mind and I might forget sometimes. This was discussed and it was agreed it was
to be put in Mr. LaBonde's car. It was bought for this purpose before I be-
came Councilman, and I believe in using it rather than leaving it set on the
floor. I have no bones to pick with anyone, the M~yor, Councilmen, Attorney or
any other City Employee, but I am not going to stand by and let anyone disrupt
this Council and cause discontent. I have a business to take care of and do
not have the time to spend that some have, but I do not intent to come to
Counc~l meeting and sit for two hours like the last meeting. This could all be
settled before we get to an open meeting. You, Councilman Smith, did not open
your mouth when we met in the Mayor's office before this meeting and I don't
intend to sit here and listen to you argue before an audience. I have more im-
portant things to do.
Councilman Seng stated Mr. LaBonde could not use the radio in the Police car
without going through New Smyrna Police Station. The Police car is now used
by the Mayor and Mr. LaBonde cannot depend upon the use of this car and the
time and gasoline saved by Mr. LaBonde will pay for the radio in his car.
Councilman Smith: At the time the purchase of the communication system was
made, I questioned the legality of the meeting. At that time, a second meeting
was called and all properly notified and I want to know why Attorney Chisholm
advised this.
Attorney Chisholm: I did advise the Mayor to call another meeting to keep the
City out of a Law suit. I could have set back and collected a big fat fee, but
I am engaged by the City to keep it out of law suits if possible.
Motion duly made by Councilman Beck the Ma~pf the City be instructed to install
radio in Mr. LaBonde's car, seconded by Councilman Seng. Councilman Smith
questioned the motion and discussion followed. Roll call was then taken as

Councilman Smith: A question. I would like to know why the Thursday
afternoon meetings were discontinued? Mayor Shaeffer stated he would
answer that. Because of your big mouth. Another discussion followed
and Councilman Beck ask if a motion to adjourn would be in order. Mayor
Shaeffer stated it certainly would.
Motion then duly made by Councilman Beck this meeting be adjourned, second-
ed by Councilman Smith and by vote CARRIED.
