The Regular Meeting of the City Council of the City of Edgewater, Florida

1962 and the Special Heeting held September 14th, 1962 were presented to each
Councilman for his approval. Motion duly made by Councilman Seng these minutes
stand approved as submitted, seconded b7 Councilman Siller and by vote CARRIED.

ORDINANCE NO. 329 APPitOPRIATING UNAPPROPRIATED SURPLUS FUNDS TO BE ADDED
TO THE APPROPRIATION ORDINANCE FOR THE YEA."'1, ENDING OCTOBER 31ST, 1962.
The above ordinance was read in full by Attorney Clark and motion duly w~de
by Councilw~n Kennedy this ordinance be adopted, se~onded by Councilman PaL~teer
and passed by vote of the City Council of the City of Edgewater, Florida at
the regular meeting of the said Council held on September 17, 1962. Roll

Upon motion duly made by Councilw~ Kennedy, seconded by Councilman Seng
and C~~ED, the requirement of reading said ordinance upon second reading
was waived and the ordinance ~~s ordered put upon final passage.
Passed by vote of the City Council of the City of Edgewater, Florida at the
regular meeting of said Council on the 17th day of September A.D. 1962
and approved as provided by law. The vote of the said Council being as

RESOLUTION
A RESOLUTION DESIGNATING AND APPOINTING HELEN l"l. JONES AS A DEPUTY CLERK
OF THE CITY OF EDGEWATER, FLORIDA, AND AUTHORIZING HER TO EXECUTE SIGNATURE
CARDS FOR, AND HAVE ACCESS TO, THE SAFETY DEPOSIT BOX OF SAID CITY AS
HAINTAINED IN THE BAm\ OF NEvi Sl"iYRNA, NEVI[ SHYR.1IJA BEACH, FLORIDA.
The above resolution was read in full by Attorney Clark and motion duly made
by Councilman Palmateer this resolution be adopted, seconded by Councilman
Kennedy and passed by vote of the City Council of the City of Edgewater,
Florida at the regular meeting of the said Council held on September 17, 1962.

OLD BUSINESS
Councilman Kennedy asked what had been done about the light at the Florida
Shores Crossing.
City Attorney Clark: According to the agreements in my possession it is
incumbent upon the City to furnish these lights, etc. If we should request
that the trains slow dovm they could take back the easements.
Councilnan Kennedy said that this IT'.atter is very important and the Council
should keep working on it.
Nayor Hussey said that he went to St. Augustine about this rr.atter and didn't
get very far.
Nat Brovm stated that there is no such law as to let the railroads take
back the easements. He said that he had a similar experience in Daytona.
Councilman Palmateer stated that the City Attorney should check into this to
the full extent.
Nat Brown made a bet that if you pass an ordinance to slow the trains dOl1n
and the railroad doesn't come through vuth a light he vull pay for the
light himself.

Council agreed to clear from the property of rtrs. Hough, the trash left
by the County.
Motion duly made by Councilman PallT'.ateer that due to the orders of his doctor
we accept vuth regrets the resignation of CouncillT'.an Kennedy, seconded by
Councilman Seng and by vote CARRIED. Roll call vote being as follows:-

11r. Dana Armstrong asked if they had any answer from New Smyrna Beach with regards
to the violation of the Electric Contract.
Ivfayor Hussey: I'le have no answer.
City Attorney Clark stated that he t~D<ed with the City Attorney and }~yor
and they will give it some consideration and try to work out something
that IT'ight be suitable. }tr. Clark stated that he was in the process of
studying the contract.
}trs. Grayson stated that she was under the impression that the contract was
scrutinized thoroughly already.

City Attorney Clark said that it might have been but it was way before he
was City Attorney.
Councilman Seng said that the previous council had gone into this but never
could get past first base.
City Attorney Clark said that he believed that it was a definite breach of
contract.
There being no further business motion duly wade by Councilman Seng, seconded
by Councilman Palmateer and by vote CARRIED, this meeting be adjourned.
