The Regular Meeting of the City Council of the City of Edgewater, Florida, held April 16th, 1962 was called to order by Mayor A. Hussey at 7:30 P.M. ROLL CALL Mayor A. Hussey Councilman C.A. Letters were read from the following: Warren L. Gunther; Fred Garlick, Fire Chief; J.W. Sikes; Florida East Coast Railway Co.; Capt. Hugh R. Lawson. Motion duly made by Councilman Seng that $50 be given to Fire Garlick for expenses for his trip to State Fireman Convention Sarasota, seconded by Councilman Kennedy and by vote CARRIED. call vote being as follows:- Chief at Roll Councilman Siller Councilman Seng Councilman Palmateer Councilman Kennedy Mayor Hussey Yea Yea Yea Yea Yea The Council agreed to put up a "Children Playing Slow Sign" on Palm Way at the request of Mr. J.W. Sikes. Motion duly made by Councilman Siller that we table paying the Florida East Coast Railway until we look into it further, seconded by Councilman Palmateer. After some discussion as to the amount that had to be paid'~hich was $5.00 in advance for a five-year period, Councilman Siiler rescinded the motion. Motion duly made by Councilman Seng that we pay the Railroad the $5.00 for a five-year period, seconded by Councilman Palmateer and by vote CARRIED. Gunther be given permission to speak atlthe end of the Council Meeting, seconded by Councilman Seng. OFFICERS REPORT The Police Report for the month of March was read. The Budget Report for the month of March was read. The Clerks Cash Statement for the month of March was read. RESOLUTIONS A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, TO MAKE PUBLIC STREET IMPROVEMENTS BY SPECIAL ASSESSMENTS; DECLARING THE NATURE OF THE PROPOSED IMPROVEMENTS; DESIGNATING THE STREETS TO BE IMPROVED; FIXING THE PART OR PORTION OF THE EXPENSES THEREOF TO BE PAID BY SPECIAL ASSESSMENTS; INDICATING THE MANNER IN WHICH SAID SPECIAL !SSESSMENTS SHALL BE MADE; WHEN SAID ASSESSMENTS ARE TO BE PAID; AND DESIGNATING THE LANDS UPON WHICH THE SPECIAL ASSESSMENTS SHALL BE LEVIED; AND FIXING THE TcrAL ESTIMATED COSTS OF THE IMPROVEMENTS. The above ordinance was read in full by Attorney Warren and motion duly made by Councilman Seng this ordinance be adopted, seconded by Councilman Kennedy and passed by vote of the City Council of the City of Edgewater, Florida at the regular meeting of the said council held on April 16, 1962. Passed by vote of the City Council of the City of Edgewater, Florida, at the regular meeting of said Council on the 16th day of April A.D., 1962, and approved as provid by law, the vote of said council being as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Kennedy Mayor Hussey Yea Yea Yea Yea Yea ORDINANCE #310 AMENDING ORDINANCE NO. 146 OF THE CITY OF EDGEWATER, FLORIDA HERETOFORE ADOPTED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, ON THE 1st DAY OF MARCH, A.D., 1957, BY STRIKING FROM SAID ORDINANCE SECTIONS TWO, (2), THREE (3) AND SIX (6), AND PROVIDING IN SAID AMENDED ORDINANCE FOR THE CLASSESOOF PL~1BERS; MASTER PLUMBERS; AND JOURNEYMAN PLUMBERS; PROVIDING EXAMINATION FEES FOR EACH CLASS; DESIGNATING CHIEF BUILDING OFFICIAL AS CHIEF EXAMINER OF MASTER PLUMBERS ANDJJOURNEYMAN PLUMBERS; AND PROVIDING THE TIME AND METHOD OF GIVING EXAMINATIONS FOR MASTER PLUMBERS AND JOURNEYMAN PLUMBERS; PROVIDING COMITY BETWEEN MUNICIPALITIES AND CITIES USING SIr~LAR TESTS. " .. . ~ . -...I '-' v Passed by vote of the City Council of the City of Edgewater, Florida at the regular meeting of said Council on the 16th day of April A.D., 1962, and approved as provided by law, the vote of said council being as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Kennedy Mayor Hussey Yea Yea Yea Yea Yea AGREEMENT An Agreement was read by Attorney Warren between the City of Edgewater, Volusia County, Florida and Hanson & McCallister, Inc. to purchase land for street purposes to connect Flagler Avenue and 12th Street in the City of Edgewater, Florida. RESOLUTION A RESOLUTION AUTHORIZING THE PURCHASE BY THE CITY OF CERTAIN LANDS FROM HANSON & MCCALISTER, INC., DESIGNATING FOR INTEREST THEREON' AND PROVIDING A METHOD OF PAYMENT. The above resolution was read in full by Attorney Warren and motion duly made by Councilman Palmateer this resolution be adopted, seconEd by Councilman Kennedy and passed by vote of the City Council of the City of Edgewater, Florida at the regular meeting of said Council held on April 16, 1962. Roll call vote being as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Kennedy Mayor Hussey Yea Yea Yea Yea Yea OLD BUSINESS None NEW BUS INESS Motion duly made by Councilman Kennedv that the Zoning Board be able to advertise in any newspaper they see fit, seconded by Councilman Palmateer and by vote CARRIED. Mr. Warren Gunther was given permission to speak. He stated that there had been a petition going around the City of Edgewater concerning the reinstating of Frank Norman. He read the petition: It stated Francis H. Norman, Police Chief of the City of Edgewater was suspended pending the outcome of a charge of larceny of $200 concerningia bond of James O. Price. On April 10, 1962 Francis H. Norman was tried on the said charge, said charge having been changed to embezzlement of said bond, and was found not guilty. There are two charges still pending but he ',has:.,not been:' tr~ed for said charges and is presumed innocent until proven guilty and should be given the benefit of the doubt unless proven guilty. There were 437 names on the petition. They all wished to have Mr., Norman reinstated with back pay as Police Chief of the City of Edgewater. Motion duly made by Councilman Palmateer that we table the petitions till we can investigate further on the names on the petitions, seconded by Councilman Kennedy. Councilman Siller called for discussion. After the motion was ,made Councilman Siller asked who would be eligible to sign the petition? Councilman Siller said anyone had a right to have their names on the petition not just the voters of the City. He said it involved all the people of Edgewater and was too important to table. Councilman Kennedy stated that the City had a population of 3,000 and that I' . ~ . '-J ' ~ v there were only 437 names on the petition. Councilman Siller stated that the last census showed 2,012 people and at least helf of them are children, judging from my neighborhood. Roll call on the motion by Councilman Palmateer was as follows:- Councilman Siller Councilman Seng Councilman Palmateer Councilman Kennedy Mayor Hussey Nay Yea Yea Yea Yea There being no further business Councilman Kennedy moved we do now adjourn, seconded by Councilman Palmateer and by vote CARRIED.
