The Regular Meeting of the City Council of the City of Edgewater, Florida,

The minutes of the Regular Meeting held March 5th, 1962 were presented to
each Councilman for his approval. Motion duly made by Councilman Seng
these minutes stand approved as submitted, seconded by Councilman Palmateer
and by vote CARRIED.

A letter ,.,as read from Ira B. Miller questioning the right of an Edgewater
Policeman to call for a towing job outside of the City Limits.
A letter was read from John H. Hoynahan requesting work be started right
away on cleaning out certain portions of the Florida Shores drainage
canals.

The clerk read the Clerk's Cash Statement and the Budget report for February,1962.

A RESOLUTION APPOINTING JOHN ANCERS TO THE ZONING AND PLANNING BOARD OF THE CITY
OF EDGEWATER, FLORIDA, TO FILL OUT THE UNEXPIRED TERM OF EARL vlEBBER, DECEASED.
The above resolution was read in full by Attorney t'larren and motion duly made
by Councilman Seng this resolution be adopted seconded by Councilman Kennedy
and passed by vote of the City Council of the City of Edgewater, Florida at

ORDINANCES
AN ORDINANCE TO PROVIDE FOR THREE CLASSES OF GENERAL CONTRACTORS TO BE DESIGNATED
AS CLASS A GENERAL CONTRACTORS; CLASS B GENERAL CONTRACTORS AND CLASS C GENERAL
CONTRACTORS; AND DEFINING SAID CLASSES; PROVIDING EXANINATION FEES FOR GENERAL
CONTRACTORS IN CLASS A, CLASS B, AND CLASS C; DESIGNATING CHIEF BUILDING OFFICIAL
AS CHIEF EXAHlNER OF GENERAL CONTRACTORS; PROVIDING FOR REGULAR HEETINGS OF THE

Upon motion duly made by Councilman Palmateer seconded by Councilman Kennedy
and CARRIED, the requirement of reading said ordinance upon second reading
vvas waived and the ordinance vvas put upon final passage.
Passed by vote of the City Council of the City of Edgevvater, Florida, at the
regular meeting of said Council on the 19th day of l<Iarch A.D., 1962, and
approved as provided by law, the vote of said Council being as follows:-

NEW BUSINESS
Mr. Thomas Groover from Briley, Wild and Associates of Daytona Beach made a
report on a survey'to be made of the feasibility of a sewer system to be
put in Edgewater. They will serve as consulting engineers on a retainer
basis. They will be paid $900.00 for making the report to see if the sewer
system is feasible for Edgewater. The payment is from the General Fund of
the City.
~~. Blauvelt asked what area this sewer system will cover.
Mr. Groover said it will cover the entire area of Edgewater including some
areas to the south.
Councilman Kennedy said that the City should get an extra loan to run the
water lines into Florida Shores. You cannot have Sewage disposals if you
don't have water.
Motion duly made by Councilman Palmateer this Contract be executed, seconded

RESOLUTION
A RESOLUTION DESIGNATING BRILEY, WILD & ASSOCIATES, CONSULTING ENGINEERS, OF
THE CITY OF DAYTONA EEA6H, VOLUSIA COUNTY, FLORIDA AS CONSULTING ENGINEERS
FOR FEASIBILITY REPORT OF SANITARY SEWAGE SYSTEM; FIXING COMPENSATION FOR
SAME; AND AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE SUCH AGREEMENT ON
AND BEHALF OF CITY.
The above resolution was read in full by Attorney vlarren and motion duly
made by Councilman Kennedy this resolution be adopted seconded by Councilman
Seng and passed by vote of the City Council of the City of Edgewater, Florida
at the regular meeting of the said Council held on March 19, 1962. Roll

Mr. Beach asked if we would have to have a referendum to put in the Sewage
System.
Mayor Hussey said that this was just a survey to see if it can be done.
Mr. Beach said that no matter how you look at it the tax payers are going
to have to pay for it.
Nat Brown asked if the west side of U.S. 1 was only for Commercial use. He
stated that he is going to put up a $100,000 building and wanted to know
if the Council was in favor of it. He said the Zoning Board will be against
it and he wanted to know how the Council stood on the matter.
Councilman Siller asked if this wasn't putting the Zoning BoardLon the spot.
Nat Brown said that he was.
Councilman Siller asked Mr. Brown if he felt the Council made a mistake
appointing the Zoning Board.
Mr. Brown said that he didn't think that but he felt that the attorneys,
doctors, and other people in the City will be against his putting up the
building.

Councilman Kennedy said the City has no right to over rule the Zoning Board when
it is Spot Zoning.
Attorney \'larren said he did not know if it was Spot Zoning.
Motion duly made by Councilman Kennedy that a street light be put up on Hardin
Place, seconded by Councilman Seng and by vote CARRIED.
Councilman Kennedy stated that in regards to the letter from Magnuson Properties,
Inc., inquiring about the fixing of the canals in Florida Shores, he had talked
to Mr. Braddock and he said he would get to it in the Spring when the job could
be done properly.
Councilman Palmateer asked what assistance Florida Shores is going to give on
a way to get into the ditches.
Councilman Kennfldy stated that we have no easements on the ditches in some
places. On Evergreen Street there is no easement to get in it. I don't know
how we can get in and out without crossing private property.
Councilman Kennedy stated that he wanted Juniper, Orange, and 30th Street
oiled and Indian /River Boulevard cleaned up.
}oil'. Armstrong stated that he knew the City was going to have problems when
they accepted Florida Shores. He said that it will be necessary to have
a floating dredge to clean it out.
Councilman Kennedy said that it would be necessary to have a survey made in
Florida Shores by the Florida Geographic Society to have an Elevation Board
set up.
Motion duly made by Councilman Kennedy that we advertise for bids for this
survey, seconded by Councilman Seng and by vote CARRIED. Roll call vote

seconded by Councilman Seng and by vote CARRIED.

Motion duly made by Councilman Seng to grant Acting Police Chief Deibler
permission to go on .Ji th the Auxiliary Police since we have the necessary
insurance to cover them, seconded by Councilman Palmateer and by vote CARRIED.
The City Clerk said that the Olympia Typewriter that she had looked at for the
City Hall was over $400 and she felt that was too much to pay. She said
she would check on a cheaper one.
}.ir. Zeilman said that he had Russell Galbreath and a man from the Army check
on the signs in Florida Shores and they said that the signs were in the
wrong place. If you will notice they are on the inside of the ditches. I
almost had two collisi~ns , one on 26th and Juniper and one on 30th and
Woodland. He said people have to turn their heads to see them and that they
are in the ditches for the convenience of mowing.
Mayor Hussey stated that }.ir. Cox and Acting Police Chief Deibler had made a
survey of where the stop signs should go.
Acting Police Chief Deibler said the stop signs are placed in accordance with
State Law.

Mr. Donald Gillespie asked Councilman Seng if he lived in Zone 1. Councilman
$eng said "no". Mr. Gillespie asked if he represented Zone 2. Councilman
Seng said he did. Mr. Gillespie then asked if he didn t t claim Homestead
Exemption in Zone 1. Councilman Seng said that was a different question.
Councilman Seng said that he owns and pays taxes on property wi thin Zone 2.
Mr. Mason said that the Council is suppose to read the ordinance on the
speed of trains twice. And that it was not done.
Mayor Hussey said that the Rail Road wanted a couple of more weeks to go
into this matter.
Mr. Warren Gunther, President of the Chamber of Commerce, asked if anything
was going to be done about the letter from :r-Ir. Miller that was read at
the Council meeting.
Mayor Hussey said he would look into it.
Mr. LaBonde, Building Official, thanked the City Attorney and the Council
for drawing up and passing the ordinance on General Contractors. He stated
that he has wanted this for about 5 years and was very happy to get it now.
Attorney Warren stated that Mr. LaBonde had done a very good job and a lot
of work to get this ordinance ready. The Council agreed with him.
The Council agreed to meet Friday night, March 23, 1962, to readjust the
. Budget.
There being no further business Councilman Kennedy moved we do now adjourn,
seconded by Councilman Palmateer and by vote CARRIED.
