Also read, Use Permit from the State Road Department of Florida, permitting the City of Edgewater construction and maintenance of underground electrical cable and overhead light standards at the Municipal Park and State Road Dep't. boat ramp area; all work to be done in keeping with standards of the SRD and under the supervision of F.T. Morley, Maintenance Engineer; all materials and equipment subject to his inspection. Letter read from Attorney Dan R. Warren, that as requested by the Council he appeared at the hearing held in Holly Hill at the Halifax Law Center on the petition of the City of New Smyrna Beach to validate the water and electrical revenue certificates. At the time, Attorney Warren filed a petition for leave to file answer for the city of Edgewater, which was granted and he filed an answer, copy of which was attached for our records. The Judge agreed that the Final Decree should contain a provision that the contractural obligations of the city of Edgewater would not be affected by the Final Decree, which is what the Council of the city of Edgewater desired. Also enclosed a copy of Final Decree which reflects the clause on Page 5, Paragraph 13. Letter read from Chas. L. Moore, Jr., Florida Power & Light Co., acknowledging receipt of request for 1000 lumen, overhead bracket type street light at the west end of Adele Street, Edgewater Acres Subdivision; will advise connection date later. Letter read from John H. Moynahan, Vice President, lvIagnuson Properties, Inc., enclosing a deed for a small 5ft. strip of land which should have been included in the dedication of streets evidenced by a Revised Plat of Florida Shores No. 1. They received a tax bill for this 5 ft. strip, and the Tax Assessor states this strip is still in their name. To remove it from their name and eliminate the same tax question next year they have deeJl.ed the strip to the City (Record Book 4l3, Page 221) to become a part of Coco~ Drive. Letter read from John Grafton, thanking the Mayor and Council for contract to write Workman's Compensation and Liability Insurance; stated that the company, 'The Travelers of Hartford', have made a survey of the city's insurance needs, which shows that the City is not now covered on its Automobile Physical Damage policy for collision on one garbage truck, one Ford dump truck and one Inter- national pumper. This would cost $95.68. II . v ~ ,. u v On the Comprehensive General Liability policy, product coverage, having to do with the municipal water system, sub-surface coverage (digging up electric, telephone and water lines) at the present time are not covered and also at the present time, for the company to back up the City's liability, an accident must happen. They suggest that this be put on an occurrence basis. To add this coverage to the policy will be $106.05. They further suggest that the safe burglary policy be converted to a broad form Money & Securities policy, which would give $2500. coverage on the prem- ises as opposed to the present $1,000. and $2400. off the premises messenger coverage. This would cover any kind of a loss, burglary, robbery or Il\Vsterious disappearance. This broadening of coverage would cost an additional $21.90. Survey further suggests that the bonds on the five City employees for $1,000. each could be extended into a blanket coverage for 37 employees for $5,000. each. The additional premium would be approximately $23.10. The City Clerkl who operates in the capacity of treasurer at the present time, is bonded for :tPl,ooo. The survey recorranends that the City treasurer be bonded for $25,000., at the discretion of the Council. The rate for this type of bond is $10.00 per thousand. After checking into the Accident & Health policy on the Edgewater Volunteer Fire Dep't., can give a $3,000. death benefit, same as at present, increase the $25. weekly indemnity to $50. and give unlimited coverage for medical treatment for a total premium of $137.50, which is about the same as at present. The present accident policy has a premium of $87.50, and it is the added $25.00 weekly in- demnity which brings this premium to $137.50. The above additions to the present coverage totals $384.23. At the City Council's discretion they may make these recorranendations in total or any one or more additions. As agent, Mr. Grafton felt it necessary to advise the Council that the City was not properly covered. OFFICERS REPORTS The Building Inspector's report for December, 1961 was read. OLD BUSINESS Attorney Warren reported on the method of extending the City limits. If such tract contains less than ten registered electors, the Council of said City shall by Ordinance, duly"passed and approved as provided by law, declare its intention to annex such tract to said City at the expiration of 30 days, from the approval of said ordinance. If any two owners of real estate in the district so proposed to be annexed shall object to such annexation, they may apply by petition to the circuit court in county the proposed proceedings of said City and the grounds of their objection to. If the tractof land so proposed to be annexed contains ten or more registered electors, the ordinance proposing to annex said tract of land shall be submitted to a separate vote of the registered electors of the said City and of said tract of land. Such election shall be called and conducted ~ ~ by the City. Said tract of land shall not be annexed unless such annexation is approved by a majority of the registered electors , actually voting at such election in said district and in said City., provided that any unincorporated tract of land proposed to be so annexed shall, when annexed, constitute a reason- ably compact addition to the iil"cro"'f,roJ<"""~ocJ territory with which it is combined. Councilman Siller raised the question of just how far the City wishes to go. Attorney Warren stated that it is necessary to provide the facilities and functions of the MUnicipality to the tract annexed. Councilman Siller made a motion to contact the engineers about the annexation subject, seconded by Councilman Palmateer and by vote CARRIED. Councilman Kennedy made a motion to accept John Grafton's suggestions on addi- tional Insurance coverage, except the $137.50 on the Foreman's Accident & Health policy, which will remain at $87.50, and bond the City Clerk for $10,000., bring- ing total premium to $434.23, the $87 .50 to be paid immediately, to cover the Fire Department, seconded by Councilman Palmateer and by vote CARRIED. Lot Cleaning Drainage Upon motion duly made by Councilman Siller, seconded by Councilman Palmateer and by vote Carried, these assignments were accepted. In reporting on the Park & Pier, John Grafton gave a price of $14.00 on rye grass, asked if it was all right to go ahead on this purchase, also to have the trees transplanted at a cost of $300.00. Councilman Kennedy made a motion authorizing John Grafton to go ahead on this work, seconded by Councilman Palmateer, and by vote CARRIED. Mayor Hussey reported that he had sent J .L. Cox to Smokey's Automotive Service and the price will be less than $500.00 Mr. Lenz brought up the subject of the 'Penny Saver'. He explained how he had purchased a license in September, 1960, which was revoked the following November, that he had been permitted to conduct his business on Hart Avenue, then on Riverside Drive up to that time. Mayor Hussey reported that he and the Building Inspector had recently gone to get opinions of surrounding resi- dents, who were all in favor of Mr. Lenz printing the 'Penny Saver', with the exception of one, Mr. Charles Meier, who said he had purchased there with the understanding that it was residential, and he wanted to keep it that way. He also said that work had gone on until 4:00 A.M. one morning. Mr. Lenz ex- plained his machine had broken down, and the job had to be completed as soon as machine was repaired. Attorney Warren said license could not be issued under present Zoning Ordinance, that Mr. Lenz could apply to the Zoning Board for a variance. Councilman Kennedy stated that the rights of Mr. Meier should be considered. Robert Wilcken brought up the subject of Ford's Used Cars, that nothing had been done to improve the situation. Mayor Hussey instructed the Attorney to write to Albert Ford. . ~I .-.,; . ' " \. Subject of hiring a policeman was brought up. RESOLUTIONS II ..., ~ A RESOLUTION APPOINTING A PATROLMAN ON THE POLICE FORCE OF THE CITY OF EOOEWATER, VOLUSIA COUNTY, FLORIDA, AND SETTING FORTH COMPENSATION FOR SUCH OFFICE. The above and foregoing resolution was presented by Councilman Siller who moved its adoption; said motion being seconded by Councilman Kennedy and upon Roll Call vote, the said resolution was duly declared adopted at the regular meeting of said Council held on the 3rd day of January, A.D., 1962, the vote of said Council on said Roll Call being as follows: Councilman Siller Councilman Sang Councilman Palmateer Councilman Kennedy Mayor Hussey Yea Absent Yea Yea Yea Councilman Kennedy made a motion authorizing Patrolman John Deibler to set up the Florida Uniform Traffic Code system in the Police Department, seconded by Councilman Palmateer and by vote CARRIED.
