2007-R-14a RESOLUTION NO. 2007-R-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, DECLARING THE RESULTS OF THE PRIMARY ELECTION HELD OCTOBER 09, 2007 AND DECLARING THE CANDIDATES FOR THE CITY ELECTION FOR CITY COUNCIL TO BE HELD ON NOVEMBER 6, 2007; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEV ERABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. A primary election was held on October 9, 2007, for the purpose of determining the City Council candidates for the November 6, 2007 City election. 2. All votes have been tabulated and confirmed. 3. It is necessary for the City Council to forward to the Supervisor of Elections a list of City Council candidates for the November 6, 2007 City election. NOW, THEREFORE, be it resolved by the City Council of the City of Edgewater, Florida: Section 1. The candidates in the October 9, 2007, primary election received the number of votes as set forth below pursuant to the Official Results on the Election Summary Report (attached hereto and incorporated herein as Exhibit "A"): DISTRICT 4 Ted Cooper 741 58.30% Jeanne DelNigro 204 16.05% Carol A. Stoughton 326 25.65% Section 2. The City Council candidates for the City election to be held on November 6, 2007, we as follows: 2007-R-14 I DISTRICT 2 Gigi Bennington Dennis A. Vincenzi Section 3. Due to the District 4 results being over 51%for one candidate (Ted Cooper), there will be no District 4 candidate listed on the November 6, 2007 City election. Section 4. If any section, subsection, sentence, clause, phrase, or portion of this Resolution, or application hereof, is for any reason held invalid or unconstitutional by any Court, such portion of application shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions or application hereof. Section 5. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 6. This resolution shall take effect immediately upon its adoption. Report of the City of Edgewater's Canvassing Board Volusia Supervisor of Elections-Volusia County Historic Courthouse, DeLand, Florida October 9, 2007- 6:04P.M. Canvassing Board Members Present: Robin Matusick, Paralegal and Susan Wadsworth, City Clerk. Mandy Mams, Volusia County Election Worker was also present. One event was reported from Precinct 4904- Before the polls opened at 7:00 a.m. on October 9, 2007 the optical scan memory card failed when the poll workers were setting up the equipment. A complete scan replacement unit with a new memory card was submitted shortly after the polls opened. Susan Wadsworth and Robin Matusick reviewed the policies and procedures for determining validity of the absentee ballots. The Canvassing Board reviewed and acknowledged, Legal Advertisement L64289, titled Important Election Information published on September 16, 2007 in the Daytona News Journal. The Canvassing Board agreed for the handling of multiple ballots found in one envelope to be as follows: "To Accept ballots, IF number of voter signatures on certificate envelope matches number of ballots enclosed (this is the option used by County Canvassing Board)." Absentee ballots were presented to the Canvassing Board members. Voter signatures had been checked and verified by personnel from the Supervisor of Elections office. There were no multiple ballots contained in any one envelope. Absentee ballots were checked by the Canvassing Board members for voter signatures. 93 ballots were presented and inspected 93 ballots were accepted 1 ballot was undeliverable 0 ballots rejected Ballots were prepared for processing in the Accu-Vote. The Canvassing Board witnessed the Logic & Accuracy Test and running of zero total tapes for absentee ballots. No absentee ballots were presented to the Canvassing Board for duplication. Absentee Ballots were processed through the Accu-Vote. The report for absentee votes cast was presented verified and accepted by the Canvassing Board. The Canvassing Board witnessed the Logic & Accuracy Test and running of zero total tapes for Un-scanned ballots. The Canvassing Board did not receive any un-scanned ballots. The Canvassing Board witnessed the Logic & Accuracy Test and running of zero total tapes for Provisional ballots. The Volusia County Election Worker presented I provisional ballot to the Canvassing Board. The Canvassing Board reviewed and rejected the I provisional ballot from Precinct 903. Rejection was due to the voter not being listed as a registered voter within Volusia County.
