PLANNING AND ZONING COMMISSIONS WORKSHOP
September 13, 1982, 7:00 p.m.
Minutes
Mr. Nolan called the meeting to order at 7:00 p.m. in the conference area of
the Community Center.
ROLL CALL
Members present: Messrs. Nolan, Bennington, Hetu, Landry, Gaffney, Petty,
and Mrs. Griffith. Excused: Mr. Slaney. Absent: Mr. Towers, MoIster,
and Yackel. Also present: Mrs. M. J. Henderson, Acting City Attorney and
Mrs. Taylor, Secretary.
DISCUSSION OF ZONING APPENDIX CHANGES - Continued from August 23rd Workshop.
Acting City Attorney Henderson was present to give some guidance on several
word definitions. It was agreed to defer defining "Elwelling Unit" and "Family"
until Mrs, Henderson has had time to do further research.
Contractor: The person who is qualified for and responsible for the entire
project contracted for and means, the person who, for compensation, undertakes
to, submits a bid to, or does himself or by others construct, repair, alter,
remodel, add to, subtract from, or improve any building or structure, including
related improvements to real estate, for others or for resale to others.
REMOVE: Franchise.
Mrs. Henderson recalled that Annexation was discussed at the June 28th Zoning
Commission meeting, and a lot of questions were raised. She has prepared a
memo dated June 29 explaining the procedure for voluntary annexation and annexa-
tion by referundum, and will provide a copy for each member. She also pro-
vided information clarifying spot zoning. Messrs. Asting, Garthwaite and
Spencer, present in the audience, requested that they also receive copies of
this information.
Mr. Nolan recommended that approval of the minutes of August 23 Workshop be
postponed until the regular Zoning Commission night.
Lot: A parcel of land contained within property lines of a specific area,
including land within easements and building setback lines of said area, but
excluding any land within street rights-of-way; and intended as a unit for
building development, or for transfer of ownership or both. The word "lot"
includes the word "plot," "Parcel," and '!track."

Lot depth: The horizontal distance between the front and rear property lines
of a lot measured along the building line.
Lot width: The horizontal distance between the side property lines of a lot
measured along the building line.

or more streets or two (2) portions of the same street.

The Board then continued on with the word "restaurant", which was where the
last Workshop stopped.

Right-of-way line: Land occupied or intended to be occupied by a street, alley,
walkway, drainage facility, water main, electric transmission line, sanitary
or storm sewer facility, access for ingress or egress, or other purposes by
the public, certain designated individuals or governing bodies.

Will continue with definitions at the next Workshop scheduled for October 11.
Mr. Bennington asked about several Ordinance changes they had recommended.
He also brought up that they had requested reclassification of permitted uses
and fee increases. Mr. Nolan said he would look into these matters and
give a report at the next meeting.
Mr. Bennington also recalled a joint workshop with Council on recreation.
They rewrote part of the Subdivision Ordinance where it talks about the
5 per cent fees (see page 1733 (Subdivision Ordinance)) Mr. Nolan said he
would also look into this and get an answer from either Mr. Henderson's
office or City Council.
Regarding the Paul Roche case, Mr. Nolan said he would get a letter to the
legal department.
Future workshops were scheduled for October 11 and October 20. No workshops
will be scheduled for the other regular meeting nights.
There will be a special Planning Meeting and Planning Workshop on September 29.
The meeting was adjourned at 9:12 p.m.
