Minutes
Chairman Bennington called the workshop to order at 7:00 P.M., in the
Community Center.
ROLL CALL
Members present: Messrs. Bennington, Wheeler, Chenoweth, Finn and
Ann Thomas. Also present: Dennis Fischer, Building Official, secretary,
Susan Mista, Deputy City Clerk, 'Susan Wadsworth. Mr. Finn and Mr.
Quaggin were excused.
Chairman Bennington stated that this workshop was to review the Permitted
Uses in the zoning districts. Tonight they will be discussing the B2 and
B3 zones.
The list that was given to the members regarding the B2 zone was worked
on by Susan Wadsworth. Chairman Bennington said that the miniwarehouses
are being kept in the B2 zoning, he thinks they belong in the industrial
zoning. He reminded the Board members that they recommended to Council
that the zoning be changed from 20th to 30th Streets on Hibiscus and
Guava from B2 to 11. Mr. Wheeler agreed that the warehouses should not
be allowed in neighborhood business district, and he further said he
did not think residential should be allowed in the B2 zoning.
Chairman Bennington questioned the category entitled service stations
without pumps. Susan Wadsworth said that service stations are broken
down into three different categories, listed on page 1530 of the Code
book. Chairman Bennington said if you leave that category in, it
should be limited to type "C" and put in the exclusion regarding the
location they are now in. Leave type "B" in the B3 zoning district but
not in B2. Type "B" allows gas pumps, type "C" is auto repair shops,
paint and body shops. From 20th to 30th Streets the Code basically
allows industrial zoning in the B2 classification, under Section d.1 on
page 1598. If Council rezones that area, it would be best to take out
the category for service stations, type "C", which is the same as paint
and body shops and engine repair.
It was decided to change item 91, service stations, by taking out "no
pumps" and adding "type C", including the area that is listed in section
d.l on page 1598. If Council ddes change the zoning, this item will
be taken out of the B2 zone.
In regards to the mini shops and tool and grinding shops listed in section
d.l on page 1598, it was decided to delete those businesses from the
Code book.
The Board agreed that if th~s particular land is rezoned to 11, they
would recommend that the miniwarehouses be deleted from the B2 zoning.
Mr. Wheeler said he thought that the residential classification should
be deleted from the B2 zoning. Chairman Bennington said he did not
think that could be done, he doesn't think you can exclude a residence
from being built in any zone.
Councilman Wargo stated that there are people living in some of these
miniwarehouses, using them as residences. He also discussed the problem
that exists with individuals receiving a license to operate a business
for one purpose and then operating under a different purpose. Also,
there is a problem with plans being brought in for construction of a

business or residence, being approved by the City, and when construction
commences, it is built differently than what the original plans called
for.
After a long discussion concerning residences allowed in the B2 zoning,
the Board members agreed to update the square footage requirement from
800 square feet to 1,000 square feet.
In regards to car washes permitted in B2, it was the Board's decision to
omit this use from the B2 zone, eliminating any problems with water run-off.
If Council does not change the zoning to 11 between 20th and 30th Streets
on Hibiscus and Guava, it was decided to limit the miniwarehouses to what
is presently in existence. If the zoning is changed, they decided to
recommend that miniwarehouses be exclused from the B2 zoning altogether.
In addition to the definition and restrictions concerning the miniware-
houses in the Code, it was agreed to add: "May be converted into a
commercial Permitted Use if restrooms and parking are adequate. Must
submit new site plan for approval by the Planning and Zoning Board."
Also, it was agreed to add the location restriction: "To be allowed
only in that area of land along the Florida East Coast railroad tracks
from 20th to 30th Streets in the City."
It was the Board's decision to omit tool and grinding shops and mini
shops from section d.1, for the reason that mini shops will be allowed
as long as there are no more than 3 employees and the use is devoted
primarily to the sale of a service or product or products, but the ser-
vice is performed or the product to be sold is prepared in its finished
form on the premises.
Susan Wadsworth gave each of the Board members a list of possible Permitted
Uses in the B3 zone, advising them that the highlighted uses are the ones
she feels should be included in the list.
Chairman Bennington suggested that swimming pools be added to item 3 on
the list, that item being on page 1603 in the Code book under archery
ranges, bowling alleys, boxing or sports arenas, etc. After a general
discussion concerning this item, it was decided that this category be
eliminated and a new category, named, "Recreational Businesses", be
added with the businesses listed under the Archery Range category.
The item on B2 regarding Balls, Concerts, Parades, Carnivals, etc., has
to go to Council for approval in the B3 zone. The Board decided to
omit that section altogether from the B2 zone, also, due to the fact
said request would require Council approval in both zones.
In regards to Billiards, Electronic Games, etc., the Board decided to
add these items to the section in the Code entitled, "Pool Rooms".
Susan Wadsworth suggested that the Code be amended to include, under
the item, Fruit Stands, that said stand be a permanent structure. The
Board members agreed to add this specification to that item.
A discussion ensued concerning the category entitled "Manufacturers",
and the number of businesses that would be covered under this category.
It was decided to delete the category entitled, "Garment Assemblage",
and the category entitled, "Light Manufacturers" shall include 3 employees;
3-8 employees requires a Special Exception and over 8 employees would be
put into industrial zoning.
Drive-in theaters are to be included under the category entitled, "Theaters" I
in the Code book. I
Under the category entitled, "Professional Offices", it was decided to
add "including but not limited to" and continue with the description as
stated in the Code.
It was decided to delete the stipulation under the category entitled,
"Cabinet Shops" referring to maximum size of 5,000 square feet.

The category entitled, "Wrecker, tow truck" is to be added to the Service
Station category.
After a discussion about service stations and the different types, it was
decided to include the type "B" service stations in the B2 zones, rather
than type "C".
A discussion ensued concerning the category entitled, "Franchise new cars -
dealers in used cars must apply for Special Exception." The Board decided
that that item was to be omitted from the Code and in its place add a
category entitled, "Automobile Sales - new and used".
Chairman Bennington said the only thing left to do is go over the Permitted
Uses in the book and see if there is anything that needs to be deleted.
The parking requirements has to be reviewed and updated. Susan Wadsworth
said she has a short list of some of the problems she is having; she asked
that General Offices be added to the Medical Offices and add Medical
Clinics to the parking requirements. Also, requirements need to be estab-
lished for car washes, self-service laundromats~:. rent-aIls. Chairman
Bennington said they need to review also, restaurants and bars.
There being no further discussion, the meeting was adjourned at 9:05 P.M.
