Board of Adjustment Regular Meeting
September 9, 1982
Minutes
Mr. Millard called the meeting to order at 7:06 in the conference area of
the Community Center.
ROLL CALL
Members present: Messrs. Millard, Newell, Wetzel, Roush, Garthwaite and
Mrs. Martin. Absent: Mr. Butt. Also present: Mrs. Taylor, Secretary,
and one member of the press.
APPROVAL OF MINUTES
The minutes of the July 8th and August 12th Regular Meetings were approved
as submitted.
OLD BUSINESS
Henry G. Bartlett - Requesting variances to build a triplex on the northeast
corner of W. Knapp Avenue and Palmetto Street in a R-5A zone.
Mr. Bartlett was sworn in. He advised the Board that he was withdrawing
his request to build a triplex and resubmitting his application for a duplex
at the same location. He said that he discovered after the previous meeting
that his property measured 55.1 feet x 136.68 feet rather than 60 feet by
136.68 feet as he originally thought. He submitted a revised sketch plan
for the duplex, and asked approval of a variance of approximately 15 feet
in the front setback and 10 feet rear setback.
The Board UNANIMOUSLY approved the request for variances for the one-story
duplex, per the revised drawing.
NEW BUSINESS
Mr. William C. Boyd appeared before the Board asking for approval of a
Home Occupational License to permit a business phone at his residence.
Mr. Boyd informed the members that he was a certified contractor, having
worked in the business for 36 years, and a lifetime resident of Edgewater.
Mr. Boyd agreed to abide by the criteria for a home occupation, and he was
advised that the application was approved and to pick up his license at
City Hall.
William G. Harris - Request for Variance to the ~ront yard setback requirements.
Mr. Thomas L. Witter was present to represent Mr. Harris. He stated that the
plumbing was in, but the concrete had not been poured, as indicated on the
application. The proposed dwelling sets back 24.79' from the front property
line, requiring a variance of approximately 5 feet. Mr. Garthwaite believed
that the property could be used as it was supposed to be used and did not think
a mistake was justifiable reason to grant the variance. He could change his
design and move the house back five feet. He felt the land could have been
knocked down, a fill made to make a proper size lot to put the building on.
The Board approved granting the variance with a 5-1 vote, Mr. Garthwaite

George Workman - Application for variances to add front and rear additions
to an existing building in a non-conforming use at 319 N. Ridgewood Avenue
(Tommy's Lounge).
The owner, Mr. Workman, and Phillip Watters, his representative were present
to discuss their request. Mr. Watters was sworn in.
Mr. Workman is requesting a variance to the front and rear building additions
to his property at 319 N. Ridgewood Avenue. The front addition is for
restrooms; the rear addition, approximately 16' x 361, would accommodate
storage, a bandstand and a larger dance area, but would not increase the
seating capacity, which is 75. Mr. Watters said that he would lose two
parking spaces to the expansion, but would still exceed the required parking
by one space.
Mrs. Barbara Garrett, a neighboring property owner, and Rex Arnette, whose
parents lived across the street, were present to speak about the project.
Mrs. Garrett, who~R-3 zoned property abuts the subject property, asked that
a fence be erected to shield her property from the parking lot. Mr. Arnette
was concerned about the noise generated by the business during the late
evening hours, and was seeking assurances that the parking would be adequate.
The Board voted UNANIMOUSLY to grant the variances according to the drawings
and with the stipulations that 1) Adequate marked parking spaces as required
by law will be provided in the immediate parking lot or in a rented lot
across the street; 2) A screening buffer will be erected between the south
property line and the abutting property. The screening buffer will continue
to the front of the building to the building line; 3) A strong and continued
effort will be made to control noise by keeping the back doors closed
during evening hours when the band is playing. The members agreed that
granting these variances for this non-conforming property does not appear
to increase the non-conformity.
James Wagner - Application for a Special Exception to allow a 4-unit
apartment in a B-2 zoning district at 1824 Hibiscus
Mr. Earl Wallace was present to represent Mr. Wagner. He stated that it
would be an up-grading of the area, there was adequate parking, and that
the units met the square footage requirement. Mr. Garthwaite was concerned
about the unsafe condition created by permitting residential homes in a
business district.
The Board UNANIMOUSLY approved the Special Exception as it was shown in
the blue print submitted, with the condition that there be an expiration
date one year from the date of the hearing.
The meeting was adjourned at 9 p.m.
