BOARD OF ADJUSTMENTS REGULAR MEETING
August 11, 1983
Minutes
The regular meeting was called to order by Mrs. Martin, Chairman, in the
Community Center at 7:05 p.m.
ROLL CALL
Members present:
Roush and Newell.
Mrs. Martin, Mrs. Murphy, Messrs. Garthwaite, Wetzel,

APPROVAL OF MINUTES
Mr. Garthwaite motioned to approve the minutes of the July 14, 1983 regular
meeting and the July 28, 1983 special meeting. The motion was seconded by
Mr. Newell and CARRIED 6-0.
NEW BUSINESS
BJ's Flowers and Plants, requesting variances to the rear and front setback
requirements at 917 South Ridgewood Avenue
Mrs. Betty J. Morton, one of the owners of the business, was present to
explain her plans. She explained that the addition to the rear of the
building will be used for a design room and storage. The roof of the
building will be remodeled and sloped. Traffic can go around the building
and go out the front if they wish.
Mr. Garthwaite suggested that each variance be considered separately. The
rear variance was considered first.

spaces. Mrs. Morton said that the majority of their business is at four
different times during the year. There is one parking space on the street.
Mr. Garthwaite made a motion that the back yard variance be approved pro-
viding diagonal parking be provided on the south side and a circular type
drive around the building back out to U. S. 1 be provided. Mr. Newell
seconded the motion. The motion CARRIED 6-0.
Mrs. Morton asked if she could alter the front of the building so that
she needed less of a variance, would they approve that. She needs the
five feet for an overhang because of the sun. She needs protection for
her plants from the sun.
Mr. Garthwaite, explained the request, stating that the former residence
was turned into a business, which now requires a 40 ft. setback from U. S. 1.
He stated that in talking to the owner, and learning what she plans to do,
it will help the building and be of benefit to the City, but it would be
adding to the nonconformity. Mrs. Morton said she has gotten more infor-
mation about the structure of the front of the building where the door and
window are. They do not have to be removed. She needs the porch front
because she must have some type of overhang because of the intense heat.
Mrs. Murphy remarked that a variance stays with the property. Mr.
Garthwaite said that if the roof which will come out five feet can be
constructed in such a way that no ground supports would be needed, it
is possible she would be legal in doing it. The supports may be able to
come back into the building itself. Mrs. Morton said that she could move
the addition to the north back so that it could remain the same size, and
do away with the front addition. Mr. Garthwaite said that if she is just
going to put up the overhang, it is possible there is no variance condition
to consider. This was discussed at length. Mr. Garthwaitie motioned to
DENY the front yard variance as requested. ~s. Marti~seconded the motion.

Mrs. Morton said she would take two copies of the drawings to the Building
Official to see if he would approve the overhang.
Mr. Garthwaite motioned to table further discussion of this request until
the applicant gets with the Building Official for his comments. Mr.
Newell seconded the motion, which CARRIED 6-0.
The plan shows ten parking spaces. Without the addition to the front this
number of spaces would be sufficient.
MISCELLANEOUS
Mrs. Martin asked the Board members to review the Rules and Regulations of
the Board, because this would be on next month's agenda for revisions, if
necessary.
The meeting was adjourned at 8 p.m.
