Continuation of the Pearl Hartsfield request for a variance to the rear
setback requirements to construct a 10' x 18' glass enclosure on her
home at 607 Mary Street
Mr. Madlow Jones was present to represent Mrs. Hartsfield.
Mrs. Martin asked if all the members had read the memorandum regarding the
date which the lot was platted, and called attention to the revised sketch
plan and the building permit attached to the memorandum.
Mr. Garthwaite said that the questions the members had about when the lot
was created and what the setback is have been answered. He noted that the
lot was created before 1974 and there is a 20.5 foot setback, so that the
applicant would not be encroaching further into a nonconforming area.
Mr. Madlow Jones explained that he originally measured from the corner of the
house to the lot line. The property line is not straight. At the location
where the addition will be placed there is 20'5" between the house and the
property line.
After some discussion the members agreed that at the location where the
addition will be placed the setback meets the requirements of the "R-3 zone,
in that it is more than 20 feet from the rear property line.
Mr. Newell asked if the property owner to the
