2023-R-29 - Belvedere Fuel FarmRESOLUTION 2023-R-29 A RESOLUTION OF THE CITY OF EDGEWATER, FLORIDA, IN OPPOSITION TO THE PROPOSED CONSTRUCTION OF THE BELVEDERE FUEL FARM NEAR ORMOND BEACH IN THE UNINCORPORATED AREA OF VOLUSIA COUNTY AT, OR ABOUT 874 HULL ROAD, ORMOND BEACH, FLORIDA.; PROVIDING FOR SEVERABILITY AND APPLICABILITY AND ESTABLISHING AN EFFECTIVE DATE. Whereas, the proposed Belvedere fuel farm would consist of 16 tanks, some 40 feet tall, that will store more than 20 million gallons of gasoline, diesel, ethanol, biodiesel, additives, and propane and will feed a constant stream of tanker trucks (approximately 164 trucks per day), and Whereas, this is an extreme use of commercial zoning which has proximity to the residential neighborhoods of Bear Creek Retirement Community, Ormond Lakes, Ormond Grande Townhomes, Village of Pine Run as -well -as the Ormond Beach Sports Complex with its 29 sports fields. The presence of such a high -use terminal in proximity to residential and recreational f facilities with its traffic and noise generated 24 -hours a day would negatively impact the.quality of life of many tax -paying residents, and Whereas, there are potential safety issues that would exist with thepr ' imity of -Ormond-- Beach Municipal Airport and airport runway, which averages 119,000 operations' Jtakedfs or landings) per year. Operations includeproviding flight instruction to student_'pilots. The" risk of- potential collisions and catastrophic effects are a major concern, and Whereas, there are numerous environmental concerns which would be created. Air quality is impacted by the release of harmful chemicals during fuel storage, transfer, and loading operations. These chemicals can cause a variety of health problems including eye, nose, and throat irritation; headaches and loss of coordination; damage to the liver, kidneys, or central nervous system. Fuel farm emissions, such as benzene, are known to cause cancer. There is also the risk of spills and leaks, which can release large amounts of pollutants into the environment. Spilled fuels can contaminate soil, groundwater, and surface water, posing risks to the aquifer and impacting our drinking water. Storage of flammable and combustible materials also adds additional risks, and 2023-R-29 1 no NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida supports the efforts of the Volusia League of Cities and its members to oppose the construction of the Belvedere Fuel Farm in unincorporated Ormond Beach, and recommends the developer seek a more suitable location in a more remote location outside Volusia County. Section 1. Conflicting Provisions. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 2. Severability and Applicability. If any portion of this resolution is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this resolution. If this resolution or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstance. Section 3. Effective Date. This Resolution shall become effective immediately upon passage and adoption. PASSED AND DULY ADOPTED this g5�day of 2023.
