MEETING OF THE ZONING AND
PLANNING BOARD OF THE CITY
OF EDGEWATER, FLORIDA
HELD MARCH 25TH, 1966
The Meeting of the Zoning and Planning Board was called
to order by Chairman David L. Wiggins, Sr. at 8:00 P.M.
on March 25th, 1966 in the Edgewater Community Center.

Chairman Wiggins announced this is a Public Hearing on four
variance requests. Legal advertisements were placed in the
Daytona Morning Journal and the Daytona Evening News on
March 9th, 1966.

The first variance request to be considered was from the City
of Edgewater requesti'ng the following property be mned commercial.
Legal description is: Property lying east of Lots 4R and 4S,
Assessor's Subdivision of the Alvarez Grant as recorded in Map
Book 3, Page 137 Public Records of the Volusia County, Florida,
including the easterly extension of Park Avenue right of way
being submerged, semi-submerged or filled land. Said property
beginning on the easterly right of way line of Riverside Drive
and known as Edgewater Park and Pier.

Comments, limited to two minutes per person, were as follows:
Wiley Smith - 602 S. Riverside Drive - Opposed - Homeowners
live on Riverside Drive. Trash will be piled up out there
all the time if such a business is started.
Crawford Shaeffer - 218 N. Riverside Drive - Opposed - There
will be a trash pile out there. It will take away from the City.
The purpose of the Park is recreation. What will happen to
the property owners? The property owners will suffer.
Henry R. Palmateer - 920 Lake St. -OPposed - The Park is
for recreation purposes not commercial. It is a playground
for the children.

Kenneth May - 410 S. Riverside Drive - Opposed - If we break
the ordinance for one business on the River Front that is not going
to be the end of it. The best property we have is Riverside Drive
Property. The property value will go down if you grant the variance.
lack Jones - 2511 Umbrella Tree Drive - In favor of the variance
Fishing is recreation. It will not be installed by the taxpayers
but by the man opening the business.

Sam Keel - 301 Old County Road - Opposed - I have two small boys
who like to fish down there. This business will chase kids away.

Mrs. George Latzkowski - 118 Lamont St. - Opposed
I a. a member of the Edgewater Garden club. I am opposed
to such a business on the Park and Pier. This is supposed
to be I park. not a fishing area or fishing business. The Garden
Club is trying to make it beautiful. We have done a lot to make
it beautiful. All members of the Garden Club are against the
rezoning.
Harvey Byrd - 106 W. Park Avenue -OPposed
It should be left as it is. It is a nice playground.
David McGinnis - 107 W. Park Avenue - Opposed
Quite a few people spent a lot of hard work building this
park and pier. It was never in the mind of those people to
use this as a commercial enterprise.
Gayne11 Palmateer - Secretary of Garden Club - Opposed
We have worked for beautification of the City. We have donated
shade trees to the City. We are definitely against it.
Harriet Smith - Garden Club - Opposed - If they put bathrooms
out there as. they intend to do. and they have a fishing business
out there the bathrooms will be ruined. They are in other places.
Chairman Wiggins read a petition signed by nine persons. property
owners. near or adjacent to the Community Pier. requesting the
proposed concession be disallowed.
A letter w.s:~ad from Gillespie. Gillespie and Hall who
represent Mr. & Mrs. David A. Taylor who own river front property
stating the Tay10rs were opposed to this rezoning.
A letter was read from the Edgewater Citic Garden C1u~.wdt~
approximately sixty names on it. stating their opposition to granting
the above variance.

The Meeting was recessed about five minutes.
Property~ners within 300 feet of the following properties were
allowed to speak for or against the following variance requests.
The second variance request to be considered was from David C.
an~Hazel R. Ledbetter requesting the following property be rezoned
fro~residentia1 to commercial. Legal description is: lots 1
to 5 and 1/2 of lot 6. Block 3. Snider Subdivision Hart Street.
beginning at the Blue Gables Trailer Park property line running
south 275 feet and east 100 feet thence North 275 feet and back
to point of beginning.

G. C. Spears - 314 Hart Ave. - Opposed
J. W. Ryan - 400 Hart Ave. - Opposed
J. Curtis Wessell - 401 Hart Ave. - Opposed

Olen Matthews - 118 Oakridge Ave. - Opposed
Dana T. Armstrong - 1801 India Palm Drive - I do not object
to the request for a change in zoning but ample provls1on
should be taken by the City with regards to the drainage
problem.
Mr. J. Lopes - 122 Oakfidge Ave. - Opposed.
Winnifred Matthews - 118 Oakridge Ave. - Opposed
The legal advertisement does not say what will be on the
property but just says commercial.
Mrs. Wimberly - who owns property in the area - spokein
favor of the variance. I would only object if it were going
to be a Night Club or a Skating Rink or something of the
same nature.
Mr. Carl Anderson -Real Estate Broker - who is involved with
this property - said the property will be used for either
a Winn Dixie, Public Market or Thrifway.
Motion duly made and seconded we adjourn to City Hall to
make decision on these variance requests. There were no objections.
Minutes up to this point taken by Marie Robinson.
9:10 P.M.
Motion duly made by Mr. Loveland, seconded by Mr. Shaeffer
the request for a variance at the Park and Pier be denied.
The roll call vote was unanimous.
Motion duly made by Mr. Shaeffer, seconded by Mr. Loveland
the request of Mr. & Mrs. Ledbetter for a variance be granted
for the purpose requested, and by vote CARRIED. The roll
call vote was unanimous.
Motion duly made by Mr. Mosher, seconded by Mr. Shaeffer
the request of Raeburn Judy for a variance be granted with
reservations and by vote CARRIED. The roll call vote was
unanimous with the exception of Mr. Robinson who voted Nay.
Motion duly made by Mr. Mosher, seconded by Mr. Shaeffer
the request of Mr. Powell for a variance be granted with
reservations and by vote CARRIED. The ro~l call vote was
unanimous.
Motion duly made and seconded the meeting be adjourned.
