04-14-1966 .... ;: Q o ~ ~ REGULAR MEETING OF THE ZONING AND PLANNING BOARD OF THE CITY OF EDGEWATER, FLORIDA HELD APRIL 14TH, 1966 The Meeting of the Zoning and Planning Board was called to order by Chairman David L. Wiggins, Sr. at 8:00 P.M. on April 14th, 1966 in the Mayor's Office in the Edgewater City Hall. ROLL CALL David L. Wiggins, Sr., Thomas B. Loveland Clifton E. Mosher W. K. Robinson Arthur I. Shafer Chairman Present Present Present Present Absent Chairman Wiggins announced this is a Public Hearing on two variance requests. Legal advertisements were placed in the Daytona Morning Journal and the Daytona Evening News on ~ .Jb. , 1966. Mr. Wiggins read from the City Ordinances stipulating those who can speak for or against the variance requests. Anyone ~who wished to speak was allowed three minutes to do so. ~ fhe first variance request to be considered was from Ellen T. Cook, 2116 Mango Tree Drive, Edgewater, Florida. The variance was requested to permit her to have a small one booth Beauty Shop in her home. The legal rescription of her property was as follows: Lots 5142, 5143, and 5144, Block 177, Florida Shores No.6, MB23 Page 109 Mr. Donald Mason, 2111 Willow Oak Drive, objected to the granting of the variance. (Mr. Mason does not live within 300 feet of the home) He said when the property owners signed contracts to pnrchase property they were told they could have no businesses. He felt the request was irregular, and it should be turned down. If a business is put in there all the property values will go down. The property values now are lower than when we moved there. (Miss Straub does not live within 300 feet of the property) She said there is commercial property in Florida Shores that is for sale if someone wants to open a business. The following correspondence was read from people who live within 300 feet of the Cook Property. A letter was read from Clayton C. Sterett, Tarpon Springs, Fla. objecting to the granting of the variance. A letter was read from Mr. & Mrs. Louis Barsevick, Evergreen Park, Ill. objecting to the granting of the variance. A letter was read from Mr. Henry John Tenace, Mt. Kisco, N.Y. objecting to the granting of the varaance. A letter was read from Mr. & Mrs. Joseph Barricella, Cliffside Park, N.J. objecting to the granting of the variance. A letter was read from Mr. & Mts. Rosco Stampone, Belleville, N.J. objecting to the granting of the variance. A letter was read from Mr. & Mrs. Joseph J. Herold, Fairview Park 26, ~,Ohio objecting to the granting of the variance. ~ A letter was read from Mr. & Mrs. John Mahon, Paterson, N.J. objecting to the granting of the variance. Aletter was read from Mr. & Mrs. Anthony Ferrara, Staten Island, N.Y. objecting to granting the variance. A letter was read from Mrs. Esther Auker, Chambersburg, Pa. objectng to the granting of the variance. A letter was read from Magnuson Properties, Inc. objecting to any commercial enterprise in the subdivision other than in sectio~ set aside for this purpose, believing that not to do so would be a detriment to the Florida Shores Community as a whole, and to protect property owners and present purchasers who believed they were acquiring property where they could live and/or retire in quiet 100% residential neighborhood. A copy of the sales agreement was attached, on the reverse side of which are reservations, etc. which also appear on deeds to Florida Shores Property. Recess Few Minutes ~ o . . The legal description of her property was as follows: Lots 1 - 2 - 3 and the NDrth 5 feet of Lot 4, Blk. 4, Totem Park, Map Book 4, Page 46, Public Records of Volusia County Florida Lilian Straub and Donald Mason, Real Estate Brokers in the City, objected to the variance. (Miss Straub and Mr. Mason do not live within 300 feet of the above property) They said trere is commercial property in the City and the people would lose faith in the Real Estate Brokers if they find someone opening up a Commercial Business in a Residential Section of town. People pay good money for commercial property and would object to this. Motion duly made and seconded, the board adjourn and discuss this further and make decision. Motion duly made by Mr. Loveland, seconded by Mr. Mosher, that the request of Ellen T. Cook for a variance be denied --~and by vote CARRIED. The roll call vote of those present '-' 'Ias unanimous.
