PUBLIC HEARING HELD
FEBRUARY 11, 1974
The Zoning & Planning Board was called to order on Mpnday night
February 11, 1974, at 7:30 P.M.

Raymond Shambora read the notice for this Public Hearing. It
read that the purpose of this meeting is for the discussion of
the following:
l-Al10wing Businesses on one 40 foot Commercial lot
in Florida Shores.
2-Reducing set back requirements for corner lots on
Indian River Blvd. and 30th Street in Florida
Shores, From 60 feet to 30 feet.
3-Reducing set back requirements for all corner lots
other than those located on Indian River Blvd. and
30th Street in Florida Shores from 30 feet to 15 ft.
4-lncreasing the minimum square footage requirements
for residences built in Florida Shores.
5-Rezoning Commercial property for light business
following lots which are currently zoned for
residential use:
Lots 450 through 456, Block 16, Lots 383 through
388, Lots 315 through 318, Block 13, Lots 254 and
255 , Block 10. All lots being in Florida Shores
Subdivision No.1
6-Pub1ic discussion of building two story homes in
Florida Shores.
This Public Hearing is being called by the Zoning and
Planning to hear interested citizens of Edgewater
before making any recommendations to the City Council
of the City of Edgewater.
The Chairman of the Zoning & Planning Board stated that he would
like to introduce the Florida Shores Lawyer, Mr. Goberna.
Mr. Wolfe stated that we will take each one of these topics one
at a time to di scuss them. For those who don I t know where
these lots are, these are the lots along the railroad at this
time which are now commercial. These were sold years ago before
the City took over Florida Shores.
1- The City minimum is 50 foot but they'd like to keep them at
40. He asked for any comments or any discussion on this
particular topic. There was none.

2- The Chairman stated that this next topic means that the people
who buy along the two right-of-ways has to buy (4) four lots.
They are not allowed to build on the first lot and a half.
He then asked if anyone had any comments on that?
Mr. Goberna explained to the public just why they want to change
this after so many years. As it is now, a person has to buy
four lots and literally throw 1 1/2 lots away. We would like
to reduce the set back requirements, for Indian River Blvd. and
30th Street, just those two streets.
3- After much discussion on topic No.2 they went on to topic No.3
reducing setback requirments for all corner lots other than
those on Indian River Blvd. and 30th Street from 30 feet to
15 feet.
Mr. Wolfe stated that it is now 30 foot back, which is almost
a full lot, and wants to reduce it to 15 feet~ on corner lots.
Councilman John Bevel stated that he owns property on Lime Tree
and Orange Tree, he has four lots on either corner. At the
present time there is a 30 foot setback from the numbered streets.
He stated that his house is setback 30 feet now, if you change
it to 15 feet, what advantage is it going to be to the people
who own property in there other than to make more money from the
property that is theirs, and crowd the houses closer together
and make a less desirable neighborhood. The public applauded.
Mr. Gaberna stated that he does have a point but, we are trying
to see that in the future the people that have that property
will be able to build 15 feet instead of 30 feet. It will not
hurt the individual that is there already, but it can be effective
from now on.
One man stated that if we go this route of building on two lots
that looks like your going to be able to raise YOUr population
dinsity.
4- The Chairman stated that if there were no more comments on topic
no.3 we will go on to no.4 Increasing the minimum square footage
requirements for residences built in Florida Shores. Right now
the square footage is 700 sq. ft.
Councilman Bevel stated that the question is, will it be fair for
the people who bought property here. expecting to retire, be able
to build a small retirement home.
The Chairman Mr. Wolfe stated that his feelings in this is that it
should be increased so that we don't have these Cracker Box homes
being built in Florida Shores.
One man stated that you can build a home 2,000 sq. ft. and still
have a Cracker Box, that's going to the building code.
The President stated that there is no maximum on square footage
but there is a minimum. these comments will be taken before the
Zoning Board and brought before the Public.
5- Rezoning Commercial Property for light business for certain lots
which are currently zoned for residential use.
One man asked for a definition of light business, he stated that
that could mean a lot of things.
Mr. Wolfe stated that this would mean industrial.
6- The Chairman stated that if there was no more discussion on
topic no.5 that we would move on to topic no.6, building two
story homes in Florida Shores.

The Chairman stated that there was a Resolution passed many years
ago that there would not be any two story homes in Edgewater, this
did not have a public hearing so according to the Attorney it is
not constitutional so this time to get this off the record and
put another Resolution back on the record we have to have a Public
Hearing for this. He then asked for any/comments on this.
One man stated that it should be worded as to split level homes
or two story homes.
One lady stated that she could not see any reason for not building
two story homes in Florida Shores, as long as it is a single
family dwelling.
Mr. Harris stated that he would like to say a few words on these
two story homes. He said that he thinks two story buildings
would up grade any place in the City. A two story home is going
to want to be a nicer home. That will help us upgrade the area.
Personally as a builder, he would like to see a person be allowed
to build a nicer home than these cheap homes that are in there
right now.
One man stated that if we are going to build two story homes we
should have some sort of restrictions on them. Reducing the
square footage.
Mr. Harris stated that you have to have so much minimum square
feet on the lower story then the upper story is less.
One man stated that he was still not clear on topic no. 5 the
rezoning commercial property for light business for certain lots
which are currently zoned for residential use.
The Chairman stated that just north of this situation is an
industrial site, and this is almost 50 feet across the road from
the industrial site. However, in front of the little triangle
that is being talked about, there's two commercial set ups there
now. It might be well to think if you did consider this for
commercial you wouldn't have more of the family density sitting
around you, and you already have a commercial zone at the rail-
road. If you get right down to it,your considering a multifamily
setting up there on 6 or 8 blocks. The only thing that he can
see is four building sites. I stated that he felt that we would
be ahead of the game if we did consider it.
Mr. McCallister on the Zoning and Planning Board moved to make a
motion that we recommend this zoning on these lots of topic
no.5, being seconded by Mr. Wiggins of the Zoning and Planning
Board.
Mr. Wolfe stated he thought there should be some provision for
a buffer zone so the residential area would not be looking out
on business property.
Chairman Wolfe recessed the meeting for 5 minutes so the City
Clerk could get the Ordinance concerning light business.
Mr. Wiggins withdrew his second to the motion with Mr. McCallister
withdrawing his motion, for the reason that we need to go into
the Ordinance here a little further. Mr. McCallister moved that
we table this until the next meeting, Tuesday March 5, 1974.
Chairman Wolfe stated that the only other thing that the Board
wishes to vote on tonight is topic no.6 about the two story homes
in Florida Shores. It seems like everyone here is for this.

Mr. Harris made a motion that do allow the building of two story
homes in Florida Shores, being seconded by Mr. Mackie.
Mr. Loveland stated that he assumes that the requirements for
two story homes in Florida Shores would also meet the requirements
in the other areas in the City, as far as the minimum areas.
Florida Shores should be considered like any other part of the
City.
The Chairman stated that we should have an amendment to the
motion and to take in Ordinance 219.
Mr. Wiggins asked if they were considering split level the same
as two story homes.
The Chairman stated that anything would be split level with two
stories.
