Meeting of the Zoning and Planning
Board of the City of Edgewater,
Volusia County, Florida held
February 19, 1963.
The Zoning and Planning Board was called to order by Joseph Emry, Jr.,
Chairman, at 7:30 P.M., February 19th, 1963, in the Community Center
Building.

The minutes of the previous meting \"lore read and, approved. Mot::,:m dul:c
made by Olen Matthews, seconded by O.N. Long and by vote carried.
Chairman Emry - This hearing is on the request of John D. Swartz for a
variance for rezoning that part of his propert~. zoned as residential,
to conmercial, incorder to extend his trailer park, such property being
shown in the attached Sur'ley Plat and two picturos, and as advertised
in the New SJI\YI"IlB. Beach News January 24th, 31st and February 7th.
Since this is a Public Hearing, everyone present will be heard although
ac.:ording to the Ordinance only those within a 300 ft. radius are the
ones to be taken into consideration.
~. W.R. Leach: O/ll1S secondJot from considered property(proposed
railer Pa!"k Extension) is ready to build an $18,900 home there,
it would devaluate his property and he is very much opposed to it.
Mr. Elmo Carden: 117 Hardin Place Northside - Lives within 300 ft.,
about 200 feet, strongLy opposed to said extension because of the
devaluation of his property and not wanting to live near a Trailer
Park, its future uncertain.
Mr. Grant H. McFarland: 119 Hardin Place (Northside) Zoned residential
and should reJl"ain so. Present Trailer Park well kept by Mr. Swartz
but could be sold at ,any time and nc!m owners might not do as well. Kind
of poople renting might be even gypsys or lmdesirable. Not against
trailers as he has lived in one in a Trailer Park, but undesirable
tenants did move in. So opposed to variance.

Mr. Howard Huggins: 1707 S. Ridgewood -1 adjacent to property presently
used as Trailer Park, the same well kept and the Swartz family good
neighbors, sees no reason why the Variance shouldn't be granted. Said
Mr. Swartz & himsllf had measured the distance across to the north
side of Hardin Place and would say it was a little more than 305 ft.
Letters ~mre then read from the follo~dng three property owners
protesting the granting of the Variance:
Mrs. Mary Rodgers - 1716 Riverside Drive
Mrs. Magdalean Vaughn - 115 Hardin Place
Mr. Burton Pedigo - Riverside Drive & Hardin Place
Mr. W.R. Leach - said that }II". Harris, who o~med the small subdivision
adjoining the Swartz property under consideration, planned to build
8 homes and did not want the Variance granted, that Mr. Harris was
to build his (the Leach) home, that Mr. Harris .'laS attending another
meeting or would be at the meeting, that Mrs. Harris had asked Mr. Leach
to attend.
Mr. ElI1:rJ (Board): Mr. S~lartz had told him that Mr. Harris had no objections.
Mr. Swarts: That was ~lhat Hr. Harris had told him.
A question arose as to who owned the subdi ,.-ision 1'.r. . Tizzard or J.tr. Harris ~
Mr. Leach ansl'lered that Mr. Tizzard aold to Mr. Har..ds, and that Mr.
Harris had sold his lot to him.
Mr. Long (Board) Would like to ins~ect to see eXact~r where all the property
owners lived but would go along with the vote.
l-Ir. Hester (Board) Its not close to Riversj_de Drive, it is well kept,
and I can see no reason why it shouldn't be granted.
Mr. Clifford (Board) Did not believe a variance &hould be granted as trailers
are mcvab1e prop"rty, tenants chang-a and .,roocrty ca.n be sold .to anyone
at any time.
Mr. l-K.,atthews (Board) Against granting as it was too close to Riverside
Drive, the highest zoned property of the City. Much time was spent on
the present zoning, that the people had sho\~ that they were satisfjed
with it at the Public Haar1n81 at the time it was enforced, that M4-. Swartz
knew or should have known that part of his property under con~id9ration
was zoned residential when he bought it, and that although the Variance
would help Mr. Swartz it would hurt all the other near by property owners
by devaluation and in other ways.

Mr. Settle (Board) Against any variance unless it was a definite
hardship which he did not feel this was as tItre was now a road
going into the property.
There Wl:\s some discussion as to whether this road could be closed
to Mr. Swartz but the general opinion was that it could not be, as
it is a public road.
Upon request the secretary read the recommendations to the City Council
on two previous requests for rezoning this same property the first one
against, and the second one for it but the main reason for reconmending
the granting-no access to it by road-no longer held true.
After further discussion along the same lines Chaiman Emry asked if
all were ready for tho vote. All agreed and the voting was as followSI-

Chairman Emry: By a 5-3 vote your petition hae been turned down here. You
can go before the City Council and present it to them, as they have the
final say 80; we just make reconmendations.
A motion was duly made by Mr. Long for adjo'lrnment, seconded by }.f.r. Settle
and by vote CARRIED. Adjournment at 8:30 P~M.
