07-22-1971 '". ,. ~- .. , <.J u u Q <.) MINUTES OF ZONING BOARD JULY 22, 1971 DAVID K. MCGINNIS A Zoning Board meeting was held Ju16 22, 1971 in the Courtroom of City Hall at 7130 P.M. ROLL CALL James L. Budd, Chairman Kenneth D. Robinson Thomas B. Loveland Robert D. Fisher Joseph Emery, Jr. Present Present Present Present Absent Chairman Budd read the request of David K. McGinnis asking permission to rezone that portion of Lots 7 and 8 of McGinnis Subdivision to commercial, it is now residential, for the purpose of erecting a steel storage building. All property owners within 300 feet of the area under consideration that were present at the hearing, as well as Mr. McGinnis, Were given an opportunity to be heard. There were no communications received in regard to the request. Mr. Armlin had no objections to the building, didn"t want to stand in way of progress and spoke very highly of Mr. McGinnis. Mr. Wetzel wanted to know what type of building was to be erected. Mr. McGinnis stated the building was steel and would open to the other building. The purpose of the building was to put all the drums and other equipment under cover. Will also put the bee hives under cover. Just wants to improve his own property and the neighborhool. Armond Galileau objected to the building. Mrs. Major objected to the building and the trucks and asked that the following statement be made a part of the minutesl liThe lots in question are not accessable to HiWay #1 except by Western Ave. or Wetzel St. via Park Ave. It's under- standable that existing zoning provides 250 feet west of U.S. 1 where it is accessable to Hiway #1. Federal Courts have ruled spot zoning to be non-constitutionable. I beg of the Zoning board and the City administration to abide by your own zoning laws and protect City property owners by denying the request as partitioned and I further request my statement be made a part of the minutes of this meeting." The property owners were dismissed and the Board reviewed all that transpired at the public meeting. A Motion was made by Mr. Loveland seconded by Mr. Robinson that the variance requested be granted for the purpose of erecting a storage building with the provision that if no construction is started within twelve (12) months from date of approval by the City Council the property shall revert back to the residential zoning status.
