04-22-1982 <..> o CITY OF EDGEWATER Charter Review Commission Meeting Minutes April 22, 1982, 1:00 PM Chairwoman Mason called the meeting to order at 1:11 PM in the conference area of the Community Center. ROLL CALL Members present: Messrs. Millard, Kropp; Rev. Hardin, Mrs. Mason, Mrs. Bennington. Excused: Mr. Dore. Also present: Mr. Mitchell, City Manager, Ivlrs. Winks. APPROVAL OF MINUTES Mrs. Bennington noted a correction to page 2, fourth paragraph. The last sentence "The answer was "yes"." will be deleted from the April 15, 1982 minutes. The minutes of April 15, 1982 were approved with this correction. DISCUSSION OF INPUT FROM ORGANIZATIONAL MEETINGS Mrs. Mason requested from Mr. Mitchell that the Police Chief be present at the Charter Review Public Hearing. Mr. Bennington reported on the PTA meeting and the many questions the group had. They questioned the statement, "There 'shall' be a City Manager...". The concensus of the Commission was that the wording be left as is. Mr. Mitchell noted a change to Article IV, Administrative, Section 2, Powers and Duties of the City Manager, i., which should read ~.. suspend or remove 'any' City employees...". Mr. ~1itchell also asked the Commission if they would like Article IV, Administrative, Section 1, City Manager, a. Appointment. changed to delete the phrase "fixed term". The Commission felt this should stay as it is. The PTA members questioned Article V, Personnel, Section. 4, Anti-Nepotism, as to whether this includes present employees and the exact meaning. Article VII, Transition, Section 3, Rights of Officers and Employees states that this does not affect present employees. The. Commission discussed this in length, and the wording was simplified to state, "No City Council member, City Attorney, City Manager, department head or super- visor, or employee of the City shall directly supervise any individual who is a relative, within the definition provided by state law." The people felt there was a need for a fifth zone, but still wanted to elect the mayor. The Commission decided to bring this up at the Public Hearing and if there is enough support, put in.the transmittal letter to Council. The people questioned Article IV, Administrative, Section 7, Volunteer Emergency Rescue Force, in that in the future the City may warrant having a paid, not volunteer, rescue service. Gayle Harmon was called in to the meeting to ask her opinion on the wording of this section. The Commission agreed to leave all mention of "volunteer" out of this section. The secretary noted that on page one of Proposed Option 1, Section 4, Qualifications, a., the second sentence should read, "One Council member...". Mr. Millard felt that Article III, Legislative, Section 8, Vice-Mayor and Acting Mayor, should be more clearly defined. 'The Commission decided to change the wording as follows: "In the absence o.f' both the mayor and vice- mayor, the acting mayor shall perform the duties of mayor during such absence. Absence shall be defined as not physically present, refusal or inability to act." Article III, Legislative, Section 9, Procedure, f, Emergency Ordinances, 2, Procedure will be changed to state "...affirmative vote of at least fourth fifths (4/5) of the entire Council shall...". Mr. Mitchell noted that in Article VI, Elections, Section 2, Non-partisan Elections, the words "or mayor" should be put in parentheses with an asterisk noting: *If Option II is selected. put on the bottom of the page. Also in Article III, Legislative, Section 4, Qualifications, b. the words "except that the Mayor shall have the qualifications of an elector and shall reside within the City limits." should be put in parentheses with an asterisk noting: *If Option II is selected. In the Preamble and Article VII, Amendment, Section 1, the word "revised" should be deleted. <-) o Article III, Legislative, Section 5, Conflict of Interest was discussed at length. The peoples concern is that this section means that anyone receiving any money from a government source is ineligible to run for office. There were several suggestions from the Commission to reword this section. The concensus of the Commission was to leave this section as it is until further input from the Charter Review Public Hearing. Article VI, Elections, Section 3, Arrangements of Elections, the last sen- tence shall be changed to read,"...decided, and shall cause the same to be published according to law. II The Commission discussed different options for copying the Charter for the Public Hearing on May 10. The meeting was adjourned at 3:05 PM.
