2. APPROVAL OF MINUTES
A motion was made by Mr. Andrejkovics, second by Mr. Rainbird, to approve the Minutes
of the March 9,2022 meeting. The MOTION was APPROVED by the following vote:
Yes: 5- Robert Andrejkovics,George Kennedy,Burton Maroney,Eric Rainbird and Paul Wright
Excused: 1- Albert Amalfitano

a. SD-2201 - Cody Bogart,requesting Preliminary Plat approval for Riverfront Estates
Mr.Lear provided a staff report and recommendation.
Chairman Kennedy opened the public hearing.
Marilyn Jones Bennett, 194 Jones Fish Camp Road asked if this project is the same owner as the
prior meeting in 2020. Mr. Lear stated Lennar purchased this project from the prior owner. Ms.
Bennett asked if the name of the road will still be Jones Fish Camp Road. Chairman Kennedy
advised yes. Ms. Bennett asked if the plans had changed. Cody Bogart of Newkirk Engineering
stated now the plans are not encroaching on the river. There will be no boat slips. Mr. Lear stated
there was a pier and dock that is no longer in the plans. Ms. Bennett stated she had traffic concerns.
Mr. Lear stated a traffic study was done and the study did not indicate traffic issues. Mr. Lear also
stated they will be putting in sidewalks. Cody Bogart stated that Lennar is working on utility and
repaving will happen if any damage is done during the work. Mr. Bogart stated the study did not
indicate the need to repave Jones Fish Camp Road. Ms. Bennett expressed concern regarding
emergency vehicles. Mr. Lear stated this has been addressed in the PUD agreement. Ms. Bennett
stated she is concerned about animals being forced out of their environments and also about

infrastructure. Mr. Lear recommended Cody Bogart from Newkirk Engineering to meet with M.
Bennett to discuss her concerns and discuss the plans.
Chairman Kennedy closed the public meeting and asked for a motion.
A motion was made by Mr. Wright, second by Mr. Maroney, to send a favorable
recommendation to City Council for Item SD-2201. The MOTION was APPROVED by the
following vote:

b. SP-2201 - James Hodges, requesting site plan approval for indoor and outdoor
storage on property land located at 4175 S.Ridgewood Avenue
Mr.Lear provided a staff report and recommendation.
Chairman Kennedy opened and closed the public hearing.
A motion was made by Mr. Andrejkovics, second by Mr. Rainbird, to send a favorable
recommendation to City Council for Item SP-2201. The MOTION was APPROVED by the
following vote:

C. VA-2134 - Ted Linze, requesting a variance from Article V of the Land Development
Code for property located at 1630 Orange Tree Drive.
Mr. Lear provided a staff report and recommendation.
Chairman Kennedy opened and closed the public hearing.
A motion was made by Mr. Andrejkovics, second by Mr. Wright, to approve Item VA-2134.
The MOTION was APPROVED by the following vote:

d. VA-2204 - Yariv Natanel, requesting variances from the Land Development Code
for property located at 1309 South Riverside Drive.
Mr.Lear provided a staff report and recommendation.
Chairman Kennedy opened the public hearing.

Mr. Andrejkovics asked Mr. Lear to define adequate shrubbery. Mr. Lear stated in order to be
considered adequate shrubbery, the shrubbery buffer would not allow the pool to be visible from
Riverside Drive. Mr. Lear stated there will be an inspection to insure this condition is met.
Chairman Kennedy asked if a screen could be put up. Mr. Lear stated yes, but the applicant would
have to submit another variance request.
The applicant, Yariv Natanel, 1209 South Riverside Drive stated he might want a screen in the future.
Chairman Kennedy advised him he would need to submit another variance at that time.
Chairman Kennedy closed the public hearing.
A motion was made by Mr. Wright, second by Mr. Andrejkovics, to approve Item VA-2204
with the condition of adequate shrubbery. The MOTION was APPROVED by the following
vote:
Yes: 5- Robert Andrejkovics,George Kennedy,Burton Maroney,Eric Rainbird and Paul Wright
Excused: 1- Albert Amalfitano
C. VA-2205 - Kristin Gaines, requesting variances from the Land Development Code
for property located at 607 N. Riverside Drive.
Mr.Lear provided a staff report and recommendation.
Chairman Kennedy opened and closed the public hearing.
A motion was made by Mr. Maroney, second by Mr. Wright to approve Item VA-2205. The
MOTION was APPROVED by the following vote:

Excused: 1- Albert Amalfitano
f. VA-2206 - Harold Anderson, requesting a variance from Article V of the Land
Development Code for property located at 3318 Woodland Drive.
Mr.Lear provided a staff report and recommendation.
Chairman Kennedy opened the public hearing.
Mr. Andrejkovics asked if this was an after the fact variance. Mr. Lear stated yes. Mr. Andrejkovics
asked if there is a fine if a variance is after the fact. Mr. Lear stated the building department can
charge double the permit fee, and staff is currently looking to charge more in the future for after the
fact variances. Chairman Kennedy asked if the applicant pulled a permit. Mr. Lear stated no, and it

was an error by the contractor, not the property owner.
Chairman Kennedy closed the public participation.
A motion was made by Mr. Andrejkovics, second by Mr. Maroney to approve Item
VA-2206. The MOTION was APPROVED by the following vote:

g. VA-2207 - Michael V. McGauley requesting a variance for property located at 130
Magnolia Avenue
Mr.Lear provided a staff report and recommendation.
Chairman Kennedy opened and closed the public hearing.
A motion was made by Mr. Maroney, second by Mr. Rainbird to approve Item VA-2207.
The MOTION was APPROVED by the following vote:
