1. CALL TO ORDER,ROLL CALL
Present 6- Robert Andrejkovics,Thomas Duane,George Kennedy,Eric Rainbird,Paul Wright and
Chris Hatcher
Also Present 3- Darren Lear,Sue Williams and Larry Wheatcraft
2. APPROVAL OF MINUTES

3. OLD BUSINESS-PUBLIC HEARING
4. NEW BUSINESS-PUBLIC HEARING
a. RZ-2208 - Joseph H. Hopkins, requesting an amendment to the Official Zoning
Map to include 32.09± acres of land located East of Cow Creek Road and north
of SR 442 as MUPUD (Mixed Use Planned Unit Development) and approval
the of the associated MUPUD Agreement.
Mr.Lear provided a staff report.
Chairman Kennedy opened the public hearing.
Joe Hopkins, Engineer of Record, gave a synopsis of the plan and stated they are trying to keep this
as far from any next door residents, and to maintain it as a secluded and serene natural habitat and
environment. Mr. Hopkins stated they have added a recreational path that will go around the lake on
the property of Serenity Springs. Mr. Hopkins stated he was available for any questions. Mr.
Andrejkovics stated this is a wonderful facility. Mr. Andrejkovics asked if this is on a County Road.
Mr. Lear stated it is a City Road. Mr. Hopkins stated they worked with fire for safety regarding the
road. Mr. Hopkins stated they are currently on water and septic and part of the plan is to get City
hookup. Mr. Rainbird asked if the body of water is staying and Mr. Hopkins stated there are 2lakes
and they have not plan to change them.
Chairman Kennedy closed the public hearing.
A motion was made by Mr. Hatcher, second by Mr. Rainbird, to recommend for approval
Item RZ-2208. The MOTION was APPROVED by the following vote: .
Yes: 7- Albert Amalfitano,Robert Andrejkovics,Thomas Duane,George Kennedy,Eric Rainbird,
Paul Wright and Chris Hatcher
b. VA-2301 - Austin Schwarz, requesting a variance from the Land Development
Code for property located at 501 Finch Drive.

Mr.Lear provided a staff report.
Mr. Wheatcraft provided staffs findings.
Chairman Kennedy opened the public hearing.
Chairman Kennedy asked if we have discussed other options with the applicant regarding the pool.
Mr. Lear stated the applicant will answer that question. Mr. Amalfitano questioned the criterion.
Mr. Wheatcraft clarified the criterion. Mr. Andrejkovics asked if it would be reconsidered it the pool
was moved to a 5 feet setback. Mr. Lear stated those are Environmental Services comments and it
has to do with proper runoff. William Wills, 411 Seagull Court, wanted to address other times at this
property. Mr. Wills stated there are several violations on this property requesting the variance.
Chairman Kennedy stated he needs to call Code Enforcement. Applicant, Shane Regal, 1305 Live
Oak, New Smyrna Beach stated if this City used impervious/pervious like New Smyrna this variance
would be approved. Mr. Hatcher stated this has nothing to do with pervious or impervious coverage.
Mr. Hatcher stated this is about setbacks and the applicant does not have the room for this pool. Mr.
Travis, 317 Seagull Court, stated he does not see a hardship. He is concerned about neighborhood
safety, and they have flooded. Mr. Travis stated the clubhouse has a pool they can all utilize. Shelly
( inaudible), 411 Seagull Court stated she is angry and everyone needs to be treated the same and
fairly and the applicant can use the community pool like everyone else.
Chairman Kennedy closed the public hearing.
A motion was made by Mr. Wright, second by Mr. Rainbird to deny Item VA-2301. The
MOTION was DENIED by the following vote:
No: 7- Albert Amalfitano,Robert Andrejkovics,Thomas Duane,George Kennedy,Eric Rainbird,
Paul Wright and Chris Hatcher
C. VA-2302 - Mike Saxton, requesting a variance from the Land Development
Code for property located at 607 North Ridgewood Avenue.
Mr.Lear provided a staff report.
Mr. Wheat Craft provided staffs findings.
Chairman Kennedy opened the public hearing.
Chairman Kennedy asked why did they want to put in canopy but the do not have gas pumps. Mr.
Lear stated there will be gas pumps. Mr. Amalfitano stated he always thought this was too close to
the sidewalk and a hazard. Mr. Hatcher stated this needs to be shifted back. Mr. Andrejkovics stated
this is the opportunity to right a wrong. Mr. Hatcher asked if there is any reason they cannot move
the building further back. Mr. Lear stated no because behind the building are residents.
Chairman Kennedy closed the public hearing.
A motion was made by Mr. Wright, second by Mr. Andrejkovics, to deny Item VA-2302.
The MOTION was DENIED by the following vote:

Chairman Kennedy asked if there was a Director's report. Mr.Lear stated none at this time.
