Background
The property owners of Carter's Motel and Mobile Village are requesting that a
portion (15.7' by an approximate average 612.08') of Thomas Avenue be abandoned.
Currently several mobile home units on their property encroach into this platted,
unimproved right-of-way. The request would bring the property into compliance
with the City's Land Development Code in regard to the required setback from the
property line.
Land Use Compatibility
This abandonment would not adversely affect the land use compatibility in the
vicinity.
Consistency with Comprehensive Plan
There are no concurrency issues with the proposed abandonment. The proposed
abandonment will remain consistent with the density requirements for the Medium
Density Residential Future Land Use designation.
Other Matters
Letters of approval have been obtained from the affected utility companies and City
governments (Florida Power and Light and The City of Edgewater Department of
Environmental Services with the condition that the applicant provide a utility
laccess easement on said property). The applicant shall provide an easement as
requested.
STAFF RECOMMENDATION:
Staff recommends sending a favorable recommendation to City Council for the
proposed abandonment of a fifteen-foot (15.7') by an approximate average of 612.08'
feet portion of City right-of-way known as Thomas Avenue.

The commercial use of the property is consistent with Objective 1.5, "Land Use
Compatibility", of the City of Edgewater Comprehensive Plan, Future Land Use Element
which states that "Future development must be consistent with the adopted Future Land
Use Map and existing incompatible uses shall not be allowed to expand and shall be
eliminated, when feasible."
