BACKGROUND:
In accordance with Florida statutory requirements, the City of Edgewater advertised a Notice of
Public Hearing informing the public/citizens of the Special MeetinglPublic Hearing regarding the
proposed millage rate of 5.3740 per $1,000 of assessed taxable value and budget for the fiscal year
2007-2008.
The tentative budget as of today includes a proposed operating millage rate of 4.8903, which is a -
9% change of roll back rate and generates ad-valorem revenue of$5,563,363 budgeted at 95%. The
voted debt service millage rate is .0271 and generates non ad-valorem revenue of$32,495.
STAFF RECOMMENDATION:
Staff respectfully recommends that Council consider approval of Ordinance No. 2007-0-15 and
Ordinance No. 2007-0-16 which adopts the tentative millage and budget.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA; ESTABLISHING MILLAGE
RA TES FOR THE CITY OF EDGEW A TERFOR THE FISCAL
YEAR BEGINNING OCTOBER 1, 2007, AND ENDING
SEPTEMBER 30, 2008, STATING THE PERCENTAGE BY
WHICH THE MILLAGE RATE IS LESS THAN THE
ROLLED-BACK RATE COMPUTED PURSUANT TO
SECTION 200.065, FLORIDA STATUTES; PROVIDING FOR
MILLAGE ADJUSTMENT; PROVIDING FOR COLLECTION
OF TAXES; PROVIDING FOR CONFLICTING PROVISIONS,
SEVERABILITY AND APPLICABILITY; PROVIDING FOR
AN EFFECTIVE DATE AND ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. The City of Edgewater, Florida, has received the report of the V olusia County
Property Appraiser dated July 1, 2007, stating the amount of assessed values which he has certified
to the Florida Department of Revenue for non-exempt real and tangible personal property within the
City for the year 2007 for operating purposes; and
2. The City of Edgewater, Florida, has also received the report of the Volusia County
Property Appraiser dated July 1, 2007, stating the amount of assessed values which he has certified
to the Florida Department of Revenue for non-exempt real and tangible personal property within the
City for the year 2007 for voted debt service purposes; and
3. In order to provide the revenue necessary for the operation of the City for its Fiscal
Year beginning October 1,2007, and ending September 30, 2008, the City Council ofthe City of
Edgewater has determined the rate of ad valorem tax levy that must be assessed for the year 2007;
4. In order to provide the revenue necessary to finance a voter approved capital
improvement project for a new animal adoption/rescue facility and to pay debt service on limited ad

valorem revenue bonds in connection therewith for its Fiscal Year beginning October 1, 2007, and
ending September 30,2008, the City Council of the City of Edgewater has determined the rate of
additional ad valorem tax levy that must be assessed for the year 2007 in connection with such voted
debt service; and
5. The provisions of Chapter 200 ofthe Florida Statutes prescribing the method of fixing
millage have been complied with.
NOW, THEREFORE, BE IT ENACTED by the City Council of the City of Edgewater,
Florida as follows:
SECTION 1. Authority. The City Council of the City of Edgewater has the authority to
adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters
166 and 200, Florida Statutes, and pursuant to City Ordinance No. 2004-0-26 and Proposition 4
thereof as approved by the electors of the City.
SECTION 2. Operating Millage Levy. The City Council of the City of Edgewater hereby
adopts, establishes and levies a millage rate for ad valorem taxation of real and business personal
property within the City of Edgewater, Florida, for the fiscal year beginning October 1, 2007 and
ending September 30, 2008, at the rate of $4.8903 per $1,000 of assessed valuation.
SECTION 3. Percentage Change/Decrease of Rolled-Back Rate. The millage rate, as herein
levied, changes/decreases the rolled-back rate computed pursuant to Section 200.065, Florida
Statutes, by -9%, such percentage change/decrease being characterized as the percentage decrease
in property taxes adopted by the City Council of the City of Edgewater.
SECTION 4. Voter Approved Debt Millage. The City Council of the City of Edgewater
hereby adopts, establishes and levies an additional millage rate for non ad valorem taxation of real

and business personal property within the City of Edge water, Florida, for the fiscal year beginning
October 1, 2007 and ending September 30, 2008 at the rate of $0.0271 per $1,000 of assessed
valuation in order to fund a voter approved capital improvement project for a new animal
adoption/rescue facility and to pay debt service on limited ad valorem revenue bonds in connection
therewith. The millage rate of$.0.0271 per $1,000 of assessed valuation represents a 14% decrease
from the prior year debt service millage rate.
SECTION 5. Millage Adjustment. The City Council hereby authorizes the City Manager
to administratively provide the Property Appraiser with the millage adjustment, pursuant to his report
of the aggregate change in the assessment roll as provided for by Section 200.065(5), Florida
Statutes.
SECTION 6. Collection of Taxes. The tax shall be collected by the V olusia County Tax
Collector, subject to discounts prescribed by law, and distributed to the City in accordance with
Florida law.
SECTION 7. Severability. If any section, subsection, sentence, clause, phrase or portion
of this Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion hereto.
SECTION 8. Effective Date. This Ordinance shall become effective immediately upon
passage and adoption.

The Detective Sergeant has requested the Police Chiefs permission to use Law Enforcement
Trust Funds in the amount of $500.00 to be used in defraying the costs of investigative activities.
BACKGROUND:
The Criminal Division (CID) requires the use of special funds to defray the costs of ongoing
investigations and their associated activities. These funds have exhausted due to the costs of
duplicating records, procuring copies of evidence, photographs, documents, and other items
needed for court presentations and prosecutions that are routinely required by the State Attorney's
Office.
STAFF RECOMMENDATION:
Staff recommends that the City Council approve the transfer of Law Enforcement Trust Funds in
the amount of $500.00 to defray the cost associated with criminal investigative activities of the
CID Division.

During the Workshop held on August 28,2007 between the General Employees Pension Board and
City Council, Councilwoman Rhodes submitted her resignation from the Board.

of the General Employees Pension Board), the membership section (subparagraph #B2) states that
one (1) member shall be a council member and selected by a majority vote of the city council.

BACKGROUND
In July of 2007 staff received a letter from Mrs. Charlene Zeese resigning from the Planning and
Zoning Board effective September 1, 2007.
This item was continuedltabled at the August 20, 2007 City Council meeting.
RECOMMENDATION
At their regular meeting of August 8, 2007 the Planning and Zoning Board voted to not make a
recommendation to City Council to fulfill the remainder of Charlene Zeese's term.

Attached you will find the proposed plan modification language that has been discussed
at the General Employees Pension Board meetings this month. It has been expressed that
not all employees are comfortable voicing their opinions regarding implementing this
change. The City would like to give you the opportunity to have a voice without any
pressure.

Retiree Options
A. Existing Retirees who have left City employment are not affected by
changes being considered. Your retirement check will continue unchanged.
B. Existing Retirees who continue employment with the City and receive a
monthly retirement check which is increased each year by additional service with
the City
· Option 1 - Remain in the Defined Benefit Plan accruing service benefits
a) You continue to receive your current retirement check.
b) Future benefit increases after this year will not be paid until you
actually retire.
c) There would be an actuarial offset from your actual retirement
benefit for the value of the previously paid monthly benefits at
actual retirement
d) You continue to contribute 2-1/2% of pay until you actually retire
since it helped to purchase age 55 or 25 years normal retirement
and increasing average compensation to highest 3 years of last 10.
· Option 2 - Actually retire from the Defined Benefit Plan and continue
receiving your monthly benefit with no future increases.
a) You no longer would pay the 2-1/2% contribution.
b) You would then have the option to:
1) Enter the City's Defined Contribution Plan until you leave
employment or
2) Take a pay increase or
3) Enter the City's Deferred Compensation Plan with the ICMA.
C. Future Retirees when you reach your normal retirement date
· Option 1 - Actually retire and begin receiving your retirement benefits
· Option 2 - Defer retirement from your Defined Benefit Plan and continue
accruing benefits until actual retirement. Retirement benefits would begin
at actual retirement. You would continue to pay the 2-1/2% of
compensation until you actually retire.
· Option 3 - Continue working for the City and actually retire from the
Defined Benefit Plan and begin receiving your retirement benefits. You
would no longer pay the 2-1/2% contribution to the plan. You would then
have the option to:
1) Enter the City's Defined Contribution Plan until you leave
employment or
2) Take a pay increase or
3) Enter the City's Deferred Compensation Plan with the ICMA.

Oh, yes it does. If contribution required for 2007 is 1,222,000 and you
only fund 600,000, then 2008 goes up by about $110,000 because the
assets are $600,000 less and that gets spread over future compensations.
However, there is an additional loss for all the payments to the people
still working and receiving benefits. Plus you would have additional
people take advantage of the provision if you make no changes as of
10-1-07. I don't have a very good handle on that. I'm thinking 2008
would probably be 800,000 to 900,000 at the low end and would go up if
more people take advantage of the provision. That's extremely rough,
but I can't get a good estimate without doing additional detailed work.
We can do some more estimates for you, but you might want to wait until
we have the 10-1-07 data to get a more accurate estimate.

modifications efft. 10/1/07 to give the Board and City time to come to

Hi Donna,
If all assumptions were exactly met, the ARC would remain a level
percent of compensation. You can use the same 5.4% salary increase
assumption that we used in the cost estimate. Then if ARC for 2007 is
estimated at $578,000 to $640,000, that would mean an ARC for 2008 of
between $610,000 and 680,000. As we discussed there is a range in the
cost estimate from $578,000 to $640,000, but no guarantee that actual
numbers will end up there after we have the new data for 2007.
Of course, the actual estimate for 2007 will change depending on how you
decide to write the provisions of the plan amendment. I had recommended
to Jack that to be fair to the participants, you may want to make the
actuarial equivalent offset apply only to payments after the effective
date of the amendment. That would cause a loss for 2007 based on how
much was paid out during 2006 for the people still working. Also, the
amendment will help determine where we want to estimate the retirement
age for the ongoing plan.
And I have an additional caution. You might want to add some due to the
stock market reductions lately. There may be an asset loss when we do
the 10-1-07 valuation. Also, if you have a feel for what the salaries
look like that will be reported for the 2007 valuation that would be
another factor. That's, of course, really hard to estimate at this
point before we do the actual numbers!
